[UPDATED] Former A-G Thomas wins appeal to recuse High Court judge in Shahrir's suit

PUTRAJAYA: The Court of Appeal today allowed former attorney-general Tommy Thomas's appeal to reinstate his recusal application against Judge Roz Mawar Rozain from hearing Tan Sri Shahrir Samad's malicious prosecution suit against him.
A three-member bench led by Datuk Supang Lian made the decision on the grounds that a superior court would be better positioned to decide on the allegation of bias, as it was not involved in the trial proceedings.
The other members of the panel were appellate court judges Datuk Faizah Jamaludin and Datuk Ahmad Fairuz Zainol Abidin.
Faizah, when delivering the ruling, said the court agreed there was a real danger of bias if Judge Roz Mawar were to preside over the case, even if the bias was unintentional.
She said the court found that the High Court judge's findings were not based on the book authored by the appellant (Thomas) or on the pleadings (defence) filed by the respondent (Shahrir).
She said the court found that the judge's remarks were formed from her own personal opinion and not based on the merits, and that the judge's findings in the application to strike out the suit were unnecessary.
"As informed and fair-minded observers, based on the facts and circumstances of this case, we are of the view that the findings and observations raise a real risk of bias on the part of the judge.
"If this court finds that a real risk of bias exists, even if the lower court held otherwise, this appeal ought to be allowed.
"The judge in question should have recused herself from hearing any proceedings related to this case," she said.
The court also awarded RM30,000 in costs to Thomas.
Roz Mawar had dismissed Thomas's recusal application in January this year, ruling that it lacked merit.
This followed her decision in July 2024 to also reject Thomas' application to strike out Shahrir's suit.
She ruled that the former Johor Baru member of Parliament's claim did not amount to an abuse of court process and should be heard in full.
Shahrir filed the suit against Thomas, former Malaysian Anti-Corruption Commission (MACC) chief commissioner Latheefa Koya, the MACC and the government, citing malicious prosecution, malicious investigation, and wrongful arrest.
He alleged that Thomas had prematurely authorised his prosecution before the investigation was complete, particularly in relation to a charge for allegedly failing to declare RM1 million received from former prime minister Datuk Seri Najib Razak to the Inland Revenue Board.
Shahrir was fully acquitted in January 2023 after the prosecution withdrew the case.

PUTRAJAYA: Former attorney general Tan Sri Tommy Thomas has succeeded in disqualifying a High Court judge from hearing a defamation suit filed against him by Umno veteran Tan Sri Shahrir Ab. Samad. A three-judge panel of the Court of Appeal allowed Thomas' appeal to disqualify Justice Roz Mawar Rozain from hearing the case in its future proceedings. In the unanimous decision, read out by Justice Faizah Jamaludin, the panel ruled that the findings of the High Court judge were neither based on the book written by Thomas nor the pleadings filed by Shahrir. The panel chaired by Justice Supang Lian, found that the statement made by the judge when dismissing Thomas' striking out application of the main suit was based on an opinion that she formed rather than by merits of the case. 'As an informed and fair-minded bystander, given the facts and circumstances of the case, we perceive that these findings and observations do give rise to a risk of real danger of bias by the learned judge even though the bias may be unintentional. 'We allow this appeal and set aside the decision of the High Court judge dated Jan 14 with order that the learned High Court judge recuse herself from all future proceedings in the trial,' Justice Faizah said. Justice Ahmad Fairuz Zainol Abidin is the third judge of the panel. Thomas filed the recusal application on Aug 26 last year, claiming that Justice Roz Mawar had made numerous baseless findings and contradictory statements to the claims in the lawsuit and the evidence presented in court. On Jan 14, Justice Roz Mawar dismissed Thomas's application, saying that an unhealthy trend had emerged of litigants seeking to disqualify judges from hearing their cases which is capable of eroding public confidence in the judicial arm of the state. Thomas then filed an appeal at the appellate court. The application stemmed from Shahrir's lawsuit against Thomas over what the former claimed was a malicious prosecution. Shahrir was charged at the Sessions Court on Oct 21, 2020, for allegedly failing to declare a RM1mil cheque he received from former prime minister Datuk Seri Najib Razak to the Inland Revenue Board (LHDN) for restoration work on the Puri Langkasuka housing project in Larkin, Johor. On Jan 5, 2023, High Court judge Justice Muhammad Jamil Hussin acquitted the former Johor Baru MP of the charge. In December the same year, Shahrir filed the lawsuit and named Thomas, former Malaysian Anti-Corruption Commission (MACC) chief commissioner Latheefa Koya, the MACC, and the government as defendants, for alleged malicious prosecution against him. Thomas, who served as AG from June 4, 2018, to Feb 28, 2020, refuted Shahrir's allegations of abuse of power, describing them as 'unsustainable'. He stated that the discretion to charge could only be exercised after the AG receives the investigation papers from agencies like the MACC. Thomas said he resigned on Feb 28, 2020, and that Shahrir's criminal trial for the charges began on July 26, 2022.

LONDON: Pro-Palestinian campaign group Palestine Action's co-founder on Friday lost a bid to pause the British government's decision to ban the group under anti-terrorism laws, with the group losing an urgent appeal meaning it will be banned from midnight. Huda Ammori, who helped found Palestine Action in 2020, asked London's High Court to stop the proscription of Palestine Action as a terrorist organisation, before a full hearing of her case that banning the group is unlawful later this month. The High Court refused to pause the ban and, following a late-night hearing, the Court of Appeal rejected an appeal against that decision at just after 2130 GMT. British lawmakers this week decided to ban Palestine Action after its activists broke into a Royal Air Force base and damaged two planes in protest against what the group says is Britain's support for Israel. Proscription will make it a crime to be a member of Palestine Action that carries a maximum sentence of 14 years in prison. Palestine Action has increasingly targeted Israel-linked companies in Britain, often spraying red paint, blocking entrances or damaging equipment. The group accuses the British government of complicity in what it says are Israeli war crimes in its ongoing bombardment of Gaza. Israel has repeatedly denied committing abuses in its war in Gaza, which began after Palestinian militant group Hamas attacked Israel on October 7, 2023. Ammori's lawyer Raza Husain said the proscription marked the first time Britain had sought to ban a group carrying out such direct action, describing it as 'an ill-considered, discriminatory, authoritarian abuse of statutory power'. Critics of the government's decision, including some United Nations experts and civil liberties groups, have also argued that damaging property does not amount to terrorism. DEFENCE FIRMS TARGETED The group has particularly focused on Israeli defence firm Elbit Systems and Britain's government cited a raid at an Elbit site last year when it decided to proscribe the group. The decision to ban the group came as four members were charged over the incident at the RAF Brize Norton air base, in which military planes were sprayed with red paint. Husain said that was the only example of action targeting a government or military facility and previous incidents were against private companies, to support his argument against proscribing Palestine Action. Home Secretary Yvette Cooper, Britain's interior minister, has said violence and criminal damage have no place in legitimate protest and that Palestine Action's activities justify proscription. Judge Martin Chamberlain earlier ruled against Ammori's bid to pause the ban, saying that any harm to Palestine Action members or supporters did not outweigh 'the strong public interest in maintaining the order' to ban the group.

TAWAU: The Eastern Sabah Security Command (Esscom) which was established 14 years ago has maintained its excellent performance not only in creating peace but also in bringing benefits to the community in the Eastern Sabah Security Zone (ESSZone). Home Minister Datuk Seri Saifuddin Nasution Ismail said Esscom remained committed to its core task of creating peace and through that, many government plans could be implemented, including the Madani Adopted Village Programme in Kampung Inderasabah here. "Esscom, with an allocation of RM1 million, has selected Kampung Inderasabah to carry out several physical and non-physical infra projects," he told reporters after officiating the Esscom Madani Adopted Village in Kampung Inderasabah on Friday. He said Prime Minister Datuk Seri Anwar Ibrahim had previously announced an allocation of RM200 million for the implementation of the programme this year, which involved 200 villages nationwide, including 12 or 13 villages under the Home Ministry. Esscom chief executive officer Datuk Dr Jamaluddin Mohd Ali said the selection of Kampung Inderasabah was based on several important justifications, including the unique security challenges faced. He said the justification was also seen from the aspect of potential for eco-tourism and fisheries development as well as the geographical location of the village which is close to the border of the waters of neighbouring Indonesia. "The Finance Ministry agreed with Esscom's proposal and approved RM1 million on March 1, projects received approval from the ministry, namely the construction of the village entrance gate, upgrading the pavilion, the open hall of SK Inderasabah, the futsal court and the Al-Furqon Mosque. "Other projects include the upgrading and installation of solar street lights in the village, repairing the village footbridge, the jetty at the base, the Kemas Daycare Center area, and the church in addition to implementing programmes with the local community," he said. Jamaluddin said Esscom, in collaboration with Tawau Municipal Council and GiatMara Tawau as the implementing agency, would ensure that the projects involved ran smoothly and were given priority so that they could be completed this year. "Esscom also hopes that through this initiative, it can further strengthen the relationship between Esscom and the community in ESSZone, thus ensuring Eastern Sabah area continues to be peaceful, prosperous and resilient," he added. Apas assemblyman Datuk Nizam Abu Bakar Titingan said for the past 14 years, Kampung Inderasabah community has been a strategic partner for Esscom, whether in terms of prevention of cross-border crimes, including involvement in community programmes. "On behalf of the residents of Apas constituency, I would like to express my gratitude and welcome this initiative because we are confident that it will bring progressive change and address the problem of poverty as well as ensuring infrastructure in the village is improved," said Nizam, who is also the Assistant Minister to the Chief Minister. – Bernama
