KZN MEC Thulasizwe Buthelezi faces lockout at UMkhanyakude District Municipality
According to a media statement released by the department, the MEC was 'compelled to instruct officials to break locks that were used in an attempt to prevent him from addressing councillors.'
The MEC described the incident as a blatant act of obstruction by officials, including the Speaker and Municipal Manager of the Umkhanyakude District, who 'barricaded the entrance to the municipality' to stop him from fulfilling his constitutional responsibilities.
Condemning their actions, Buthelezi said: 'This conduct is unacceptable and goes against the principles of good governance and accountability. I will not be deterred in carrying out my constitutional mandate.'
With the doors to the municipal offices locked, the MEC held his meeting at the entrance of the building, where he informed councillors that the Provincial Executive Council had resolved to place the municipality under administration in terms of Section 139(1)(b) of the Constitution.
'This section empowers the provincial government to appoint an administrator when a municipality fails to fulfil its duties of providing services to communities,' Buthelezi explained.
He announced the appointment of Mr. Bamba Ndwandwe as the new administrator. 'Mr. Ndwandwe is a seasoned local government veteran with extensive experience working with various municipalities across the province,' the MEC said. Ndwandwe officially took office on 1 July.
His immediate mandate is to stabilise the municipality and develop a 'comprehensive turnaround plan' to address the issues that led to the intervention.
Buthelezi also revealed that a forensic investigation, authorised under Section 106 of the Municipal Systems Act, had been launched to probe allegations of corruption and maladministration.
'The investigation aims to thoroughly examine the various allegations, and officials will be held accountable should any wrongdoing be uncovered by the investigators,' he said.
The MEC called on the absent municipal leadership to cooperate fully with both the administrator and investigators, stressing the importance of urgency.
'MEC Buthelezi reiterated his unwavering commitment to working collaboratively with all KZN Municipalities to ensure they effectively deliver services and prioritise the interests of their communities,' the department stated.
Despite the confrontation, Buthelezi affirmed: 'The MEC remains undeterred and will continue to work in the best interests of the residents of the KwaZulu-Natal province.'

Zondi insisted that the ANC should promptly initiate an internal investigation into the allegations and refer the two MECs to its integrity commission. 'It is in the interest of the two MECs to have their names cleared, and it is in the ANC's interest to clear its own name quickly,' he stated, emphasising the critical importance of a swift response to uphold the credibility of the government. Political turbulence surrounded Hlomuka and Simelane, after claims surfaced that their personal business affiliations may have improperly influenced government contract awards. In an interview with Newzroom Afrika, Hlomuka contended that he had distanced himself from the implicated company, insisting he was no longer part of it and was unaware of its ongoing activities. 'If it has received any tenders, that information will come out in the investigation,' he added, urging patience for the forthcoming revelations. Provincial Premier Thami Ntuli has demanded thorough explanations from both MECs following the serious corruption allegations. Asserting the need for transparency, Ntuli confirmed that he had proactively reached out to both executives for clarification as soon as he became aware of the claims. 'I would be writing to them so that they give me full information regarding the allegations,' he noted, awaiting their responses by today. Hlomuka's spokesperson Muzi Mahlambi confirmed that the premier had written to the MEC requesting him to give explanation on the allegations regarding school nutrition. Mahlambi alluded that the MEC has also responded to the letter. 'The MEC (Hlomuka) has responded to the letter from the Premier, however, we must give both the MEC and Premier space to process the responses as per premier's request. "What we also need to indicate is that the current tender or contract that is in place now is not disturbed,' said Mhlambi. Further complicating matters for the ANC, Health MEC Simelane faces scrutiny over her family's potential improper gain from government contracts. The implications of her alleged business ties could further erode public confidence in the party's commitment to ethical governance. Zondi reiterated the need for the party to reconcile these allegations with its core promise of ethical governance, which he stated was crucial for any hopes of renewal. 'Defending its own is to assume their innocence without verification,' he cautioned. 'It has caused the party many problems in the past.' Simelane-Mngadi rubbished the allegations against her, threatening to take legal action against people who have implicated her in the Ithala corruption loan scandal. It was alleged that the MEC used her position of power as the chairperson of the Agriculture and Rural Development portfolio committee some years ago to get funding for a family company in Ithala and in government. The allegations surfaced on social media platforms a week ago. However, in statements she issued last week, she reiterated that the allegations were false and malicious, saying she was exploring the legal route. 'I'm exploring legal action to protect my name and my integrity and take to task those who deliberately and nefariously wish to impugn my good name. In our system of government, the separation of powers is clear, MPLs, including committee chairpersons, have no role in Supply Chain Management or operational decisions of departments. Therefore, I could not have influenced any procurement processes."These facts are easily verifiable, and their deliberate distortion shows that this is not an attempt to inform the public, but rather a well-calculated political smear campaign,' concluded Simelane-Mngadi. Auditor-general demands action from KZN Cogta MEC in troubled uMkhanyakude municipality
Auditor-general Tsakani Maluleke has instructed KwaZulu-Natal Cogta MEC Thulasizwe Buthelezi to intervene in the trouble-torn uMkhanyakude district municipality. Buthelezi, an IFP deployee in the provincial legislature, and ANC-led uMkhanyakude officials are at loggerheads over the provincial cabinet's decision to place the council under administration. uMkhanyakude officials are resisting the decision, saying it is politically motivated. They have since taken Buthelezi to court over the matter. Earlier this month, Buthelezi was forced to announce that the municipality had been placed under administration at the entrance of the council offices after he was denied entry. On Sunday, Buthelezi said he had received formal correspondence from Maluleke instructing him to intervene in uMkhanyakude. 'The auditor-general has requested that I intervene in the uMkhanyakude district municipality due to the municipality's consistent failure to address material findings. These findings stem from the municipality's inability to implement a credit and debt collection policy, as required by section 62(1)(f) (ii) of the Municipal Finance Management Act (MFMA),' said Buthelezi. A material irregularity is defined in the Public Audit Act (PAA), as 'any noncompliance with, or contravention of, legislation, fraud, theft or a breach of a fiduciary duty identified during an audit performed under this act that resulted in or is likely to result in a material financial loss, the misuse or loss of a material public resource or substantial harm to a public sector institution or the public'. In the correspondence, Maluleke highlighted that 'The failure of the municipality to implement the municipality's credit and debt collection policy for a number of years and to take reasonable steps to recover outstanding debt from consumers is likely to result in a material financial loss for the municipality'. The AG further stated that: 'The failure of the accounting officer to take appropriate actions to address the material irregularity led to a decision by the AGSA's material irregularity committee, duly delegated, to approve reporting in the audit report of the municipality on the material irregularity with recommendations, as provided for in section 20(4) of the PAA, read with regulation 4(3) of the MI regulations on the steps the accounting officer should take to address the material irregularity within a stipulated period in the audit report.' Buthelezi said he was aware of the grave nature of the issues raised by Maluleke, which were emphasised during a meeting with the AG on July 23. He said he was committed to acting in the interest of the residents of the uMkhanyakude district. 'These residents bear the brunt of failed service delivery due to a lack of governance, financial, and consequence management measures within the district,' he said, adding that the AG has requested a formal report from him by August 15.

Kunene, who was serving as Johannesburg's MMC for Transport, resigned from his positions as a Proportional Representation (PR) councillor and as a Member of the Mayoral Committee (MMC) for Transport in the City of Johannesburg on Saturday, after the Patriotic Alliance placed him on suspension pending an investigation into his alleged association with a murder suspect. In an interview on eNCA, Morero explained that Kunene's resignation meant the city could not pursue any internal inquiry. 'Council works quite differently. He has resigned as a councillor, meaning he's no longer part of council. And council, therefore, does not have jurisdiction over him in terms of our code of conduct as councillors,' Morero said. The Democratic Alliance has written to the mayor, demanding a full investigation into Kunene's conduct. ''The Democratic Alliance (DA) in Johannesburg notes the resignation of Mr Kunene as PR councillor and MMC of Transport in the City of Johannesburg,'' said the party in a statement on Saturday. The party said this came after it wrote to Morero demanding Kunene's removal as MMC of Transport, citing the powers granted to the Executive Mayor under section 60 of the Municipal Systems Act. While Kunene is no longer a councillor, the DA stated it still demands that investigations proceed as outlined in its letter to the Mayor. The party is calling for a full investigation into all contracts and procurement processes at the Johannesburg Roads Agency (JRA), a full investigation into the contractors and procurement process behind the Lilian Ngoyi Street repairs, and a full investigation into contracts, appointments, and procurement processes at the Metropolitan Trading Company (MTC). The DA maintains that Kunene had direct political oversight of these processes, organisations, and projects. DA Johannesburg Caucus Leader Belinda Kayser-Echeozonjoku said: 'Should the Executive Mayor fail to respond to the DA within 7 days, the DA will use all avenues at our disposal, including approaching law enforcement with the information available to us, to hold the Executive Mayor as Shareholder representative himself responsible for the alleged irregularities at JRA and MTC.' Morero acknowledged receiving the correspondence but noted that it likely arrived before Kunene's resignation. 'They know the law. They know the code of conduct of councillors,' he said, adding that his office would respond formally. Morero also confirmed that the city is working to fill the vacant MMC for Transport position: 'We are still discussing internally and at the right time we will announce the replacements. In no time we will give you the responses,' he said. Turning to transport-related issues, Morero addressed concerns over the Bree Street refurbishment project, which faced delays during Kunene's tenure. He confirmed there were problems with the initial contractor. 'The contractor was not meeting the milestones as required. The contractor also raised concerns about cash flow and about payments not coming on time. But as a result, between the contractor and the city, the contract was therefore nullified and a new contractor was brought in,' he said. Despite earlier delays, Morero assured residents the city is back on track. 'The contractor made a commitment to us that indeed by the end of August, when the explosion has happened, they would have concluded the work. So we are on track and by the 30th of August we should be in Bree Street or Lilian Ngoyi Street to announce the completion,' he said. The mayor revealed that the project's second phase ,widening the road, adding pavements, planting trees, and creating a more pedestrian-friendly 'complete street' , will take another year. 'We do apologise and we have said so to our residents that unfortunately there were contractual issues which led to the delays, and we are resolving them,' Morero said.
