
Facial recognition tech not a green light for surveillance
Although the inquiry found the trial legal and generally compliant with the Privacy Act, important questions remain, and the report recommends that the technology stay under active review.
People who may have been paranoid about facial recognition technology being used to monitor their every move in supermarkets – what's purchased and so forth – can rest easy.
The commissioner found the technology was only used for the very narrow purpose of deterring serious incidents of violence and high-value retail theft by matching customers against a store's 'watchlist' (the image database of people of interest). It was not used for any other purpose, including minor retail crime prevention. The report cautioned against any future 'mission creep' in this regard.
Furthermore, although everyone entering a store with such technology had their face scanned, images that did not trigger a match against the store's watchlist were deleted almost instantaneously.
Meanwhile, watchlist data was deleted after two years in the case of perpetrators (and three months for their accomplices).
The number of people put on watchlists peaked at 1800 during the trial and was down to 1504 at the end. Crucially, watchlist data was specific to each store, meaning there was no master list shared within the Foodstuffs' network. This meant anyone who had been added to one store's watchlist could still shop elsewhere, including at a store without facial recognition technology.
Just as importantly, the criteria for being added to a watchlist were strict: either a conviction or a trespass notice was required. There was also de-linkage from other incident reporting systems, and watchlists were compiled manually.
A two-camera/two-staff fail-safe system was adopted for positive matches, and the commissioner's report found no bias in how watchlists were compiled as well as used. Children and young people were excluded from watchlists.
Meanwhile, Foodstuffs also maintained record keeping for judging the effectiveness of the facial recognition trial.
A 16 percent decrease in serious incidents and an estimated 21 percent decrease in shoplifting in the participating stores was recorded. In addition, 115 serious incidents were avoided (including 65 people deterred from entering and 50 others through staff intervention). However, some scepticism was expressed because of qualitative limitations in the overall data set (especially data from non-participating stores which operated as the control group).
The report documented at least two instances of misidentification, resulting in harm. Partly as a result, the accuracy rate required for positive matches was increased from 90 percent to 92.5 percent, although this still needed to be implemented. The Office of the Privacy Commissioner's Māori Reference Panel had opposed facial recognition technology in principle but gave advice enabling further safeguards to be adopted.
Finally, the report cautions that its findings are 'not a green light for more general use of facial recognition technology'. This is a salutary reminder that decisions to employ it should not be taken lightly.
Few small and medium-sized businesses will have the resources of Foodstuffs. The trial succeeded because of its investment in human time and effort. Technology, ultimately, is no substitute for this.

The supermarket has so far continued to pay the staff, but First Union, which represents about 40 of the workers, told Checkpoint there's now a proposal to make all the workers redundant. Some will have the opportunity to work at other stores. Foodstuffs North Island confirmed in a statement that the process of disestablishing roles at the store is underway. It said it's supporting staff to find new roles, including positions at nearby stores, at its support centre, and distribution centres. It comes after Foodstuffs North Island confirmed it would bring forward the opening of New World Pt Chevalier following the Victoria Park fire. The Pt Chevalier store, originally scheduled to open on 9 September, will now open earlier, with the team working towards an opening date of 19 August. Foodstuffs North Island chief executive Chris Quin said the damage to New World Victoria Park was extensive, and the store was expected to be out of operation for approximately two years while significant rebuild work takes place. He said the new Pt Chevalier store will be the closest New World option for many affected Victoria Park shoppers, especially those in surrounding suburbs. "Since the fire, we've heard from so many locals who told us how much they'll miss Victoria Park. Some even described it as their 'extended pantry'," he said. "We know how important it is to have access to a full-service grocery store in the area, and bringing forward the opening of New World Pt Chevalier is one way we can help meet that need." Foodstuffs North Island said it is expected some staff from the Victoria Park store will have opportunities at the new Pt Chevalier supermarket while others are being redeployed elsewhere in the company. "We're actively prioritising affected team members in recruitment across our network," he said. "It's been a challenging time for the Victoria Park team. Our goal is to support them into a new opportunity and ensure they feel looked after through this transition." Foodstuffs North Island said it is working with the owner-operators of Victoria Park and its wider co-operative network to support affected staff in finding new roles, including positions in nearby stores, its support centre, and distribution centres. The company also confirmed the fire investigation work was completed, with Foodstuffs next week beginning to process of removing damaged parts of the building to make it safe for teams to begin clearing stock and equipment from the store. Foodstuffs North Island warned for 'likely' breach of supply code
Foodstuffs North Island has been issued a warning for treatment of a supplier that likely breached the Grocery Industry Competition Act 2023. The Commerce Commission said it believed Foodstuffs North Island "likely breached a fundamental aspect of the Supply Code which is that retailers deal with suppliers in good faith at all times". The company responded to the commission's warning by stating it took its obligations to suppliers seriously and was committed to keeping fair and constructive relationships. New Zealand's mandatory Grocery Supply Code was introduced under the Grocery Industry Competition Act, created to increase transparency and certainty for suppliers through a set of rules supermarkets need to follow when dealing with suppliers. "Foodstuffs North Island appears to have obstructed and delayed a supplier request by acting in ways that we believe were uncooperative and unreasonable," said Grocery Commissioner Pierre van Heerden. ADVERTISEMENT He was "concerned" this followed a pattern of behaviour that has been present in the industry for decades. "This behaviour has been enabled for so long, due to the significant power imbalance between the major supermarkets — who hold the vast majority of the market — and suppliers, who have limited bargaining power in comparison," he said. A category manager at Foodstuffs North Island — who acted as the main point of contact for the supplier — also came under investigation regarding their role in the matter. "Suppliers are reliant on their relationships with the retailers' commercial teams, so the staff in these roles within the supermarkets hold a lot of power. Any behaviour that weaponises this power imbalance is unacceptable," van Heerden said. "The major supermarkets have a responsibility to make sure their staff are properly trained. They need to make sure their staff follow the rules and deal with suppliers in good faith. "The changes we're proposing to the Supply Code are intended to provide more scrutiny to these relationships and clarity about what is acceptable behaviour." Grocery Commissioner Pierre van Heerden says Foodstuffs North Island likely breached a fundamental aspect of the Grocery Supply Code, that states retailers must deal with suppliers in good faith at all times. The Code is under consultation at the moment and as part of that the regulator wants to strengthen the position of suppliers with supermarkets.
