KUALA LUMPUR: The High Court was told that SRC International Sdn Bhd, initially intended to serve the public, was instead exploited to benefit former prime minister Datuk Seri Najib Tun Razak.
Lawyer Datuk Lim Chee Wee, representing SRC International, argued that the company became both a vehicle and victim of large-scale fraud, with Najib as the primary beneficiary.
The civil suit involves US$1.18 billion in losses, with Najib accused of personally receiving US$120 million and RM42 million from misappropriated Retirement Fund Inc (KWAP) pension funds.
Lim stated, 'The very funds misappropriated through SRC were pensioners' money from KWAP. While SRC International suffered a devastating loss of US$1.18 billion, the first defendant (Najib) personally received US$120 million into his own accounts.'
Najib allegedly acted as a shadow director, controlling key decisions through shareholder resolutions, including approving a RM4 billion KWAP loan and disbursing RM3.6 billion for illegitimate purposes.
Lim added, 'He utilised his role as the shadow director of the company, where he controlled the company's board via shareholder resolutions on important macro-decisions.'
SRC International, under new management, filed the suit in May 2021, accusing Najib of breach of trust, abuse of power, and misappropriation of funds.
The company seeks a court declaration holding Najib accountable for losses and demands repayment of RM42 million.
Najib is currently serving a six-year prison term for the misappropriation of RM42 million in SRC funds, following a reduced sentence from the Pardons Board in January 2024. – Bernama

KUALA LUMPUR, July 8 — Malaysia has pledged to continue engaging the United States in pursuit of a fair and balanced trade agreement following the surprise announcement of a 25 per cent tariff on Malaysian goods. The Ministry of Investment, Trade and Industry (MITI) said it took note of the US decision and emphasised the importance of maintaining constructive relations. Washington's move, announced by President Donald Trump in a letter to His Majesty Sultan Ibrahim, the King of Malaysia, will take effect from August 1 and applies to all Malaysian exports entering the US. Trump cited 'Tariff, and Non Tariff, Policies and Trade Barriers' as the reason behind the action, which he described as a response to persistent trade imbalances. Malaysia said it valued the longstanding economic partnership with the US and believed that open and fair trade supported growth and jobs in both countries. MITI reaffirmed its commitment to good-faith discussions aimed at resolving trade issues and concluding negotiations on mutually beneficial terms. 'These efforts are still ongoing and reflect Malaysia's willingness to reach a fair and sustainable outcome for both parties,' the ministry said. The US is Malaysia's second-largest trading partner and its top export destination, with trade in 2024 rising nearly 30 per cent to RM324.9 billion. Exports to the US accounted for RM198.7 billion, while Malaysia imported RM126.3 billion in goods from the world's largest economy. Miti acknowledged Washington's concerns but maintained that dialogue remained the best way to resolve differences. It also cautioned that unilateral actions could disrupt business operations, supply chains and investment flows. Miti then called for solutions that protect both nations' interests and ensure continued economic development. The ministry said it would continue to clarify the scope of the announced tariffs with US counterparts and seek a timely resolution. The Malaysian government concluded by saying it would take 'all necessary steps' to protect local businesses, workers and consumers from the new measures. Trump's letter had left open the possibility of further tariffs should Malaysia increase its own trade barriers. He said Malaysia could avoid tariffs if its companies relocated production to the US, describing the American market as 'the Number One Market in the World, by far.'

Managing director Datuk Amirul Feisal Wan Zahir said the discussions focused on how Malaysian, French and Italian companies could work together amid shifting global geopolitical dynamics. "We looked at how we can collaborate (with them) when it comes to technology innovation, and even some of the mid-tier companies that they have and that we have, and see how we can collaborate further. "We realised that we were facing the same issues: how do we look at being globally competitive using artificial intelligence and innovation, and how can we find new markets,' he told reporters in Brazil at the conclusion of Prime Minister Datuk Seri Anwar Ibrahim's official visits to Italy, France and Brazil. Khazanah was part of the Malaysian delegation on the official visits, which began on July 1 and were aimed at strengthening bilateral relations and boosting trade and economic cooperation. Other major Malaysian participants included Petroliam Nasional Bhd, Tenaga Nasional Bhd , Malayan Banking Bhd , FGV Holdings Bhd and YTL Power International Bhd . Amirul Feisal said Khazanah has partnered with Cassa Depositi e Prestiti, Italy's national promotional institution, for two years, and with Bpifrance, also known as Banque Publique d'Investissement, for three years. The visits to Rome, Paris and Rio de Janeiro were also part of efforts to reinforce diplomatic and commercial ties with key economic partners. Collectively, bilateral trade with Italy, France and Brazil amounted to RM50.91 billion (US$11.14 billion) last year. Khazanah posted its highest-ever annual return in 2024, achieving a net asset value (NAV) time-weighted rate of return (TWRR) of 24.6 per cent, a sharp increase from 5.7 per cent the year before. Its total portfolio, or realisable asset value (RAV), rose to RM151.3 billion, while operating profit reached RM5.1 billion. - Bernama

KUALA LUMPUR: Malaysia is pushing for global aircraft manufacturers Airbus and Embraer to establish the country as a key hub for maintenance, repair, and overhaul (MRO) operations, training, and supply chain activities. This follows major aircraft purchase agreements by AirAsia and Malaysia Airlines. Transport Minister Anthony Loke stated that the government is ensuring these aircraft deals bring broader economic benefits to Malaysia. 'Our strategy ensures these purchases are not one-way transactions. We want investments that boost Malaysia's aerospace sector,' he said during Prime Minister Datuk Seri Anwar Ibrahim's official visit to Brazil. Loke also proposed that Airbus consider Malaysia as a potential location for a final aircraft assembly line, given the company's backlog of 8,000 undelivered planes. 'Airbus faces supply chain challenges. We hope they expand operations here, creating jobs and strengthening our aerospace industry,' he added. AirAsia has confirmed an order for Airbus A321XLR long-haul jets worth US$12.25 billion (RM51.72 billion), with deliveries starting in 2028. Meanwhile, Malaysia Airlines' parent company, Malaysia Aviation Group (MAG), has ordered 20 additional A330neo aircraft, bringing its total commitment to 40. Deliveries for the new batch are expected between 2029 and 2031. Malaysia's aerospace capabilities are already recognized, with Composites Technology Research Malaysia in Melaka producing aircraft components for Airbus and Boeing. Embraer, with nearly 200 E-Jets operating in Asia Pacific, has also drawn interest from AirAsia and Air Borneo. - Bernama
