Dealership ordered to refund buyer RM4,600 for failing to deliver car
Nuraliah Izzati Mohamad Mirizan had gone to a car dealership at one of the hypermarkets along the Kota Tinggi-Johor Baru trunk road on Nov 3, 2024.
The dealer, she recalled, had been displaying cars at the common area of the hypermarket for many years.
'My mother had even bought a car from the dealership without any issues,'' said Nuraliah Izzati.
The 22-year-old claimant chose a sedan priced at RM49,980 and paid a RM100 booking fee on the same day.
She then paid the dealer a RM4,500 deposit via two bank transfers of RM2,250 each on Nov 19 and 20.
'The car was supposed to have been delivered in January this year, as promised by the saleswoman,'' Nuraliah Izzati said when met outside the Johor Consumer Claims Tribunal at Menara Ansar, Johor Baru.
However, the company failed to fulfil its promise.
The claimant said she felt lucky that she had not signed the bank loan for the car although the loan had been approved on Nov 19, based on documents forwarded to her by the company.
'I went to see the saleswoman again in February and she promised to deliver the car in March before Hari Raya Aidilfitri, which fell on March 31,' Nuraliah Izzati recalled.
The claimant added that she had wanted to use the car during the Hari Raya period but once again, the company failed to deliver the vehicle.
Dissatisfied with the service rendered by the company, Nuraliah Izzati called the car manufacturer's headquarters in Selangor to check on the status of the car.
'To my surprise, the saleswoman had not even booked the car under my name when I paid the booking fee on Nov 3, 2024,'' said the claimant.
Tribunal president Hafez Zalkapli ordered the respondent to refund RM4,600 (comprising the RM100 booking fee and RM4,500 deposit) to the claimant within two weeks.

Communication company staff claims trial to CBT charges

KOTA KINABALU (July 3): A finance executive cum accountant of a communication company claimed trial in a Sessions Court here on Thursday to three charges of committing criminal breach of trust. Rabiahtul Adawiah Pastor, 33, who appeared before judge Amir Shah Amir Hassan, was charged under Section 408 of the Penal Code. The indictment provides for a jail term of up to 14 years and whipping or with a fine, upon conviction. On the first to the third counts, she was accused of embezzling RM273,802.64, RM263,758.50 and RM49,330 respectively, by transferring the alleged money to three companies' bank accounts. The alleged offences were committed at the communication company between January 6, 2022 and October 30, 2023, between January 14, 2022 and October 27, 2023 and between November 30, 2022 and October 27, 2023, respectively. The court fixed August 5 for her case management. Rabiahtul who was represented by counsel Sharatha Masyaroh John Ridwan Lincon, was released on RM5,000 bail for all the three charges with two local sureties.

KOTA KINABALU (July 3): The State Government in collaboration with Petronas and industry partners has set a target of a 100 per cent increase in oil and gas services and equipment (OGSE) local job contracts for Sabahan companies this year, said Chief Minister Datuk Seri Panglima Hajiji Noor. 'In terms of employment, the target is clear: 100 per cent of non-technical roles and at least 80 per cent of technical roles in the OGSE sector must be filled by Sabahans. 'These targets reflect our firm commitment to strengthening local participation and building a resilient, homegrown energy ecosystem.' he said at the 12th Sabah Oil, Gas and Energy Conference and Exhibition at the Sabah International Convention Centre here on Thursday. His speech was delivered by Minister of Industrial Development and Entrepreneurship Datuk Phoong Jin Zhe. In 2021, Hajiji said the total contracts awarded to Sabahan companies for local oil and gas services jobs stood at RM341 million, while by the end of last year, the figure soared to over RM2 billion for jobs awarded both in and outside Sabah. He said Sabah's oil and gas industry is an essential pillar of the state's economic growth and continues to play a pivotal role to that of Malaysia's, contributing nearly 40 per cent of the country's oil production and approximately 20 per cent of its gas output. 'However, we believe that our role must extend beyond mere production. We aspire for Sabah to become a center of excellence for OGSE innovation and sustainable energy practices and a hub where investment, talent and technology converge to create long-term value,' he said. In this respect, the Chief Minister said the State Government through SMJ Energy has taken decisive steps in securing equity in key upstream and downstream assets, including the Samarang PSC and the SAMUR petrochemical plant, as well as interests in exploration blocks SB403, SB409, SB306A and SB306B. He said Sabah Energy Corporation had also strengthened its position as Malaysia's largest domestic supplier and transporter of natural gas, following its successful takeover of Petronas' onshore gas contracts in Sabah. 'I wish to take this opportunity to thank Petronas and all our operating partners in Sabah for your continuous efforts, commitment and investment in local content development. The Commercial Collaboration Agreement (CCA) signed in December 2021 with Petronas was significant and its implementation through initiatives such as the Sub-Committee for OGSE industry, co-chaired by the Sabah Ministry of Industrial Development and Entrepreneurship and Petronas, has yielded tangible results. 'These initiatives, coupled with the transparent insights provided by the Kinabalu Activity Outlook (KAO), are designed to ensure our local companies are well-informed, well-prepared, and well-partnered for success,' he said. Hajiji commended the Sabah Oil and Gas Services Council (SOGSC) and the Persatuan Kontraktor Petroleum Bumiputera Sabah (PKPBS) for their role in championing Sabahan participation in the OGSE sector. He also called on everyone to support the effort of the SOGSC and PKPBS to organise this OGSE conference next year. CIMB commits over RM100mil to upskill workforce this year
