Sabah assemblymen and businessman face corruption charges in mining scandal

KOTA KINABALU: Two Sabah assemblymen and a businessman are set to face charges in the Sessions Court today over alleged corruption linked to mineral mining licensing in the state.
The trio will be charged under Section 16(b)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 for offering bribes, as well as Section 16(a)(A) for receiving bribes.
MACC chief commissioner Tan Sri Azam Baki confirmed on June 18 the arrest of a state assemblyman and a businessman suspected of involvement in bribery amounting to around RM200,000.
Sources revealed the assemblyman, in his 60s, and the businessman, in his 30s, allegedly committed the offences between 2023 and 2024.
On June 23, Azam announced the arrest of another assemblyman, believed to have solicited and received approximately RM150,000 in bribes related to the same case.
The second suspect, in his 40s and holding an assistant minister position, is also accused of offences spanning 2023 to 2024.
The businessman was released on RM100,000 bail with two sureties, while the two assemblymen were granted RM50,000 bail each with one surety after their statements were recorded.

Selangor police chief Datuk Hussein Omar Khan confirmed that the suspect is the boyfriend of one of the three women who were previously arrested in connection with the case. 'The access card and keys to the unit were handed over directly by the suspect's girlfriend. We do not rule out the possibility that the suspect had malicious intent toward the victim. 'At the time of the incident, the victim was living alone as her housemates had returned to their hometowns for the semester break,' he said during a press conference at the Selangor Police Headquarters on Tuesday. Selangor police chief Datuk Hussein Omar Khan The 20-year-old victim, a Bachelor of Physiotherapy student at a private university, had been staying alone in the unit after her housemates went home for the holidays. 'The suspect is believed to have struck the victim with an object, causing injuries that led to her death,' he added. Addressing speculation that the victim may have been sexually assaulted, Hussein clarified that the pathologist's report did not find any evidence of rape. However, police are continuing their investigation to determine whether any form of assault took place. Following the incident, the suspect is believed to have attempted to cover his tracks by disposing of the victim's belongings. 'He threw away her mobile phone and disposed of her laptop, keys and access card. Police have since recovered several of these items,' Hussein said. He added that police are finalising the investigation and will submit the case to the Deputy Public Prosecutor soon. The three women previously arrested, including the main suspect's girlfriend, a friend of the victim who lived in the unit above, and another woman who was with the suspect during an ATM withdrawal, are still assisting police with their inquiries. The case came to light after the victim's body was found in her condominium unit in Cyberjaya at 10.28am last Tuesday. The murder was reportedly solved within 48 hours following the arrest of four suspects, one man and three women. It was also reported that the main suspect used the victim's ATM card to withdraw RM200 shortly after the incident. Sepang District Police Chief ACP Norhizam Bahaman previously confirmed that the arrests were made between Thursday morning and early Friday in Johor Bahru and Gemencheh, Negeri Sembilan, by teams from Bukit Aman, the Selangor Police Headquarters and the Sepang District Police.

SHAH ALAM: Five individuals, including a woman with the title of 'Datuk', were charged today at a Sessions Court with illegal deposit taking and money laundering over four years. Datuk Suhaila Semaru, 41, her sister, Suraya Semaru, 37, brothers Muhammad Wahbah Az-Zuhaili Mohd Ariffin, 33, Muhammad Syaabil Ajwad Mohd Ariffin, 26, and Mohamad Noor Syauqi Shafiee, 30, pleaded not guilty and requested for trial when the charges were read to them separately in front of judge Muhamad Anas Mahadzir. Suhaila, as XFOX Market Sdn Bhd director, faces 22 counts of receiving, obtaining, and possessing an estimated RM13 million from the illegal activities, while Suraya, as chief executive officer, faces 10 charges of obtaining, possessing, and transferring a total of RM11.1 million in funds. Mohamad Noor Syauqi is charged with obtaining and possessing RM2.5 million from illegal activities, Muhammad Wahbah Az-Zuhaili faces seven charges of receiving, obtaining, and using RM10.3 million, while Syaabil Ajwad faces seven charges of receiving and one charge of disposing of RM58 million in funds from illegal activities. They allegedly committed the offences under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, punishable under subsection 4(1) of the same Act, at various bank branches around Shah Alam, Petaling Jaya, and Subang between November 2021 and July last year. At the same proceeding, Suhaila, Suraya, and Mohamad Noor Syauqi pleaded not guilty to another charge of agreeing to accept deposits from the public without a valid licence. They are charged with committing the offence at the XFOX office in Subang Bestari from Nov 12, 2021, to July 30, 2024, under subsection 137(1) of the Financial Services Act 2013, read together with subsection 249(1)(a) and punishable under Section 137(2) of the same Act. The prosecution, led by Nurdeenie Abd Rashid and Megat Mahathir Megat Tharih Afendi, suggested RM1 million in bail for all the accused with the condition that they surrender their passports, while lawyer Mohd Haziq Dhiyaudin Razali requested a reduction, pointing out that his clients cooperated fully with Bank Negara Malaysia during the investigation and had no risk of flight.

IPOH: An oil and gas consultant in Ipoh lost approximately RM2.7mil to a fraudulent online investment scheme, according to Comm Datuk Noor Hisam Nordin. The Perak police chief reported that the 37-year-old victim realised he had been scammed on May 20 after continuously failing to withdraw the "profits" from the scheme. Comm Noor Hisam explained that the victim registered on a website called "Nova 88" in April 2023, after learning about it from an acquaintance. "Trusting the acquaintance, the victim initially invested about RM30,000 into a bank account provided to him to obtain a login name and password for the website to check his investment. "Between Jan 5, 2024, and May 20 this year, the victim made 136 transactions into seven different accounts, totalling around RM2.7mil," he said in a statement on Tuesday (July 2). "The funds were from the victim's own savings and contributions from his family members. Whenever he tried to withdraw the earnings, he was required to make more payments, but was still unable to access the money," he said, adding that a police report was lodged on June 29. "The acquaintance provided excuses when questioned and has since become uncontactable," he added. Comm Noor Hisam advised the public against engaging in investments offered on unverified or unregistered websites, or those not regulated by recognised authorities. "High-risk investments like this can lead to significant losses," he said, noting that the case is being investigated under Section 402 of the Penal Code for cheating. "Always check the background of the investment company with relevant agencies like Bank Negara or the Securities Commission before making any decisions," he added.
