Pensioner admits bid to ‘blackmail' woman over sex photos on old phone
A Dublin pensioner has admitted recovering pictures of a woman engaged in sexual acts from her old phone to "blackmail" her years later.
Anthony Nolan, 84, of Richmond Road, Fairview, was charged with harassment from May 8, 2021, until May 10, 2022, under section 10 of the Non-Fatal Offences Against the Person Act.
He pleaded guilty when he appeared at Dublin District Court before Judge Michele Finan on Monday.
The court heard the woman, who was known to the accused, gifted the pensioner her old phone in 2009, which she had used for four years.
Three years later, Nolan discovered some content on the phone, including personal messages and "photos showing the injured party in sexual activities and he attempted to blackmail her in relation to that".
Judge Finan noted that defence solicitor Andrew Molony said his client was attending psychiatric treatment and he needed time to obtain a report.
The woman was not present for the hearing.
Adjourning sentencing until September, Judge Finan requested that a victim impact statement be prepared for the next hearing. She also extended legal aid for a psychiatric report on Nolan.
The accused was remanded on continuing bail and was not required to testify.
It followed a preliminary hearing in April to consider whether the case should be sent up to the Circuit Court, which has wider sentencing powers. Jurisdiction was accepted, keeping it in the District Court.
The judge had heard that before the victim gave Nolan the phone, "she wiped the phone clean of personal data."
The evidence against him also included an accusation that, having discovered the messages and images, he refused to return the phone.
Judge Finan heard the complainant tried to "block" him, but he continued to harass her by electronic means and with messages.

Four men further remanded in custody in relation to major cocaine seizure in West Cork
Four men charged with possession of illegal drugs and possession of illegal drugs for sale or supply in relation to a major cocaine seizure in West Cork on July 1 have been further remanded in custody. The four appeared by video link before Judge Joanne Carroll at Clonakilty District Court and are charged over the seizure of 440kg of cocaine with an estimated street value of €31m at Courtmacsherry in West Cork. Solicitor Plunkett Taaffe for Mark Doherty, aged 40, of Waterfoot Avenue, Glasgow, Scotland, said the question of legal aid in relation to his client was still outstanding and said he was also seeking directions from the DPP in relation to the matter of venue. Judge Carroll said that Mr Taaffe was entitled to a response by July 25. Anti-immigration activist Derek Blighe has appeal against public order conviction allowed
Anti-immigration activist Derek Blighe had his appeal against a public order conviction allowed on Tuesday on payment of €500 to the Irish Red Cross. He was convicted originally at Fermoy District Court following his failure to make a €350 contribution to the Irish Refugee Council. In March, when the matter came up at Cork Circuit Appeals Court, his then barrister Alan O'Dwyer said: 'It is purely a religious matter.' He explained Mr Blighe's difficulty was with the position taken by the Irish Refugee Council on the repeal of the 8th amendment to the Irish Constitution in relation to abortion. Judge Helen Boyle adjourned the appeal until Tuesday for the appellant to pay €500 to Nasc, the organisation that advises migrants and refugees on their rights. And Mr O'Dwyer said the appellant would make this contribution. However, when the appeal was mentioned on Tuesday, Mr Blighe, who represented himself in court, said paying this contribution to NASC was against his faith because they had taken the same position on the abortion amendment. Judge Boyle let the matter stand at 11.30am and said she would return to the case later. When the case was called again at about 4pm, Judge Boyle asked Mr Blighe if he had the €500 in court. He said he had. The judge then directed him to hand it over to An Garda Síochána, which he did. Judge Boyle said: 'I am going to direct the sergeant to pay it to the Red Cross and thereafter to allow the appeal.' Woman in court after kicking detective in crotch during search of her home
Jana Milaniakova apologised after being charged, stating 'I was very frightened'. A woman who kicked a detective in the crotch while he was carrying out a search of her home in Co Donegal has appeared in court. Jana Milaniakova appeared at Letterkenny District Court charged with assaulting the Garda at her home on January 2nd, 2024. Garda Pauline Doherty gave evidence of the arrest, charge and caution of Milaniakova at Letterkenny Courthouse yesterday. Judge Eiteain Cunningham asked if the detective was injured following the assault. Sergeant Doyle said there was "initial discomfort" but that the detective did not suffer any long term issues. The assault charge is Contrary to Section 3 (1) and 3(2) of the Non-Fatal Offences against the Person Act 1997 (as amended by Section 20 of the Criminal Justice (Miscellaneous Provisions Act 2023).
