Nothing was found on Mr Carey but he was intoxicated and 'overreacted' to the search. Judge Brennan said while Mr Carey had thought he was being 'picked on' by the gardaí, this was not the way to react and it was 'kind of reprehensible behaviour'. Mr Carey displayed a 'level of aggression' and the garda suffered a minor injury. 'He's a young man who reacted badly and lost the head somewhat,' the judge said. 'He's learned his lesson.'

Outlining the prosecution's case, he said a woman and her son arrived on an Aer Lingus flight from Germany on March 30 and entered the immigration hall. They presented at a booth with no documentation and claimed asylum. This woman denied knowing Ms Marouani who came off the same flight, approached a different booth and presented a German passport. The accused also denied having travelled with the other two passengers. However, it was alleged, she had boarding passes in their names and when further questioned, she produced four passports. Two were genuine Georgian passports and two were false Czech passports, the court heard. In interview, she said she was only helping the woman and her son because they were afraid to fly alone and she knew the woman's mother from Georgia. According to the prosecution, she alleged that the woman had placed the passports into her handbag without her knowledge. The accused denied getting any payment from the woman to assist her arriving in Ireland. The woman said she and her son had travelled here on the false Czech passports and paid €2,500 each for them to 'an unknown entity'. She stated she had got the passports in Georgia before travelling to Germany and when they arrived there, she handed all four passports to Ms Marouani but did not pay her any money. It was the two other people who benefited from the alleged offence and Ms Marouani 'didn't understand the gravity of the situation' and made a 'terrible decision'. The two were released but as they were not detained, they left and 'continued their journey' out of Ireland and into the UK.

Craig McKeever (20) was arrested when the gun fell onto the ground in front of gardai, who fear it was related to an ongoing 'violent feud" in the city. He was refused bail when he appeared in Dublin District Court this evening charged over the gun seizure in the south of the city on Wednesday. Mr McKeever, from Dromard Road, Drimnagh is charged with unlawful possession of a firearm. While the accused was being arrested, the other man fled on foot and attempts to apprehend him were unsuccessful. In a preliminary examination, the pistol was found to be loaded with one round of ammunition. Gardai also seized the ballistic vest and €550 in cash Mr McKeever had on him. The garda said the area where the accused was stopped was a popular location for entering and exiting households and apartments and was also near a park frequented by children. He said the maximum sentence for the charge on conviction was 14 years. Gardai believed the gun seizure was related to an ongoing violent feud in the Dublin 8 area and the accused's family home had been burned out by a petrol bomb. Applying for bail, defence barrister Kevin McCrave said Mr McKeever was prepared to abide by conditions and would be under the garda 'spotlight' and 'effectively under house arrest' if released. He had always lived at his home address and family members including his father were in court to support him. The accused, who was presumed innocent, could be in custody awaiting trial for at least a year if refused bail, Mr McCrave said. The other man had been arrested, charged and bailed, he added. Judge Fay refused bail and remanded Mr McKeever in custody to appear in Cloverhill District Court on July 3, for DPP directions.

Man appears in court charged over death of Mircea Rostas in Balbriggan

A MAN has been charged following the death of a father-of-three who was struck by a car as he stood on a footpath in north county Dublin earlier this week. Daniel Rostas (41) appeared in Dublin District Court today accused of causing serious harm to Mircea Rostas (33) who died after a collision in Balbriggan on Monday night. He was remanded in custody for DPP directions after no bail application was made on his behalf. Mr Rostas, with an address at Hastings Green, Balbriggan is charged with intentionally or recklessly causing serious harm to the alleged victim at Railway Street on June 23. Mircea Rostas Detective Garda John Delaney told Judge Michele Finan he arrested the accused for the purpose of charging him at Balbriggan station at 1.12am this morning. He made no reply after caution and was handed a copy of the charge sheet. Det Gda Delaney said he would be objecting to bail but defence solicitor Sandra Frayne said the accused was not making a bail application today. He was remanded in custody to appear in Cloverhill District Court on July 3. Gardai have said Mircea Rostas was struck by a car as he stood on a footpath on Monday night. Emergency services were alerted to reports of a road traffic collision and found him seriously injured on the ground. He was treated by paramedics at the scene, but died a short time later. Gardaí have appealed for witnesses and any dashcam footage. They also asked people not to share a graphic video showing the immediate aftermath of the collision. The footage, posted online, shows Mr Rostas lying motionless on the ground while a bystander attempts CPR. Family members are seen becoming distressed after arriving on the scene.
