Meyiwa trial becomes a courtroom spectacle without justice

The Senzo Meyiwa trial has turned into a legal performance filled with theatrics, questionable rulings and conflict of interest.

The Senzo Meyiwa murder trial continues to teeter between comedy and tragedy at the High Court in Pretoria.
National icon Meyiwa was murdered in cold blood in front of a number of witnesses in 2014.
The resultant legal circus being screened on national television lately at the moment is leaving viewers with many lingering unanswered questions.
The spectacle that started with the initial presiding officer, Judge Tshifhiwa Maumela, seems to have found its way under the current presiding officer, Judge Ratha Mokgoatlheng.
If ever there was a case where the interests of justice, logic, common sense and Solomonic wisdom yearned – if not screamed – for the trial to start afresh (de novo) before a new judge, and for the five accused persons to be each represented by separate counsel, it is the Meyiwa murder trial.
There is a lot that has been said and done in that courtroom in the full glare of news television cameras that dictate that this trial starts afresh before another judge.

So far, the trial has not showcased the machinations of our justice system in action in a favourable light. One has witnessed theatrics and conduct unbecoming from the Bench and the Bar itself.
Some rulings from the Bench and unsalutary comments have been made.
Not all within the Bench have the necessary acumen, temperament, patience, diligence, forensic skills and tact to restrain themselves from vying for attention to win the Oscar performance for the best actor of the show.
It is not the duty of the Bench to upstage any of the legal representatives appearing before it. After all, legal representatives are creatures of instructions, no matter how ridiculous the legal mandate seems to the listening spectators.
The palpable bias from the Bench leaning towards the prosecution has emboldened some counsel to even threaten to quit, while the state keeps on making objections on issues where the court should exercise latitude for cross-examination.
Potential conflict of interest, in itself, is sufficient for a discerning court to insist on separate defence representation. Here in this case you have two of the accused persons having made some self-incriminating admissions and confessions implicating their co-accused person.

Is that not in itself real prejudice and well-grounded conflict of interest?
The problem in this case is that the Bench and the Bar seem to be enjoying the news television cameras too much, at the detrimental expense of the fairness of the trial to both the prosecution and defence.
Unfortunately, the Meyiwa murder trial will be remembered for the many wrong things that went down instead of solving one of the most unfortunate tragedies that befell a former goalkeeper and captain of our national team.
To those versed in superstition and conjecture, it is as if the trial itself is jinxed.
I rest my case.

Gauteng police made a major breakthrough and arrested a prominent businessman and three alleged hitmen for orchestrating the assassination of DJ Sumbody and a separate hit-style murder. Accused Four men – Sandton businessman Katiso 'KT' Molefe, former police detective Michael Pule Tau, Musa Kekana and Tiego Floyd Mabusela – appeared in the Alexandra Magistrate's Court on Tuesday. The matter was postponed to next Tuesday to allow for further investigations and a formal bail application. Arrests welcomed The Be a Sumbody Foundation, on behalf of the Sefoka Family, on Tuesday, acknowledges the arrest of four suspects linked to the 'gruesome murder of our beloved Oupa John Mmanthokgo Sefoka.' 'While this development marks a critical step toward justice, the family is reliving the trauma of his untimely passing and respectfully requests privacy and space during this difficult time.' Police thanked The family thanked the police for their efforts in arresting the suspects. 'We extend our deepest gratitude to the South African Police Service (Saps), particularly the Gauteng Organised Crime Unit and the Political Task Team, for their relentless efforts in pursuing justice. 'The dedication of law enforcement has been instrumental in this case, and we remain hopeful for a thorough legal process. We also wish to thank South Africans, patriots and supporters of DJ Sumbody and the Be a Sumbody Foundation for their unwavering love, prayers, and solidarity. Kenny Kunene suspended Meanwhile, the Patriotic Alliance (PA) has suspended its deputy president, Kenny Kunene, from all party activities for a month. Party leader Gayton McKenzie dealt Kunene the blow on Tuesday. McKenzie said Kunene will be investigated after he was found at the home of alleged mastermind of DJ Sumbody's murder, Katiso 'KT' Molefe. In an explosive revelation, Kunene confirmed that he was at Molefe's house when police arrived to arrest the suspected killer. Kunene claims he was at Molefe's house to facilitate a meeting for a journalist from his online publication, Africa Global News, for a 'potential exclusive story.' Inspection in loco takes centre stage in Senzo Meyiwa murder trial

An inspection in loco at a municipal building in Vosloorus became a focal point in the Senzo Meyiwa murder trial on Tuesday. One of the five accused, Muzikawukhulelwa Sibiya, led the court to the spot where he was allegedly assaulted by officials. The lead investigator in the matter, who is also accused of the assault, Brig Bongani Gininda, also participated in the inspection. The inspection took place on July 4 after it was requested by Sibiya's lawyer, advocate Charles Mnisi. Sibiya demonstrated to the court how he was allegedly assaulted by Gininda and other officers. Photos were taken during the site visit. On Tuesday, state prosecutor advocate George Baloyi officially placed the details of the inspection on record. Baloyi explained that court officials had to drive to the Gold Sports complex at the municipal offices in Vosloorus, which houses various offices, including the metro police offices. Sibiya had to show them where he was assaulted. 'Accused one mentioned that on May 30 2020 they came from Thembisa to the municipal offices and about seven vehicles parked in the open parking area of the premises,' Baloyi said. 'He was handcuffed from behind and a plastic bag was put on his face. He mentioned that Brig Gininda appeared and the other police officers who were with him moved to the parked motor vehicles and held a meeting. He mentioned that the municipal area is known as a gold spot and the police station is behind those premises and that he has passed by that place previously and is familiar with the surroundings,' he said. Baloyi said advocate Mnisi had explained that , one could not see what was happening at the spot pointed out by Sibiya as no-one was moving around at the time because it was during the Covid-19 lockdown. Sibiya had also mentioned that other officials, including members of the metro police, were present when he was assaulted. 'He is unable to say who assaulted him and how he was assaulted as his face was covered in plastic. He said about 14 police officers participated in the assault. Some were in uniform, some in civilian clothes and some were metro police officers. On June 5 2020, the cars came through the same municipality gate and parked at more or less the same spot.' Sibiya said he was placed at more or less the same spot as on May 30 2020. 'He was made to sit and he was handcuffed from behind but no leg irons. A plastic bag was put on him and he was assaulted by about 10 or fewer police officers. There were not that many. Thereafter, they left for Alberton,' said Baloyi. Baloyi said Gininda disputed that it was the place where they were and asked that a note be taken of the fact that there is only one entrance and exit to the municipal premises. He explained that the court and the police station are divided by a wall, but there is no wall or fence to the parking area in front of the police station. On arrival at the parking area at Vosloorus police station, Baloyi said Gininda had pointed out where he met Sibiya in a red VW Golf. 'Brig Gininda mentioned that there is a motor vehicle entrance next to the pedestrian entrance. He also mentioned that the late Sgt Mabena's vehicle was also there,' he said. Gininda said he had not seen Sibiya on June 5 2020 and only saw him on May 30 this year. The trial continues on Wednesday. TimesLIVE
