Kolkata: Calcutta High Court on Monday dispensed with the personal appearance of Kunal Ghosh and other accused in a contempt of court case concerning a ruckus in front of chambers of high court lawyers at Old Post Office Street and Kiran Shankar Roy Road on April 25.
The division bench of justices Arijit Banerjee, Sabyasachi Bhattacharyya and Rajarshi Bharadwaj excused the personal appearance upon an undertaking that the alleged contemnors would appear as and when directed by the court.
Senior counsel for the accused, Kalyan Bandyopadhyay, opened his argument by pleading that the bench didn't have the jurisdiction to issue a contempt rule. "The CJ on his administrative side assigned the matter to the special bench.
It was not a judicial order," he argued.
Citing rules under the Calcutta High Court Contempt of Courts Act, 1975, Bandyopadhyay pleaded that the HC could issue a contempt rule on "its own motion" after hearing petitions of contempt that were moved before the bench.
Bandyopadhyay pointed out that no such petition had been moved before the division bench of CJ TS Sivagnanam and Justice Chaitali Chatterjee (Das) a day after the incident.

A lawyer of the Calcutta High Court has urged Chief Justice T S Sivagnanam to take suo motu cognisance of the rape at a Kolkata law college, arguing that the state machinery will otherwise 'continue its descent into callous inertia, and evidence may be destroyed, witnesses may be silenced, and justice will be permanently derailed'. Advocate Souma Subhra Ray wrote in his letter, 'As the voice of a frightened student community, a shaken civil society, and a democratic conscience that bleeds today in the wake of a heinous and unconscionable act of sexual violence perpetrated on the evening of 25th June, 2025.' 'This was not a spontaneous crime of opportunity; it was politically motivated, premeditated, and brazenly executed within the walls of an institution meant to uphold and teach the rule of law. What is even more horrifying is that despite prior complaints, threats to the victim, and a pattern of coercion aimed at forcing her into certain politically affiliated student activities, neither the college administration nor the local police authorities acted,' he further wrote. Ray has asked the high court to make five considerations. Firstly, issuing directions for a court-monitored, independent criminal investigation, preferably by the Central Bureau of Investigation (CBI), secondly, constituting a judicial commission, headed by a retired judge of the court, to investigate the institutional, administrative, and security failures that permitted this incident to occur; thirdly, directing the West Bengal government and the university authorities to undertake immediate audits of safety and surveillance systems across all law colleges and higher educational institutions, with special attention to the enforcement of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 and UGC safety guidelines; fourthly, calling for an explanation from the police and local administration on the use of force against peaceful protesters and the denial of democratic expression; and finally, issuing appropriate interim directions to safeguard evidence, ensure witness protection, and prevent the further erosion of public trust in the law enforcement system. Ray described the incident not just as a crime against one individual but as a 'monumental institutional failure — a breakdown of every constitutional assurance granted to our citizens under Articles 14, 15(3), 19(1)(a), 21 and 51A(e)'. Ray further wrote in his letter, 'If Your Lordship does not intervene, the State machinery will continue its descent into callous inertia, and evidence may be destroyed, witnesses may be silenced, and justice will be permanently derailed. The culture of impunity and patriarchy, particularly in institutions of legal education, will only deepen leaving countless more students exposed and unprotected.' A first-year student of the law college was allegedly raped on Wednesday in the security guard's room on the campus. The survivor's medical examination done in a state-run hospital has corroborated her statements, officials said without divulging details. On Thursday, a contractual staffer and former student of the college, Monojit Mishra, 31, and two students — Zaib Ahmed, 19, and Pramit Mukherjee, 20–were arrested on the basis of a complaint lodged by the survivor. On Saturday, a security guard of the college, Pinaki Banerjee, was also arrested. The survivor's statement has been recorded by a magistrate under Bharatiya Nagarik Suraksha Sanhita section 183.

Former deputy director of the Enforcement Directorate (ED) Niranjan Singh, who probed the alleged money laundering charges against former Punjab minister Bikram Singh Majithia and also recorded his statement in connection with the Jagdish Bhola drug-racket case before being transferred, on Saturday said the conduct of the Shiromani Akali Dal (SAD) leader in the entire case was 'doubtful.' This came a day after former Punjab director general of police (DGP) Siddharth Chattopadhyaya met a Vigilance Bureau team on Friday and shared his 'experience and knowledge' with its members regarding the drugs case registered against the former Akali minister in 2021. Singh, who appeared before the Vigilance Bureau in connection with their investigation into the alleged money laundering case against Majithia, said he had recorded his 'verbal statement' with the Bureau. 'Being with ED, I started the investigation in the case in 2013, and it went on till 2017. I was not able to complete that because I was transferred and promoted. I cannot reveal everything to the media as the investigation is pending. We gather a lot of evidence in financial investigations. I can just add that there is a doubtful conduct,' he said, referring to Majithia. The bureau on June 25 arrested Majithia in the case allegedly involving the laundering of Rs 540 crore of 'drug money'. The former Punjab minister was sent to a seven-day custody by a Mohali court on June 26. He also accused Majithia of getting him transferred out of Jalandhar when he was in the midst of the investigation. 'What the Punjab government is saying about linking drug money with disproportionate assets case, I have no link with that. There is no evidence of this link at this juncture. The investigation was delayed. The credit for the delayed investigation goes to Majithia. He got it done. I am saying this on record. I was transferred several times,' Singh said. 'The ED has a clear mandate: if an FIR is lodged under the NDPS Act case and recovery is made, then the agency enters into it and takes details about how crime money was generated, laundered and investigated. There were 102 accused, and they were investigated. I was not able to complete it. I had the support of the department for many years. When I summoned Majithia in 2014, I was transferred to Kolkata. The HC later cancelled this transfer. There was non-cooperation by the department after that, and some steps were taken by the authorities which do not go in favour of the investigation.' 'I told them that now I am retired. I have no documents. They can get copies of those documents from the ED. I will come and certify those,' Singh said. Recalling the case, he said, 'The initiation of investigation was done as a case of drugs. I investigated for the ED and submitted the status report to the high court. The HC examined the report and gave it to the STF. The STF examined it and gave its observation to the HC. The court then directed the Punjab government to take action, but the government did not take action.' He said the 2021 FIR was based on the status report filed by him and the STF. 'Now, the Vigilance is investigating the money laundering. Because the initiation of the investigation was done by me, they wanted me to come and help them. I can say the documents in both cases are the same. It is the same story and the same facts. The money laundering is linked. They have to do the investigation now,' Singh said. 'When we started the investigation, drug kingpin Jagdish Bhola's statement was recorded. Majithia's name is mentioned in his statement. Later, I investigated Bittu Aulakh. He, too, wrote his name. Bhola has been convicted. I got 17 accused convicted, and their illegal property was attached and confiscated. This case has the same ground. The guilty are behind bars,' Singh said. He said, 'The matter is still under investigation. Whatever is in the court and public domain, I can tell. Some people in contact with him were in Canada. We sought an investigation report about them from the Canadian government. The government never sent it to us. They were Satpreet Satta, Amrinder Singh Laddi, Parminder Singh Pindi and many others.' 'I have recorded statements in which his name figures. I have submitted the report to the court. Based on those statements only, 17 persons were convicted. That means the court agreed with my statements and evidence,' he said. He said, 'The challan was to be presented by the SIT, but they did not. I can only help whenever an agency seeks my help.' He said that the Vigilance had never contacted him earlier. 'I have given a verbal statement. The police have to record it. I gave the details of the Bhola drug case and what came into the investigations about Majithia. I had submitted the statements of Bhola and Aulakh in the trial court. The contents of their statement were required by the VB. I have told them about it.' 'I am neither in favour nor against anyone. I am only responsible for the investigation I have done. There is no politics as far as my investigation is concerned. There are many statements, there are revelations, and the accused has named him. Since the investigation is pending, it is not fair to say anything. The investigation is going on, and is live and in progress. It has not been closed,' he added.

Five persons, including a pilot working with a commercial airline, were arrested on Saturday for allegedly kidnapping three members of a farmer's family, who were rehabilitated for giving up land for the upcoming Noida International Airport at Jewar, with an aim to create hurdles in the project. Police said the accused intended to falsely implicate police and administrative officials, creating hurdles in the airport's land acquisition and rehabilitation process to extract unethical financial benefits. The farmer, Hansraj, along with his wife Kamlesh Devi and son Saurabh, was kidnapped under the pretext of medical treatment from Jewar's Rohi village at Gautam Buddha Nagar in Uttar Pradesh. They were rescued by the police from outside Dayanatpur village in Jewar. The police identified the accused as Captain Puttan Singh and his wife Sarojbala, residents of Noida's Sector 135; Pawan Chaudhary and Pramod, residents of Dayanatpur village in Jewar; and Ramadevi, a resident of Maidan Garhi in Delhi. 'They have been charged with the kidnapping of Hansraj, his wife Kamlesh Devi, and their son Saurabh, residents of Rohi village in Jewar,' Greater Noida DCP Saad Miya Khan told mediapersons. He said that Hansraj and his family were among the residents of the six villages that were rehabilitated during the first stage of the airport's development. 'However, Hansraj, Kamlesh Devi, Saurabh, and their other son, Sonu, objected to shift to the rehabilitation and resettlement (R&R) site and had been staying at their house in Rohi for the last three years. On May 29, the family was moved by the Jewar sub-district magistrate and sent to the R&R site,' he added. The same day, Saurabh allegedly admitted his parents to Kailash Hospital in Jewar, who were reportedly discharged on June 4. However, Khan said on June 2, Sonu filed a Habeas Corpus petition in the Allahabad High Court against police and administrative officers, alleging illegal detention of his father, mother and brother Saurabh. 'On June 9, the petition was accepted by the court, which directed the police to present the three before it,' the police said in a statement, adding that the HC has scheduled its next hearing on July 7. An officer said that the police suspect that sometime between May 29 and June 2, the accused approached Saurabh and his parents and offered to take the couple to another facility for better treatment. Following this, they went missing. The police said seven teams were set up to search for them. During the investigation, the three were found hostage in a secluded enclosure outside Dayanatpur village. 'The accused had conspired to kidnap them to cause hindrance and disorder in the relocation policy of the Noida International Airport,' said the DCP. The police have registered an FIR under Section 140(3) (kidnapping or abducting in order to murder) of the Bharatiya Nyaya Sanhita at Jewar police station.
