
SC sets aside jail term of man found juvenile in rape case, upholds conviction
A bench of Chief Justice B R Gavai and Justice Augustine George Masih said after the accused claimed to be a juvenile at the time of the crime, the apex court asked the district and sessions judge at Ajmer to conduct an inquiry into his claims.
The bench, upon examining the inquiry report, said the accused was aged 16-years-two-months-and-three days on the date of crime on November 17, 1988.
'The appellant was therefore a juvenile on the date of commission of the crime," the bench said.
It said authoritative judgments of the top court have categorically held that plea of juvenility could be raised before any court and has to be recognised at any stage, even after disposal of the case.
The bench said as the accused was then a juvenile, the provisions as contained in the Juvenile Justice (Care and Protection of Children) Act, 2000 would apply.
'Consequently, the sentence as imposed by the trial court and upheld by the high court will have to be set aside, as the same cannot sustain. We order accordingly," the bench held.
While section 15 of the 2000 Act deals with order that may be passed regarding juvenile, Section 16 relates to order that may not be passed against juvenile.
The top court's verdict came on the accused's appeal against a July 2024 verdict of the Rajasthan High Court.
The high court had confirmed his conviction and five-year sentence awarded by a trial court in the case.
His counsel, in the apex court, highlighted the alleged discrepancies in the prosecution's case and said the accused was a juvenile at the time of commission of offence.
The bench noted the survivor was firm in her cross-examination supported by the medical evidence.
Her testimony was found 'worthy of credence" requiring no corroboration that could form the sole basis for conviction.
'Prosecution's case is not founded solely on the testimony of the victim; rather, it is amply supported by the statements of other witnesses and corroborating medical evidence, all of which collectively establish the case of the prosecution," the top court said.
It said the findings recorded with regard to his conviction stood duly established beyond doubt. PTI ABA ABA AMK AMK

Police constable's wife dies by suicide in UP, alleges harassment by in-laws in Instagram video
NEW DELHI: The wife of a police constable in Uttar Pradesh died by suicide after posting a video on Instagram in which she accused her in-laws of harassment, police said on Sunday. According to PTI, Saumya Kashyap, married to constable Anurag Singh who is posted with Eagle Mobile at Bakshi Ka Talab police station, was found hanging from a ceiling fan in her home. Her death came to light after authorities were alerted to the social media post. In the video, Saumya alleged that her in-laws were pressuring her husband to remarry and that her brother-in-law had threatened to kill her. Police have informed Saumya's family, who are travelling from Mainpuri to Lucknow. A case will be registered upon receiving their complaint, officials said. An investigation is underway.

J&K Police attach property of drug peddler in Kulgam
Jammu and Kashmir Police have attached property of an alleged drug peddler under Narcotic Drugs and Psychotropic Substances (NDPS) Act in south Kashmir's Kulgam district. The police said that the said individual is involved in two separate NDPS cases. (File) Officials said that a house and land belonging to drug peddler Farooq Ahmad Mir, of Zadoora, was attached under the provisions of NDPS Act. 'The property- comprising a single-storey residential building (850 sq. ft.) along with 12 marlas of land with an estimated market value of ₹65 lakhs, has been attached,' a police spokesperson said. The police said that the said individual is involved in two separate NDPS cases. 'As per section 68-F of the NDPS Act, proceedings were initiated by the competent authority for the attachment of illegally acquired property believed to be purchased through proceeds of narcotic trafficking,' the spokesperson said.

Univs sensitise students, faculty, staff on POSH Act
1 2 Bhubaneswar: In the wake of a college student's self-immolation in Balasore over alleged sexual harassment by her head of department, state govt has urged universities and colleges to intensify awareness about the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, or POSH Act and measures to lodge complaints. Universities have started holding meetings, workshops and seminars to sensitise students, staff and other stakeholders to create safe campuses for women. While some of them have already conducted sensitisation programmes, others plan to carry out such activities. Utkal University on Friday conducted a seminar-cum-workshop on the POSH Act to raise awareness about workplace rights while promoting a safer, gender-sensitive environment within the academic space. Jointly hosted by the internal complaints committee (ICC) and the Post Graduate Council, experts explained the institutional framework and responsibilities of the ICC in handling harassment cases. They emphasised the importance of timely redressal and institutional support for complainants.
