Allahabad HC denies bail to man for posts against PM, Armed Forces during Operation Sindoor

LUCKNOW: The Allahabad High Court has refused bail to a person accused of posting objectionable content on social media against the Prime Minister and the Indian Armed Forces during Operation Sindoor, following the Phalagam massacre.
A single-judge bench, comprising Justice Arun Kumar Deshwal, observed that the freedom of speech and expression guaranteed under the Constitution of India does not extend to acts that disrespect the high dignitaries of the country and create disharmony among citizens.
Justice Deshwal stated that it had become a trend among certain groups to misuse social media platforms under the guise of freedom of speech by making nasty and unfounded allegations against dignitaries and spreading disharmony and hatred among communities.
The petitioner, Ashraf Khan alias Nisrat, had been booked under Sections 152 and 197 of the Bharatiya Nyaya Sanhita (BNS) for allegedly posting edited videos on his Facebook account during the recent India-Pakistan face-off following the Phalagam massacre.
According to the prosecution, the petitioner, who had moved the High Court seeking bail, allegedly posted a video showing the Prime Minister walking next to a donkey pulling a cart carrying an aircraft, later showing him apologising to Pakistan.

BJD demands apology as BJP MLA's remarks trigger political storm in Odisha, FIRs filed

Khatua, a lawmaker from Nilgiri assembly constituency in Balasore district, in a statement to certain television channels allegedly made 'derogatory' remarks on Samantasinghar's character. BJD's senior general secretary and spokesperson Lekhashree Samantasinghar has also drawn the attention of Prime Minister Narendra Modi by tagging a letter in her X post. Bhubaneswar, Jul 3 (PTI) Ruling BJP MLA Santosh Khatua on Thursday courted controversy after allegedly making 'derogatory' remarks against a prominent woman BJD leader, prompting a strong backlash and a demand for an apology from Chief Minister Mohan Charan Majhi and the saffron party. Meanwhile, at least three FIRs were filed at Nilgiri police station on Thursday evening by separate persons — including two women — accusing Khatua of making derogatory and objectionable remarks against the woman. 'Dear Modi Ji @narendramodi, Please listen to your MLA from Odisha talking about women politicians. This is true blood BJP neta giving true salute to women,' Samantasinghar wrote. 'I know you have very competent and intelligent Odia officers in @PMOIndia and Party. Please ask them to translate for you. After listening to it, we will see if you still have the motivation to talk about 'naari ka samman' or 'Operation Sindoor'.' 'Your promise for women will sound hollow if you fail to take action against such misogynistic elected representatives,' Samantasinghar stated. The controversy started from a press conference by Samantasinghar on Wednesday, where she accused Khatua of involvement in the killing of a tusker and theft of its tusks in Balasore's Nilgiri area on June 15. She also called the BJP MLA a 'thief' and a 'dacoit.' In what appeared to be a retaliatory statement made to certain television channels, Khatua allegedly made remarks on Samantasinghar's character, which were widely condemned. Attempts to contact the Nilgiri legislator failed as his phone remained switched off after the interview. Khatua's remarks, which went viral in social media, sparked a statewide outrage over the language used by a lawmaker. However, PTI could not independently verify the authenticity of the viral video. Leader of the opposition and BJD president Naveen Patnaik strongly denounced the BJP MLA's remark and called upon people to oppose such kind of words against a woman. 'Otherwise, as a state, we will fail before our daughters and mothers,' he said. In a post on X, Patnaik said: 'Attempting to assassinate a woman's character in public as a political response is a reflection of a sick mentality and is aimed at suppressing women's voices. It suggests that all women should remain silent. The most distressing aspect is the profound silence of BJP leaders.' He added, 'Not a single leader has come forward to condemn such reprehensible remarks or hold the MLA accountable. This behaviour and the silence of all concerned clearly reveal the stance of the ruling party in public.' At a press conference on Thursday, Pramila Mallik, the Opposition chief whip in the Odisha Assembly and BJD senior vice-president, condemned Khatua's comments and accused the BJP of obstructing women's participation in politics. 'BJP MLA Khatua has used extremely hateful, ugly, insulting and low-quality language towards Dr. Lekhashree Samantasinghar. If such language is used against a woman, it is never acceptable in a civilised society,' Mallik said. 'There are also women leaders and elected women representatives in the BJP. Has the BJP, which claims to be a party with a difference, trained its MLAs to speak this way about women?' she asked. Mallik further asserted that the remarks were not just personal but an affront to all women, and demanded a public apology. 'Khatua's remarks are not directed at one woman alone—they are an insult to the entire women fraternity. Therefore, CM Mohan Charan Majhi and the BJP must apologise to the women of Odisha,' she added. Responding to the allegations, BJP spokesperson Anil Biswal defended Khatua, claiming that he is being falsely implicated in the elephant poaching case. 'Nilgiri MLA is being falsely dragged into the elephant killing case. The BJD has done a PhD in making false allegations,' Biswal said in a statement. He added that four people have already been arrested in connection with the elephant deaths at Kuldiha Sanctuary, and those apprehended were habitual offenders. 'Even during the BJD's tenure, elephants were killed. This is nothing but a conspiracy to malign the image of BJP legislators,' he alleged. `Defamation' of Savarkar: court says it can't compel Rahul Gandhi to produce `book' cited by him

Satyaki Savarkar, the complainant in the case, had filed the application in May, claiming no such book as cited by Gandhi existed, and he should be asked to produce it if it did. The Congress leader cannot be compelled to produce the book, said judge Amol Shinde of the special court for MPs and MLAs. Pune, July 3 (PTI) A court here on Thursday rejected a plea by the grandnephew of Vinayak Damodar Savarkar seeking access to a `book' cited by Congress leader Rahul Gandhi while allegedly making defamatory remarks against the late freedom fighter. The court, in its order, said the accused cannot be compelled to disclose his defense before the commencement of the trial. 'The accused may produce any relevant documents during the presentation of his defense evidence. If the accused is compelled to produce such evidence prematurely, it would amount to violation of his fundamental rights guaranteed under Article 20(3) of the Constitution of India, which protects against self-incrimination,' the order stated. 'As per Article 20(3)…'No person accused of any offence shall be compelled to be a witness against himself. Therefore, this Court is of the opinion that an order cannot be passed directing the accused to file the incriminating documents,' the judge further said. Satyaki Savarkar has filed a defamation complaint against Rahul Gandhi, citing his speech in London in March 2023. As per the complaint, the Congress MP claimed during the speech that V D Savarkar had written in a 'book' that 'he and five to six of his friends once beat up a Muslim man, and he (Savarkar) felt happy'. No such incident ever took place, nor did Savarkar write any such account, Satyaki Savarkar said in his defamation complaint. PTI SPK KRK This report is auto-generated from PTI news service. Stepfather Kills 9-Year-Old Boy To Get Closer To Wife, Avoid Property Division

1 2 Nagpur: In a chilling act of cruelty, nine-year-old Darshan Palaskar was brutally strangled by his stepfather Akash Kanhekar to 'eliminate any future demand for share in property'. Kanhekar also believed killing Darshan will remove the son from his wife's first marriage, and help mend his strained relationship with her. The 35-year-old Kanhekar roped in his friend Gaurav Gaigole with a paltry Rs300 to assist in the heinous crime. The boy's lifeless body was discovered around 40km away from their house, dumped in a sack in a gully in the hilly jungle terrain near Akot city, after an intensive 10-hour overnight search by the Akot police. The search was led by senior inspector Amol Malwe under the supervision of assistant SP Anmol Mittal and SP Archit Chandak. The case began on July 2, when Kanhekar and his wife, Darshan's mother, walked into Akot City police station at around 8.30pm to report the boy missing. The mother claimed Darshan left home around 3pm and had not returned. His mobile phone was switched off at 3.21pm, raising immediate suspicion. The police, led by the station house officer (SHO), registered a case of kidnapping under Section 137(2) of the Bharatiya Nyaya Sanhita (BNS) and launched a search operation. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 2 BHKs starts at ₹ 72.6 Lakh | No Floor rise | Zero PLC Mahindra Happinest Tathawade Get Quote Undo A breakthrough came via Akot city's recently inaugurated integrated CCTV Command Centre, where footage revealed Darshan walking alone at 3.05pm before being picked up on a motorcycle by two men. Shockingly, one of the men was identified as Kanhekar, the stepfather who had come to report the boy missing. When confronted, Kanhekar's wife revealed that he was her second husband. Darshan's father had died by suicide a few years earlier. This revelation shifted the investigation's focus. By 12.30am, the investigation officer had started interrogating Kanhekar. Under intense questioning, he confessed to strangling Darshan and disposing of his body in the hilly jungle near the Shahnur Wildlife Sanctuary, part of Melghat Tiger Reserve. Kanhekar's lack of cooperation and attempts to mislead the police delayed the recovery of the body, which was found only after a gruelling overnight search using mobile lights and torches. The boy's body, stuffed in a sack, was located in a riverine gully in rugged terrain. Simultaneously, a separate police team tracked down Gaigole, the second suspect spotted in the CCTV footage, to Anjangaon Surji tehsil in Amravati district. Gaigole was taken into custody and brought to Akot for questioning. The police, supported by the district's mobile forensic van, worked tirelessly through the night, combing the dense jungle to locate Darshan's remains. The police team completed 90% of the investigation within 12 hours under ASP Mittal and SP Chandak. All procedural requirements under the Bharatiya Nagarik Suraksha Sanhita (BNSS), including video recording of critical investigative processes, were meticulously followed. The police have prepared comprehensive documentation and aim to submit a watertight charge sheet within two days. The two accused were remanded to police custody till July 7 after being produced before the court on Thursday.
