LFL rubbishes ex-chief judge's claim of pressure over constitutional ruling

LFL's N Surendran said judicial deliberation shouldn't be mistaken for interference. PETALING JAYA : Lawyers for Liberty (LFL) has rubbished claims of judicial interference after a former chief judge of Sabah and Sarawak said that a top judge pressured him to rule in favour of a litigant in a constitutional case against the federal government. Abdul Rahman Sebli, who retired last Thursday, claimed in his farewell speech that a 'very senior member of the judiciary' had emailed him, criticising his interpretation of the constitutional issue at hand. Rahman said judicial independence was not only about interference by the executive, but also about a judge's own peers in the discharge of judicial functions. In a statement today, LFL adviser N Surendran said such accusations were 'plainly wrong' and defied logic, particularly as the senior judge in question was part of the seven-member Federal Court panel hearing the case. 'How can a judge 'interfere' in a case which she herself was involved in deciding? Such a suggestion defies logic,' he said, without citing names. Surendran said unless someone outside the bench, such as from the executive, tried to influence the decision, it did not qualify as interference. He also argued that there was nothing 'sinister' about judges on multi-judge panels discussing cases and circulating draft judgments to persuade colleagues. 'In other words, there can be nothing wrong with any judge suggesting to his fellow judge in the same panel that his interpretation of the law is incorrect, and to try to change his position on it. 'This is part of the usual process of judicial decision-making, not just in Malaysia, but also of Supreme Courts in other common-law countries such as the UK or the US,' he said. Surendran also said it was 'strange' that a now former Federal Court judge was making a complaint that he was affected by 'peer pressure', adding that Federal Court judges enjoy security of tenure and constitutional protection. While acknowledging that judicial interference was a serious concern, Surendran warned against diluting its meaning. 'Judicial interference is a very serious matter. But it must not be confused with entirely appropriate and necessary internal processes of judicial deliberation,' he said.

All Malaysians urged to proudly fly the Jalur Gemilang

MUAR: The month-long National Day and flag-flying tradition is not just for symbolic purposes but showcases the strong spirit of unity among Malaysians, says the Communications Minister. Datuk Fahmi Fadzil said for the past 68 years since independence, this togetherness formed through the Federal Constitution has ensured the nation's peace and stability. As such, he urged everyone to proudly fly the Jalur Gemilang be it at their homes, vehicles, offices or schools. Fahmi, who is the National Day and Malaysia Day main committee chairman, urged the people to also join in the 1 Rumah 1 Jalur Gemilang campaign to boost their spirit of patriotism. He was speaking at the launch of the 2025 National Month and Fly the Jalur Gemilang campaign at Dataran Tanjung Emas here yesterday, marking the beginning of the nationwide celebration of patriotism and unity. Prime Minister Datuk Seri Anwar Ibrahim later flagged off the 2025 Jalur Gemilang Merdeka Expedition Convoy, which will travel across the country carrying the message of unity and patriotism. Fahmi said each year, different ways were used to instil patriotism among the people, adding that Muar was chosen for the launch due to its historic significance dating back to the Portuguese invasion of Melaka in 1511. 'This place was also known as Fortaleza de Muar or Bentayan Fort which protected Muar from the enemy due to its strategic location,' he added. Anwar said that the national day should not be limited to gaining independence from colonial powers but must also include the liberation of the people's minds and understanding. 'Merdeka is not just about breaking free from the British, but also liberating our way of thinking. 'We must rekindle the spirit of liberation and uplift the dignity of our people and our nation,' he said.

Federal leader's insult pushed GRS into unity govt, says Hajiji

GRS chairman Hajiji Noor said many of Sabah's demands were approved by Prime Minister Anwar Ibrahim, whereas previous leaders found difficulty in devolving power to the state. (Bernama pic) PETALING JAYA : A federal leader's disdain for the proposed 'Borneo Bloc' political cooperation led Gabungan Rakyat Sabah into supporting Anwar Ibrahim's formation of the unity government after the 2022 general election, GRS chairman Hajiji Noor said today. Speaking at the annual convention of Parti Gagasan Rakyat Sabah, he said a former federal leader, whom he did not name, had dismissed the idea of Bornean cooperation. 'I was with Masidi Manjun and Jeffrey Kitingan in a meeting with a big leader over there (in Peninsular Malaysia) at the time. The person said they were the masters. He did not like the Borneo Bloc. He did not want us to share our experiences and stories with our neighbouring state of Sarawak,' he said. 'I was shocked by his words. I thought about them for a long time. What did they mean? What was his intent? As I thought about it, I lost heart (tawar hati) in these people,' he said in a video of his speech published on Facebook by Sabah Media. Hajiji said it was after much thought that he finally decided that GRS would support the unity government being formed by Anwar. Since then, he said Anwar's government 'has listened to our voices, and we have been treated well', and reiterated that GRS remained in support of the prime minister. Hajiji said many of Sabah's demands under the Malaysia Agreement 1963 were approved by Anwar, as opposed to previous leaders who found difficulty in devolving power to the state. 'So what are we hoping for? If the unity government is good for our state, why shouldn't we support it?' he said. In March, deputy prime minister Fadillah Yusof said the unity government had successfully resolved nine key claims related to MA63, including power to regulate gas supply in Sabah, the administration of the judiciary in Sabah and Sarawak, and guidelines on land reserved for federal purposes in the two states.
