Husband gets 20 years' jail for causing death of pregnant wife in Sandakan
The court found Mohd Rusdi Mohd Nor, who is unemployed, guilty of unintentionally causing the death of Dr Azma Ab Rajab, a medical officer, on Nov 9, 2022, at their condominium on Jalan Utara.
Justice Datuk Celestina Stuel Galid ruled that the prosecution had proven the case beyond reasonable doubt under Section 304(a) of the Penal Code, which covers causing death without intent to murder.
In delivering the sentence, she acknowledged that the act was not premeditated and that there was no prior history of domestic violence.
However, she stressed the severity of the consequences, which included the death of both the wife and their unborn child.
During mitigation, the defence argued that Rusdi was remorseful, had cooperated fully with police, and that the incident happened spontaneously without intent to kill.
The court heard that there were no signs of strangulation, but injuries were found around the victim's nose, mouth, and neck.
Deputy Public Prosecutor Risal Abd Fikkah highlighted that the cause of death was asphyxiation due to smothering, and the victim had likely struggled to survive.
He also noted the tragic irony that Dr Azma, a dedicated emergency doctor at Duchess of Kent Hospital in Sandakan, who had spent her life saving others, died at the hands of her own husband.
The prosecution called 23 witnesses during the trial, while the defence called two, including the accused and a forensic consultant.

[UPDATED] Man with 41 criminal records among two shot dead in Jitra [WATCH]
JITRA: A man with a past record of over 40 criminal-related offences and his accomplice were shot dead in a shootout with police near the Bandar Darul Aman exit of the North-South Expressway this morning. The 8.05am incident unfolded when a team from the Kedah Criminal Investigation Department (CID) and Bukit Aman, who were patrolling the area, noticed two suspicious-looking men in a four-wheel-drive vehicle and attempted to stop it for inspection. Kedah police chief Datuk Fisol Salleh said the suspects refused to comply and instead opened fire, prompting officers to return fire. "Both suspects were killed during the exchange. "A search of the vehicle uncovered two firearms — a revolver and a semi-automatic pistol — along with several live rounds, a machete, and tools believed to be used in criminal activities," he told reporters at the scene. As a result of the incident, the southbound exit at Bandar Darul Aman was closed to traffic for four hours from 8.30am. Fisol said checks showed that one of the suspects, aged 41, had a past record of 41 criminal-related offences. The identity of the second suspect remains unknown, as no identification documents were found on him. He added that the duo are believed to be members of a larger criminal gang involved in violent crimes nationwide. "Their activities include drug trafficking, gangsterism, factory break-ins, and armed robbery. "Investigations suggest this group has been active since 2020. "So far, the forensic unit has recovered three bullet casings at the scene, and investigations are ongoing," he said. The bodies of both suspects have been sent to the Forensic Department at Sultanah Bahiyah Hospital in Alor Setar for post-mortem. The case is being investigated under Section 307 of the Penal Code for attempted murder. Meanwhile, Bukit Aman CID acting director Datuk Fadil Marsus, who was also present at the scene, said both suspects are believed to be part of a criminal syndicate involved in multiple serious crimes. Man denies raping lover's daughter
KUALA LUMPUR: A man pleaded not guilty in the Ampang Sessions Court to a charge of raping his girlfriend's daughter. Azman Hasim, 61, was charged with raping the girl, who was 12 years and four months old then, at a house in Taman Seraya last year. The man, who runs a nasi lemak business, is charged under Section 375 (g) of the Penal Code, which provides a maximum jail sentence of 20 years and whipping upon conviction. In the same court, the girl's biological mother, a 37-year-old security guard, pleaded not guilty to a charge of abetting in the rape at the same place and date, Bernama reported. No bail was allowed.
