Karnataka High Court dismisses property claim over Bangalore Development Authority land after 53 yrs

Bengaluru: The Karnataka High Court has dismissed a petition by a Bengaluru resident who sought to challenge a property acquisition made by the Bangalore Development Authority (BDA) more than five decades ago.

Venu, the petitioner, approached the court contesting BDA's rights over a property in Thippasandra, which was part of a land acquisition process initiated under the City of Bangalore Improvement Act-1945. The preliminary notification for acquisition was issued on Sept 22, 1970, followed by the final notification on July 15, 1971.
Venu, who claimed he had purchased the property on Oct 4, 1995 — 25 years after the acquisition — approached the court on Sept 29, 2023, after BDA listed the site for e-auction as part of HAL 3rd Stage layout on Sept 16, 2023.
He argued that he had possession of the 1,950 sqft site since 1995, had utilities and khata in his name, and claimed that BDA had never acquired the property.
BDA countered that the petitioner had no valid title and pointed to the extensive delay in raising objections. The authority argued that subsequent purchasers cannot challenge acquisition proceedings long after the process is completed.
Justice M Nagaprasanna, after reviewing the case, ruled that the petitioner failed to prove ownership or show that landowner Kenchamma had legally sold the site to him.
The judge also relied on the Supreme Court rulings that bar subsequent purchasers from contesting land acquisition under the Land Acquisition Act-1894, stating that such purchases are done at the buyer's risk.
"There is no need to examine beyond the timeline of events. The petitioner's claim collapses for lack of valid title and the inordinate delay of 53 years," the court observed. The petition was dismissed, leaving the BDA free to proceed with the auction of the site.

The Supreme Court on Tuesday said that qualified women should support themselves financially and not rely on interim maintenance from their husbands. The observation came during a hearing in an alimony case, where a woman had demanded a luxury apartment in Mumbai, Rs 12 crore as maintenance, and a BMW car—following just 18 months of marriage. According to reports, Chief Justice of India (CJI) BR Gavai strongly questioned the woman's demands, pointing out that she is well educated and can earn for herself. The CJI noted that the woman is an IT professional with an MBA degree, and pointed out that such qualifications make her employable in major tech hubs like Bengaluru and Hyderabad. 'You're an IT person. You've done your MBA. You're in demand... Why don't you work also?' he asked. "But that house is in Kalpataru... one of the good builders. You are an IT person. You have done your MBA. You are in demand in Bengaluru, Hyderabad... Why don't you work?" the Chief Justice was quoted as saying by the NDTV. "You had a marriage for just 18 months. And you also want a BMW?" CJI added. The woman, in response, claimed her husband is "very rich" and had filed for annulment of the marriage on the grounds that she is schizophrenic. 'Either you get a flat free of all encumbrances or nothing,' the CJI was quoted as saying by Bar and Bench. 'When you are highly educated and decide not to work out of your own volition…' Live Events This case echoes a similar ruling by the Delhi High Court in March this year. Justice Chandra Dhari Singh had stated on March 19 that the law does not support idleness. Interpreting Section 125 of the Criminal Procedure Code (CrPC)—which provides for maintenance of wives, children, and parents—the judge emphasized that it aims to ensure fairness and protection, not to encourage non-working behavior among qualified individuals. In that verdict, the High Court said, 'A well-educated wife, with experience in a suitable gainful job, ought not to remain idle solely to gain maintenance from her husband. Therefore, interim maintenance is being discouraged in the case as this court can see potential in the petitioner to earn and make good of her education.' In another case in December 2024, The Supreme Court has ruled that a wife cannot seek alimony to equalize the wealth of her partner in the event of a divorce . 'It cannot be expected of the husband to maintain [his wife] as per his present status all his life. If the husband has moved ahead and is fortunately doing better in life post-separation, then asking him to always maintain the status of the wife as per his own changing status would be putting a burden on his personal progress,' a Supreme Court bench of Justices B.V. Nagarathna and Pankaj Mithal said then.

TOI had reported on July 3 on the Joka-Esplanade Metro corridor overcoming a major hurdle with a Calcutta High Court division bench dismissing the appeal by tenants of a dilapidated DH Road property, where the Nepal Consulate was to be shifted to allow the Purple Line work. Following the SC order, the building at 1, National Library Avenue will be demolished and the Nepal Consulate next door will be relocated there. RVNL, implementing the 14-km Purple Line, needs the land at the current Nepal Consulate address (7/1 DH Road) for utility cable diversion and widening of the western side of DH Road, so that 60m of the 450-m ramp can be built. The Telangana High Court Tuesday directed Alliance Air Aviation Ltd, a subsidiary of Air India, to consider the representation of a group of 32 passengers and pay them Rs 12.8 lakh, along with 12 per cent annual interest, as ordered by the Hyderabad District Consumer Forum within three weeks. Justice N Shravan Kumar heard a writ petition that claimed Alliance Air failed to comply with an order issued on July 11, 2024, by the District Consumer Disputes Redressal Forum-II, Hyderabad. The petitioner, Shyam Sundar Lahoti, and 31 others approached the Consumer Forum with a case for deficiency of service against Alliance Air, as one of its flights was abruptly cancelled. They stated that the cancellation led to changes in their vacation plans, including the cancellation of a hotel reservation and the return journey. The Forum then directed Alliance Air to pay Rs. 12,80,000 along with 12 per cent interest from the date of receipt of the order in case of failure to comply within 45 days. The petitioners contended that despite being formally notified of the Consumer Forum's order via a notice dated September 20, 2024, Alliance Air neglected to pay the outstanding amount. The petitioners then reached Alliance Air's branch office in Hyderabad, but the office allegedly refused to accept a copy of the order or provide any compensation. Following this, the petitioners sent another notice to the Hyderabad branch on December 18, 2024. The petitioners informed the high court that Alliance Air has not filed any appeal against the Consumer Forum's order dated July 11, 2024. They then approached the Telangana High Court, asserting that the respondent's failure to pay is 'illegal, arbitrary, unjust, unconstitutional and in violation of Article 14, 19, and 300A of the Constitution of India and against the principles of natural justice.' The petitioner's counsel, Deepak Misra, argued that Alliance Air, as a public entity performing a public function, was bound to implement the orders of the forum, respond to the legal notices and representations sent to it, and issue orders. The Court then directed Alliance Air to comply with the orders of the district consumer forum.
