Contempt case: Appeal filed by KU syndicate member not maintainable, rules Kerala high court
A division bench of Justices Anil K Narendran and S Muralee Krishna, on Monday, upheld the decision of the high court Registry, which had earlier declined to number the appeal, citing defects in maintainability.
During hearing, the counsel appearing for HC submitted that, for an appeal to lie under Section 19(1) of the Contempt of Courts Act, the impugned order must be linked to an order awarding punishment for contempt.
Senior counsel appearing for Rajesh, however, contended that the single bench could not have directly proceeded to frame charges, as done in the present case, and could only have directed that the matter be placed before the appropriate bench.
After considering the submissions, the bench held that the appeal is not maintainable and observed that the defect pointed out by the registry stands sustained.
Previously, the single bench had directed HC registry to issue notice to Rajesh, requiring him to appear in the contempt proceedings on July 23.

The single bench had also directed that the matter be placed before the appropriate bench, as per the directions of the Chief Justice. This prompted Rajesh to file the present appeal.
The alleged Facebook post, made in connection with the litigation concerning the suspension of the Kerala University registrar, stated: "It is the goddess of justice who sits in the high court, not a woman holding a saffron flag." The single bench had observed that the remarks prima facie amounted to interference with the administration of justice and scandalising the court, and consequently initiated contempt proceedings against him.

(Chumchon Khon Surin /Facebook) As per Bangkok Post, the Thai Army stated that by late morning, clashes were reported at six locations along the contested border As per the Thai Army, one out of the six F-16 jets was fired into Cambodia and destroyed a military target. "We have used air power against military targets as planned," Thai army deputy spokesperson Richa Suksuwanon told reporters on Thursday. Also Read | Thailand, Cambodia shut borders, expel diplomats as tensions rise | What we know Meanwhile, Thailand has reported that Cambodian soldiers opened fire at a Thai military base in Surin and launched several rocket attacks towards Sisaket. After carrying out its air strikes, the Thai Army has stated that all F-16 jets are back at their bases. "All Thai F-16s have returned home safety and intact, after a rapid deployment to drop bombs on Cambodian battalions," the Thai army wrote in a social media post. Following Thursday's escalation, the Thai interior ministry has stated it is now working towards evacuating citizens along the border areas as a precautionary measure. Cambodia's National Defence ministry has accused Thailand from using heavy weapons, air strikes and rockets as part of an attempt to "seize" Cambodian territory. 'These unlawful and irresponsible actions not only pose a grave threat to regional peace and stability but also undermine the foundation of international order,' said Ministry spokeswoman Maly Socheata as per the Khmer Times newspaper. The defence ministry further stated that Thai fighter jets dropped two bombs on a road, adding that the Thailand has violated its agreement with Cambodia and opened fire. After this, around six Cambodian soldiers were seen in front of a Thai military base, armed with weapons and grenades. India said to be pushing back against EU's oversight proposal on capital flows citing sovereignty concerns
India has pushed back against a proposal by the European Union as part of free trade agreement talks which would give the 27-nation bloc a say in decisions related to capital flows , two Indian government sources said. The proposal, unusual in most free trade agreements, has raised concerns in New Delhi over limiting its ability to act unilaterally during crises, as both sides aim to conclude the deal by the end of 2025. India has in the past imposed restrictions on outflows, including during a currency crisis in 2013. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like The Top 25 Most Beautiful Women In The World Articles Vally Undo In its proposal to India, the EU has suggested an oversight committee on trade in services and investment policies which would review policy actions, including those taken during financial or balance of payments crises. "India fears such oversight could allow the committee to question or reverse crisis-time policy measures taken by it, which compromises a sovereign's decision-making powers," one of the sources said. Live Events India, which trades $190 billion in goods annually with the EU, has also sought clarity on whether decisions taken during emergencies, such as restrictions on capital flows, could be overturned if the committee finds them inappropriate. While trying to limit India's control over capital account decisions, the EU proposes it would have the right to impose temporary restrictions on capital outflows during serious economic difficulties. India argues this creates an imbalance in safeguard powers and deviates from the EU's own practice in FTAs with Vietnam, Singapore, and South Korea, where both sides can apply such measures in exceptional circumstances, the source said. Both sources declined to be identified as they are not authorised to the media. Emails sent to the Reserve Bank of India, Ministries of Finance and Commerce and to the Prime Minister's Office requesting comment did not receive a response. SEEKING BALANCED TRADE PACTS India's opposition to the EU's proposal comes as it negotiates deals with other trading partners including the U.S. and Australia. Accepting oversight or unequal safeguards could limit India's powers on domestic policies and may weaken its push for balanced trade pacts in the future, the sources said. "India has not had an agreement on the FTA so far because of issues such as every country in the bloc wants their point of view or interest to be included," a source from the Ministry of External Affairs said. The European Commission, in its report following the July round of negotiations in Brussels, said "good progress" had been made on capital movements, payments, and transfers, with discussions focused on remaining areas of divergence. India-EU trade talks have faced hurdles over the EU's push to cut import taxes on cars and dairy while seeking stricter climate and labour rules. India wants to protect local farmers, avoid rigid green rules, and keep control over legal disputes.

Wisconsin disappearance: 22-year-old woman goes missing after leaving a bar; found dead in Mississippi river
The body of 22-year-old Wisconsin graduate student Eliotte Heinz has been found in the Mississippi River, four days after she vanished following a night out with friends. Heinz, who studied at Viterbo University, was last seen in the early hours of Sunday after leaving the Bronco Bar in La Crosse. Her body was discovered just before 10:30 am. on Wednesday near Brownsville, Minnesota, more than 10 miles from where she was last spotted on security footage walking along the riverfront. 'This was not the outcome we had hoped for,' La Crosse police chief Shawn Kudron said. 'Our thoughts are with Eliotte's family, friends and all those who knew Eliotte. We are grateful for the outpouring of support from so many within the La Crosse community, the state of Wisconsin and nationally to locate Elliotte,' New York Post cited the officer. Heinz was reported missing by her loved ones on Sunday morning after repeated attempts to reach her failed. Security footage captured her walking alone near the Mississippi River about an hour after leaving the bar. Her phone was later found by friends near the riverbank. The disappearance sparked a large-scale search involving police and volunteers combing the waterfront and surrounding areas. Residents were urged to check home security footage for any possible sightings. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Flexible Program BITS Pilani Digital Apply Now Undo Viterbo University plans to hold a memorial service in her honour later this year, once students are back on campus. 'There are no words that can ease the pain of losing someone so young,' said university president Dr Rick Trietley. 'Our hearts go out to Eliotte's family. We hold them in our prayers and stand with them in their grief.' Heinz's mother, Amber, described her daughter as 'beautiful inside and out,' with 'the biggest heart and unending kindness for everyone.' Police say the investigation remains active as they await autopsy results to determine the official cause of death.
