Contempt case: Appeal filed by KU syndicate member not maintainable, rules Kerala high court
Kochi: High court has held that the appeal filed by R Rajesh, former MLA and syndicate member of Kerala University, challenging the contempt proceedings initiated against him over an alleged Facebook post targeting HC judges, is not maintainable. A division bench of Justices Anil K Narendran and S Muralee Krishna, on Monday, upheld the decision of the high court Registry, which had earlier declined to number the appeal, citing defects in maintainability. During hearing, the counsel appearing for HC submitted that, for an appeal to lie under Section 19(1) of the Contempt of Courts Act, the impugned order must be linked to an order awarding punishment for contempt. Senior counsel appearing for Rajesh, however, contended that the single bench could not have directly proceeded to frame charges, as done in the present case, and could only have directed that the matter be placed before the appropriate bench. After considering the submissions, the bench held that the appeal is not maintainable and observed that the defect pointed out by the registry stands sustained. Kochi: R Rajesh, former MLA and syndicate member of Kerala University, has filed an appeal challenging a high court single bench order that initiated criminal contempt proceedings against him over an alleged Facebook post targeting HC judges. The post was made against the backdrop of the legal battel over the university registrar's suspension. A bench of Justices Anil K Narendran and S Muralee Krishna has listed the appeal for July 21 for a detailed hearing on its maintainability. Earlier, the single bench had directed the high court registry to issue notice to Rajesh, requiring him to appear on July 23 in the contempt proceedings. The bench also ordered that the matter be placed before the appropriate bench, as per the directions of the Chief Justice. The alleged Facebook post, dated July 6, stated that "it is the goddess of justice who sits in the high court, not a woman holding a saffron flag." In its order, the single bench held that the remarks prima facie amount to interference with the administration of justice and scandalising the court. The bench observed that Rajesh had not merely criticised a judgment but had levelled serious accusations against the judges themselves, alleging that the bench hearing university-related matters was headed by staunch Sangh Parivar supporters. The single bench further stated that such language amounts to scandalising the court and maligning the reputation of the judges and accordingly initiated criminal contempt proceedings.

FB post: HC initiates contempt proceedings against ex-MLA
Kochi: High court has suo motu initiated criminal contempt of court proceedings against R Rajesh, former CPM MLA and a syndicate member of the Kerala University, over an alleged Facebook post targeting HC judges in connection with ongoing litigation related to the suspension of the university's registrar. Justice D K Singh directed the HC registry to issue notice to Rajesh to appear before court at 10.15am on July 23. The bench framed the charges against the alleged contemnor and instructed the registry to place the case before the appropriate bench, based on the orders of the Chief Justice. It is the duty of the court to stand in such a situation to maintain the majesty, honour and independence of the institution of justice, instead of surrendering to the individual interest of anybody, whatsoever, in the name of sympathy, leniency, compassion, forgiveness, etc. " The court further emphasised that no individual, including a public figure, can be permitted to make insinuations or allegations against judges in a manner that erodes public faith in the judiciary: "The alleged contemnor has made wild and unsubstantiated allegations through his Facebook post, thereby lowering the prestige and majesty of the courts in the eyes of the general public," HC said.

Two drown in Cauvery river near Kumbakonam
Thanjavur: Two people drowned in the Cauvery river near Kumbakonam in Thanjavur district on Sunday. One was swept while bathing, and another slipped and fell. Both their bodies were found on Monday. An engineering graduate named R Rajesh, 25, from Moopakoil in Kumbakonam taluk, along with his friends went to bathe in the Cauvery river on Sunday afternoon. He was swept away in the strong current. A seven-member team from the fire and rescue services station in Kumbakonam, led by K Balasubramanian, went and searched for the missing person. His body was swept for about four km and found near a place called Kodayanthottam on Monday morning. In another incident, S Pandiyan, 65, a banana leaf seller from Perumandi village in Kumbakonam, went to the ghat steps of the Cauvery river near Kumbakonam to wash himself on Sunday evening. He slipped from the steps and fell into the river. His body was found after hours. Police shifted the bodies to the Kumbakonam general hospital for postmortem and then handed them over to their family members. Two cases were registered separately under Kumbakonam East police station under BNSS Section 194 (unnatural death). Investigations are in progress.
