Lok Adalat settles 3.11 lakh pending cases in courts and 55.56 lakh pre-litigation cases in public authorities in Karnataka

A Lok Adalat organised by the Karnataka State Legal Services Authority (KSLSA) has brought down the number of cases pending in various courts in the State by 3.11 lakh on a single day through mutual settlement of litigation, besides resolving around 55.56 lakh pre-litigation cases that were pending before various public authorities.
But for amicable settlement, it could have taken at least 68 working days involving more than 1,000 judges to adjudicate these litigation and many of these pre-litigation cases would have given rise to a full-fledged litigation before the courts, said V. Kameswar Rao, acting Chief Justice of the High Court of Karnataka, who is also Executive Chairperson of the KSLSA.
28-year-old case
Addressing mediapersons here on Tuesday, the acting Chief Justice said a 28-year-old case of cheating was among the 2,377 old cases, pending for adjudication before various courts for more than 15 years, that were resolved through mutual agreement between the litigants.
The Lok Adalat has also resulted in the settlement of 1,756 matrimonial cases, including cases related to domestic violence, besides witnessing the reunion of 331 couples as they decided to leave behind their differences following the conciliation process undertaken by the judges of various family courts.
The amicable resolution of cases like cheque dishonour, land acquisition compensation, motor vehicle accident claims, debt recovery, and real estate and consumer disputes, has resulted in the settlement of around ₹2,878 crore, said Mr. Justice Rao.
The KSLSA will hold the next Lok Adalat across the State on September 13.

Ltd., an event management company, on Thursday moved the High Court of Karnataka challenging the report submitted by the one-man Commission of Inquiry on the incident of stampede outside M. Chinnaswamy stadium in Bengaluru during the victory celebrations of Royal Challengers Bengaluru (RCB) team on June 4. John Michael Cunha, a retired judge of the High Court of Karnataka, had conducted the inquiry under the provisions of the Commissions of Inquiry (CoI) Act, 1952, on the terms and reference notified by the State government, and submitted the report to the government on July 11. 'Biased manner' 'The commission seems to have proceeded in a biased manner as if it is a fault-finding commission rather than a fact-finding commission, and thus report is vitiated,' it has been alleged in the petition while pointing out that a copy of the report was not given to the petitioner even though it was leaked to the media. Finding several flaws in the 'hastily' conducted inquiry proceedings, the DNA has alleged that the entire inquiry process would be violative of the principles of natural justice and contrary to the provisions of the CoI Act, 1952, as no opportunity to cross-examine the witnesses was given to it. '...the haste with which the respondents conducted the inquiry gives the impression that the government wanted to save its skin and that the Commission of Inquiry was a mere eyewash in order to pacify the general public and to deflect the blame from itself by making innocent persons such as the petitioner and its officials a scapegoat,' it has been alleged in the petition. DNA, which participated in the inquiry proceedings before the commission, has also contended that it was not given a copy of the depositions of its witnesses and the other witnesses as well as the documents marked in spite of the making written request in this regard. It has also been claimed in the petition that the commission failed to give a personal hearing as per the provisions of the Act before making any adverse remarks that could prejudicially affect reputation of any person, despite the request in this regard made by the representative of the DNA.

The Central government has told the High Court of Karnataka that no decision has been taken on deportation of two minor children of Russian woman Nina Kutina, who was taken into custody after she was found living in a cave deep inside the forest at Gokarna in Uttara Kannada district on July 11. The submissions in this regard were made before Justice S. Sunil Dutt Yadav on Wednesday during the hearing of a petition filed by Dror Shlomo Goldstein, father of the children and former husband of Ms. Kutina. The petitioner, an Israeli national, had sought a direction to the Centre not to immediately deport minor children, Prema, 6, and Ama, 5, and permit him to meet the children, who have been kept in detention centre, and hand over the custody of children to him. No records of child Arvind Kamath, Additional Solicitor-General of India, appearing for the Centre, told the court that Ama Kutina had no records evidencing her birth nor does she possess any travel documents. In the light of non-possession of travel documents, for the present, the apprehension of petitioner regarding deportation of the children was not a reasonable one, he said. Taking note of the submissions, the court gave two weeks to the Central government to take a stand on the petitioner's pleas while making it clear that if there was any proposal for deportation before the next date of hearing, August 18, the Centre could move the court.

UP: 1 killed, 3 injured as SUV crashes into handpump in Mirzapur

Mirzapur, Jul 24 (PTI) A speeding SUV lost control and crashed into a roadside handpump in the Mirzapur district here, killing an individual and injuring three others, the police said on Thursday. The incident occurred in Jamui village under the Chunar Police Station limits, Circle Officer (CO) Manjari Rao said. According to the CO, the Mahindra Scorpio was heading from the Jamui market towards Chunar around 9 am when the driver lost control near a railway overbridge. The vehicle rammed into a handpump where three people, including a woman, were filling water. All three individuals sustained injuries. The driver fled the scene after the accident. 'One of the injured was referred to the trauma centre in Varanasi by doctors at the CHC Chunar," Rao added. The deceased was identified as Mangla Prasad Jaiswal (40), the officer said. Following the incident, the villagers briefly blocked the road in protest. The police managed to pacify the crowd and cleared the blockade later.
