LCIA trial: Govt may pursue out-of-court settlement with Star Hydro

ISLAMABAD: The government is likely to pursue an out-of-court settlement with the Star Hydropower Project, which initiated arbitration proceedings at the London Court of International Arbitration in October 2024, according to sources in the Finance Ministry.
The issue was reportedly discussed during Finance Minister Senator Muhammad Aurangzeb's visit in April 2025, where he met with Hiroshi Matano, Executive Vice President of the Multilateral Investment Guarantee Agency (MIGA). Matano emphasized the importance of resolving the matter through negotiation.
The Star Hydropower Project is a 147 MW run-of-the-river plant located 120 kms northeast of Islamabad on the Kunhar River. The project operates under a 30-year Build-Own-Operate-Transfer (BOOT) model. MIGA, a member of the World Bank Group, has provided a political risk guarantee to a South Korean equity investor in the project, KDS Hydro Pte. Ltd., against breach of contract by the Government of Pakistan.

Sources said the Finance Ministry has convened a high-level meeting to explore options for an amicable settlement with the power company to avoid further legal and financial complications.
In April 2024, an arbitration award under the MIGA - covered Government of Pakistan (GoP) guarantee was issued in favor of Star Hydro. Pakistan was given three weeks from April 17, 2024, to fulfill the payment obligations. Failure to pay would allow the investor to initiate enforcement proceedings, and if unsuccessful, MIGA's guarantee holder could file a claim under the breach of contract coverage.
The dispute dates back to September 2022 when Star Hydro initiated arbitration under the GoP Guarantee after the National Transmission and Despatch Company (NTDC) — the state-owned power off-taker—refused to honor an earlier arbitration award. That award ordered NTDC to pay significant sums for liquidated damages caused by delays in the project's commercial operation date. The amounts included: (i) Rs. 2.02 billion in delay-related invoices; (ii) $16.45 million in principal damages; (iii) $2.73 million in partial legal costs; and (iv) £51,180 in arbitration costs. These remain unpaid.
Under the terms of the MIGA guarantee, Pakistan is obligated to pay the awarded amounts. If it fails to do so within 180 days, MIGA would be required to compensate the investor, creating an international obligation for Pakistan. Notably, MIGA has never had to pay a claim under its breach of contract risk in its history. Should that change, the implications for Pakistan could be significant, both financially and diplomatically. The Finance Ministry is therefore weighing a negotiated settlement to mitigate potential long-term consequences and uphold Pakistan's international financial commitments, the sources added.

Aurangzeb, who is representing Pakistan in the Fourth International Conference on Financing for Development (FFD4), met with Eelco Heinen, Minister of Finance of the Netherlands, for a detailed bilateral exchange. Aurangzeb urges global push to revive development cooperation at FfD4 As per the statement, the meeting focused on further strengthening the long-standing and cordial ties between the two countries, particularly in the domains of trade, development cooperation, climate resilience, and institutional capacity-building. Both sides shared perspectives on enhancing economic engagement, technical collaboration, and the potential for deepening partnerships in areas such as blended finance, climate finance, and digital transformation. The Pakistani side expressed keen interest in leveraging Dutch expertise in agri-tech, water management, and the digitization of public services. During the meeting, the Dutch Finance Minister reaffirmed his country's support for Pakistan's structural reform agenda and emphasised the importance of policy continuity, transparency, and facilitation of investment flows. Aurangzeb also held a detailed meeting with Axel van Trotsenburg, Senior Managing Director of the World Bank, on the sidelines of the Fourth International Conference on Financing for Development. The minister appreciated the World Bank's continued support for Pakistan's development agenda and shared updates on the successful review of the International Monetary Fund (IMF) Extended Fund Facility (EFF) program and ongoing reforms under the Resilience and Sustainability Facility (RSF). He also highlighted the launch of Pakistan's National Green Taxonomy, developed with World Bank support, which aims to guide sustainable investments and is expected to be approved soon. Aurangzeb welcomed the World Bank's endorsement of the new 10-year Country Partnership Framework (CPF 2026–2035), which focuses on key areas including child stunting, learning poverty, climate resilience, fiscal space, decarbonization, and private investment. In a separate meeting, the finance minister held in-depth discussions with Alvaro Lario, President of the International Fund for Agricultural Development (IFAD), a specialized UN agency focused on rural development and food system transformation. The two sides reviewed the long-standing collaboration between Pakistan and IFAD. Aurangzeb acknowledged IFAD's ongoing support through six active projects in Pakistan. The meeting covered a wide range of IFAD-supported initiatives in Pakistan, including policy support, vocational training, community infrastructure, access to finance, climate-smart agriculture, value chain development, and resilience against climate shocks. Additionally, Aurangzeb met with John W.H. Denton AO, Secretary-General of the International Chamber of Commerce (ICC). The two discussed avenues for enhanced cooperation in trade facilitation, SME development, investment promotion, and the role of the ICC in supporting Pakistan's economic transformation. Particular emphasis was placed on private sector engagement, international best practices, and institutional capacity building to unlock new opportunities for sustainable growth and inclusive development in Pakistan.

SEOUL: Round-up of South Korean financial markets: South Korean shares rose on Thursday, lifted by hopes of easing trade tensions following the US's deal with Vietnam, a key manufacturing hub for several South Korean companies. The benchmark KOSPI added 32.27 points, or 1.05%, to 3,107.33 as of 0137 GMT. On Wednesday, President Donald Trump said Vietnamese exports will now attract a lower-than-promised 20% tariff, cooling tensions with the United States' tenth-biggest trading partner days ahead of his July 9 negotiating deadline. South Korean President Lee Jae Myung said he was doing his best to achieve a 'mutually beneficial and sustainable' outcome from negotiations with the US Tech major Samsung Electronics, which runs factory operations in Vietnam, rose 2.63%. Chipmaker SK Hynix lost 0.18%, but battery maker LG Energy Solution climbed 1.98%. Hyundai Motor gained 0.23%, while sister automaker Kia traded flat. Steelmakers, hit by a massive 50% tariff, rallied. POSCO Holdings climbed 9.38%, while Hyundai Steel jumped 13.4%. Of the total 933 traded issues, 643 advanced and 239 declined. Foreigners were net buyers of shares worth 273.5 billion won ($201.6 million). The won was little changed at 1,355.3 per dollar on the onshore settlement platform. In the money and debt markets, September futures on three-year treasury bonds gained 0.06 point to 107.19.

Crypto mining, other sectors: IMF rejects Pakistan's subsidised power tariffs proposal

ISLAMABAD: The International Monetary Fund (IMF) has rejected Pakistan's proposal to offer subsidised electricity tariffs to crypto mining and certain industrial sectors, warning that such moves would create new complications in the already strained power sector. Testifying before the Senate Standing Committee on Power, chaired by Senator Mohsin Aziz, Secretary Power Dr Fakhray Alam Irfan stated that all major power sector initiatives must be cleared by the IMF. He noted that although Pakistan has surplus electricity, particularly in winter months, the IMF is cautious about any pricing mechanisms that could distort the market. In September 2024, the Power Division proposed a six-month incremental consumption package (October–March) at marginal cost (Rs 23/kWh), based on last year's usage. However, after two months of discussion, the IMF only approved a three-month version, citing potential market distortions. The curious case of Bitcoin mining in Pakistan In a subsequent plan shared in November 2024, the Power Division suggested a targeted marginal cost-based package (Rs 22–23/kWh) for energy-intensive industries such as copper and aluminium melting, data centers, and crypto mining, arguing it would boost consumption of surplus electricity and reduce capacity charges. Still, the IMF rejected the proposal, stating it resembled sector-specific tax holidays that have historically created imbalances. 'As of now, the IMF has not agreed,' Dr Irfan confirmed, adding that the plan is also under review by the World Bank and other development partners. He emphasised that the government has not withdrawn the proposal and remains engaged with international institutions to refine it. During the session, a heated debate also emerged on the government's recent agreement with scheduled banks to reduce the circular debt stock of Rs 1.275 trillion. Senator Shibli Faraz criticised the deal, stating that banks were 'forced at gunpoint' to offer the loans. 'If I were a banker, I would have refused,' he said, warning that the burden would fall on consumers through future levies. Secretary Power rebutted this claim, clarifying that no new levies have been imposed. He stated that the existing Debt Servicing Surcharge (DSS) of Rs 3.23/kWh will continue for the next five to six years to recover the amount. He also highlighted that circular debt inflows have been reduced through timely subsidy injections. On consumer facilitation, Dr Irfan reported that over 500,000 people have downloaded the 'Apna Meter Apni Reading' app, allowing users to upload photos of their meter readings to potentially reduce inflated billing. He said the app will soon be extended to K-Electric (KE) users. The committee also expressed displeasure over the absence of the Federal Minister for Power, who was expected to answer questions on Independent Power Producers (IPPs) and sectoral inefficiencies. Senator Mohsin Aziz said the establishment of certain IPPs was an injustice and questioned why excess profits have not been recovered. Senator Shibli Faraz alleged that inflated project costs were used to justify higher returns, adding that no real steps have been taken to curb the circular debt crisis. 'The public is bearing the burden of government inefficiencies,' he said. Senators raised concerns about forced load shedding, especially in areas like Tharparkar, Matiari, and Umerkot, where daily outages last up to 14 hours, despite consumers paying their bills. Senator Poojo Bheel accused local officials of corruption, claiming they take bribes for illegal connections and restore disconnected supplies for a 'fee'. He emphasised that even paying customers are facing denial of their rights due to systemic failure. In response, Dr Irfan explained that revenue-based load shedding occurs in areas with losses exceeding 20%, citing a tragic case where a SEPCO employee was fatally stabbed during a disconnection drive. KE's Chief Distribution Officer Sadia Dada said that out of 2,100 feeders, about 30% face load shedding due to high electricity theft, often through Kundas (illegal hooks) in informal settlements. She said consumer bills are now offered in instalments to ease payment difficulties. Dr Irfan stated that 58% of consumers fall under the 'protected' category, paying Rs 10 per unit. With the approval of international partners, the government will allocate Rs 250 billion in subsidies, while also rolling out more tech-based solutions for theft control. So far, 500,000 people have downloaded the meter reading app, with 250,000 registered users. Senator Haji Hidayatullah raised an over-billing case involving a Rs 2.3 million charge on a property in Peshawar that had already been cleared by PESCO. He claimed PESCO officials offered to settle the bill for Rs 300,000, calling it blatant corruption. The Secretary Power assured that the matter will be investigated. The CEO of HAZECO also briefed the committee on issues in Sub-Division Lora Chowk, including estimated billing, feeder faults, and pending ELR work under release numbers 46241, 51911, and 51910. Following extensive deliberations, the committee expressed displeasure at the Power Division's repeated deflection of questions and directed the department to submit comprehensive answers at the next meeting.
