Johor odd job worker escapes gallows, acquitted of drug trafficking charge
Justice Suriyati Hasimah Mohd Hashim acquitted Kua Seng Poo, who was charged under Section 39B(2) of the Dangerous Drugs Act 1952, for trafficking 69.33g of methamphetamine.
She ruled that the prosecution had failed to prove the custody of the drug especially when there was a conflict of evidence between the police arresting officer and the investigating officer.
A total of four witnesses were called during the trial including an arresting officer, storekeeper, chemist and investigating officer.
According to the charge sheet, the accused had committed the offence at about 1.15pm in a place in Taman Sentosa at about 1.15pm on Sept 23, 2021.
Deputy Public Prosecutor Rashidah Baharom prosecuted while lawyer N. Mariappan represented the accused.

Judge Datuk Ahmad Shahrir Mohd Salleh ordered Ku Muhammad Hilmie Ku Din, 35, to pay the amount to Rosmah, after finding that the plaintiff had successfully established her entitlement to damages for defamation. "This court finds a global award in the sum of RM100,000 for general and aggravated damages. This court has decided not to award exemplary damages. "The claim for exemplary damages is not allowed as there is no cogent evidence before this court to support such an award," he said during the decision for the assessment of damages today. The proceeding was held online. The court ordered interest of five per cent per annum on the judgment sum to be imposed from the date of judgment until full satisfaction of the award. Ku Muhammad Hilmie Ku Din, 35, was also ordered to pay costs of RM20,000. In his judgment, Shahrir said the court found that the defamatory allegations levelled against Rosmah impute her involvement in supernatural practices and associate her with spiritual entities. "These imputations constitute an attack on her character in the domains of religious integrity and moral standing. "In a societal context where religious values and moral propriety carry significant weight, such allegations assume a particular seriousness and have the potential to cause distinct reputational harm,' he said. [UPDATED] High Court awards Rosmah RM100k in defamation suit against TikTok user
KUALA LUMPUR: The High Court today ordered a TikTok user to pay RM100,000 in damages to Datin Seri Rosmah Mansor for defaming her of engaging in sinful practices, devil worship, black magic rituals, and polytheism two years ago. High Court judge Datuk Ahmad Shahrir Mohd Salleh fixed the amount after finding that Rosmah, as the plaintiff, had successfully established her entitlement to damages for defamation from defendant, Ku Muhammad Hilmie Ku Din, the owner of TikTok account "CEO Hilmie Fighter." "This court finds a global award in the sum of RM100,000 constitutes a just and proportionate assessment," he said in his judgment in assessment of damages in Rosmah's defamation suit. The judge said the global award in the sum of RM100,000 comprised general and aggravated damages. "The claim for exemplary damages is not allowed as there is no cogent evidence before this court to support such an award," he said in an assessment of damages proceedings. Rosmah, the wife of former prime minister Datuk Seri Najib Razak, was represented by lawyer Datuk Abu Bakar Isa Ramat and Mohamed Baharudeen Mohamed Ariff. Ku Muhammad Hilmie was also ordered to pay RM20,000 in costs. On May 28 last year, Ahmad Shahrir granted Rosmah a judgment in default (JID) after Ku Muhammad Hilmie failed to file an appearance or defend the suit. A JID is a court ruling favouring one party due to the opposing party's failure to respond or appear in court, thus allowing the plaintiff to win by default. Rosmah had sought RM1 million damages from Ku Muhammad Hilmie in the defamatory suit initiated on Sept 19, 2023. Ahmad Shahrir said he found that the defamatory allegations levelled against Rosmah imputed her involvement in supernatural practices and associate her with spiritual entities. "These imputations constitute an attack on her character in the domains of religious integrity and moral standing. The judge said he came to the sum after considering the current judicial trend towards moderation in damages and the principle that damages are compensatory in nature and not intended to be punitive. He said although Rosmah had been convicted by the Kuala Lumpur High Court over the RM1.25 billion solar energy project for Sarawak rural schools and currently appealing at the Court of Appeal, damages in a defamation claim must be assessed without reference to that conviction. He said her conviction cannot be used as evidence of bad character for the purpose of reducing the quantum of damages. In the suit, Rosmah claimed that Ku Muhammad Hilmie uploaded a video on his TikTok account making false and defamatory statements about her. Rosmah contended that the defamatory remarks damaged her reputation as the wife of Malaysia's sixth prime minister and the patron of several charitable organisations. As a result of the defamatory statement, she said she was viewed negatively by the public, mocked and humiliated - thus tarnishing her reputation as a public figure.

Security guard charged with murder
KUALA LUMPUR: A security guard was charged in the Magistrate's Court here on Monday (July 7) with the murder of a man during a street fight in Sentul two months ago. K. Nagentherah, 39, nodded in understanding after the charge was read before Magistrate MS Arunjothy, but no plea was recorded as the case falls under the jurisdiction of the High Court. He is accused of murdering K. Kumaran, 44, by the roadside at Taman Intan Baiduri, Sentul here, at 9.23pm on May 25. The charge, framed under Section 302 of the Penal Code, carries the mandatory death sentence or imprisonment of between 30 and 40 years, along with a minimum of 12 strokes of the cane if the death penalty is not imposed. The court set Sept 10 for mention of the case to obtain the post-mortem report. – Bernama
