FMCSA refuses correction request on side underride guards on trailers
In its request for the correction filed in December, the Insurance Institute for Highway Safety (IIHS) said that FMCSA's exclusion of a crucial cost-benefit analysis in a review of side-underride studies puts at risk IIHS' reputation for providing independent, data-driven information to its members.
IIHS explained that it created a 'Toughguard' award to encourage trailer manufacturers to design rear underride guards that provide more protection for rear-end crashes than those designed to minimum regulatory requirements.
'Currently, IIHS is considering a new award for side underride guards based on our own analyses of real-world crashes as well as crash tests of an aftermarket design,' the group told FMCSA.
'The suppression of the [cost-benefit data] undermines this effort and could result in IIHS being seen as lacking justification for a side guard award. This could damage our reputation as a trustworthy, objective organization committed to public safety, weakening our position when advocating for all types of traffic safety improvements. And it could discourage trailer manufacturers from offering side underride guards that could prevent hundreds of fatalities and even more severe injuries each year.'
FMCSA was not swayed. In a response letter published on Thursday, the agency pointed out that, based on federal criteria for information quality, IIHS 'has the burden of proof with respect to establishing the necessity for correction. The IIHS has not met this burden and FMCSA has determined that there is no inconsistency' regarding the exclusion of the cost-benefit data. 'FMCSA has determined that no correction is necessary.'
FreightWaves reached out to IIHS for comment.
The determination made by FMCSA is the second setback for side-guard safety advocates in less than a month. In March, the National Highway Traffic Safety Administration ruled there was insufficient evidence in a petition submitted by the Institute for Safer Trucking to warrant an investigation into whether truck trailers without side underride guards should be recalled as unsafe.
Side underride guards can prevent passenger cars from sliding underneath trailers and injuring or killing the occupants.
After considering the petition, NHTSA determined that the issues raised by the safety group are better addressed in a separate underride guard rulemaking currently under review at the agency.
FMCSA listed several reasons explaining why the cost-benefit analysis cited by IIHS, which was part of a report issued by the Volpe National Transportation Systems Center and paid for by the Department of Transportation, was ultimately left out of FMCSA's review.
The analysis, according to the agency, 'overestimated the target population without detailing the source of the estimate, overestimated the effectiveness of LPDs [lateral protection devices] in various crash scenarios (including pedestrian and bicyclist impacts with the cab and front of the vehicle where no LPD is present), and underestimated the cost of LPDs, installation and maintenance cost, and additional fuel cost due to the added weight of LPDs.'
Also, the methodology used in the Volpe report 'included incidents in which the vulnerable road user was struck at an impact location where LPDs would not be present, such as by the front of the commercial motor vehicle,' FMCSA asserted. 'Therefore, the analysis would result in an over-estimation of the target population associated with LPDs, thereby leading to a significant over-estimation of the benefits.'

The study, done in collaboration with Canada's Traffic Injury Research Foundation, reveals a 33% increase in U.S. traffic fatalities from 2011 to 2021. The IIHS found that vulnerable road users - like cyclists and pedestrians - saw a 17% decline in deaths in Canada, while U.S. fatalities in those categories jumped by 64%. Truck-involved deaths rose 54% in the U.S. but fell 24% north of the border. Among young drivers, Canada posted a 52% drop in fatalities, compared to a 17% increase in the U.S. Alongside stronger enforcement, the IIHS is also pointing to the importance of vehicle safety itself. As recent IIHS crash tests have shown, brands like Volvo and Tesla continue to lead in real-world safety, while more rugged, body-on-frame SUVs and pickups from Jeep and GM struggled to meet top-tier standards. The Institute argues that smarter policy needs to go hand in hand with safer vehicles - especially as large SUVs remain popular with American buyers with tight budgets can prioritize crash protection. Earlier this year, the IIHS published a list of smart choices for families shopping on a budget, outlining safe, affordable cars recommended for teen drivers. The goal is to remove barriers for entry-level buyers, making safety accessible even in used markets. The cultural differences between the U.S. and Canada are relatively minor, the IIHS notes, which makes Canada's success even more compelling. The organization says the U.S. doesn't need to invent new strategies - just implement and enforce the ones that already automakers are doing their part. According to recent safety rankings, a surprising brand topped the charts for 2025, reminding buyers that crash protection doesn't always come with a luxury badge. Still, the IIHS says manufacturers alone can't reverse the trend. It will take stronger laws, smarter enforcement, and real policy change - not just five-star marketing. The safest new cars of 2025, according to the IIHS
Life, in a lot of ways, is a lot like driving a car. You might not be able to see further than your headlights, but by setting high standards for the things you do, you can challenge yourself to put in maximum effort, drive improvement, and achieve better results. Perhaps that's what the brains at the Insurance Institute for Highway Safety IIHS had in mind when they rolled out this year's safety tests. After decades of significant improvements to driver seat safety, thanks to automaker advancements in seatbelt and airbag technology, this year, it focused on the little guy-the one in the back seat. The IIHS is funded by insurance companies, which means that safety is its main priority. Every year, it conducts a series of crash tests on new vehicles, rating them as Advanced, Superior, Good, Acceptable, Marginal, or Poor. The highest-rated vehicles earn the designation of either Top Safety Pick or Top Safety Pick+, which meet its most stringent safety requirements. As a result, the IIHS' list of top vehicles was cut dramatically-in 2024, 71 vehicles were designated Top Safety Pick or Top Safety Pick+, while in 2025, only 48 vehicles made the cut. View the original article to see embedded media. In its updated moderate overlap front test, a vehicle simulates a head-on collision, striking a vehicle of equal size and weight at 40 mph. This year, the Institute toughened the test by adding a second crash dummy in the second row. This dummy represented a small woman or 12-year-old child and was positioned behind the driver. According to the IIHS, the test "uses new metrics that focus on the injuries most frequently seen in rear-seat occupants." Last year, vehicles that scored a rating of "acceptable" or "good" received the topmost designation. This year, they had to earn a "good" rating to rank as a Top Safety Pick+, and an "acceptable" rating to be considered a Top Safety Pick. Advanced seatbelt technologies and front-seat airbags have greatly decreased the risk of fatal injury to drivers and front-seat passengers-according to the National Highway Traffic Safety Administration (NHTSA), when used together, seatbelts and airbags reduce the risk of death in frontal crashes by 61%. IIHS updated its moderate overlap front test in 2022, challenging automakers to strengthen vehicle structures, or "crumple zones," improve airbag technology, and develop more advanced seat belts that could absorb the force produced in a crash. In fact, according to the IIHS, in the event of a collision, the risk of fatal injury is now higher for backseat passengers than it is for front-seat passengers, assuming all passengers are wearing seatbelts. While automakers have started to focus more on improving rear-seat safety, the IIHS has discovered certain vehicle classes-especially minivans and pickup trucks-that have lagged behind. Minivans were noticeably absent from this year's IIHS Top Safety Picks and Top Safety Pick+ vehicles, while only two pickup trucks made the list. How a New Bill Would Shape the Future of Autonomous Trucking
Congress has introduced new legislation that would create a regulatory framework for U.S. autonomous trucking. The bill, introduced by U.S. Representative Vince Fong from California, is named the "AMERICA DRIVES" act, which stands for the "Autonomous Mobility Ensuring Regulation, Innovation, Commerce, and Advancement Driving Reliability in Vehicle Efficiency and Safety Act." Fong notes that establishing a national standard for this industry would help avoid varying state-by-state requirements. If passed, the law would grant self-driving trucks with Level 4 or Level 5 autonomy permission to operate on interstates without an onboard human driver or a remote safety operator. Advocates of the bill argue that such approval would advance America's position in the self-driving race while also helping solve a nationwide shortage of drivers. According to AltLine, the U.S. has a truck driver staff shortage of 24,000, resulting in the domestic freight industry missing out on $95.5 million weekly. Representative Fong said, "While Europe and China are rapidly integrating autonomous trucks into their supply chains, America is asleep at the wheel, hamstrung by a confusing patchwork of state regulations that threaten public safety, innovation, and economic growth," Advanced Clean Tech News reports. Fong's bill would exempt autonomous trucks from human-specific requirements enforced by the U.S. Department of Transportation (USDOT) and the Federal Motor Carrier Safety Administration (FMCSA), such as hours of service, drug testing, commercial driver's licenses, and certain physical qualifications. Self-driving trucks would also be able to contain cab-mounted flashing warning beacons signaling a disabled status-a feature previously barred under federal law. Cab-mounted flashing warning beacons would replace the traditional human-led response of placing warning triangles on the ground near disabled vehicles. Fong's legislation would request that the USDOT and the FMCSA update federal regulations by 2027. There are 35 states allowing some form of autonomous truck testing or deployment, while other states have restrictive or conflicting regulations, according to Overdrive Online. The bill has been referred to the House Committee on Transportation and Infrastructure, where it needs approval before heading to the full House. The Owner-Operator Independent Drivers Association (OOIDA) wrote to the National Highway Traffic Safety Administration (NHTSA) in March promoting a cautious approach to autonomous trucking that emphasizes public transparency. OOIDA President Todd Spencer said, "While autonomous vehicles might improve safety under certain conditions, they create new risks with dangerous outcomes. OOIDA has advocated for autonomous vehicle standards that are based on documented research and testing data. OOIDA supports mandatory testing, safety, and crash-reporting requirements that will provide the public with direct and easy access to information about autonomous vehicle performance," Land Line Media reports. Missy Cummings, Director of George Mason University's Autonomy and Robotics Center, identified phantom braking-unexpected braking during self-driving-as a key hurdle autonomous trucks must overcome to achieve success. She added that a failure to address phantom braking in trucking will negatively impact the rollout of self-driving passenger cars. Advocates of AMERICA DRIVES, such as U.S. Representative Fong, believe that the bill will resolve a complicated patchwork of state-level rules that could hinder America's progress in autonomy while simultaneously addressing a driver shortage. According to the Washington Examiner, 75% of all U.S. freight is delivered by truck, and an overworked and under-resourced industry results in slower deliveries and higher prices. Chinese companies are already deploying autonomous driving systems at scale across over 85% of China's national highways, placing increasing pressure on Washington to update regulations while keeping safety at the forefront.
