Bail delayed for SANDF soldiers accused of killing Ethiopian nationals and Hawks investigator

The Randburg Magistrates' Court postponed the bail application of 12 South African National Defence Force (SANDF) members to Thursday, to allow for the verification of their residential addresses.
The accused 12 soldiers face multiple serious charges, including three counts of murder, kidnapping, fraud, obstruction of justice, perjury, and theft of a motor vehicle.
The charges stem from the alleged kidnapping of Ethiopian businessman and suspected ISIS funder Abdella Hussain Abadiga and his bodyguard Kadir Jemal Abotese on 29 December 2022 at Mall of Africa in Midrand.
National Prosecuting Authority (NPA) Gauteng regional spokesperson, Phindi Mjonondwane, said the victims were reportedly abducted from the Midrand mall and taken to the Zwartkop Military Base, and their whereabouts remain unknown.
'The accused are also linked to the assassination of Lieutenant Colonel Frans Mathipa, a Hawks officer investigating the kidnapping. Mathipa was fatally shot on 6 August 2023 on the N1 Highway by individuals reportedly driving a SANDF vehicle,' said Mjonondwane.

When Lieutenant Colonel Frans Mathipa was shot dead in 2023, he was probing allegations that members of the SANDF Special Forces had abducted two people including an Ethiopian businessman and suspected ISIS leader from the Mall of Africa.

During the court proceedings on Tuesday, the defence submitted affidavits in which the accused deny any involvement in the incidents.
A statement from their commanding officer was also submitted in support of the bail application.
Mjonondwane said the NPA views the matter in a serious light, given the nature of the charges and the potential threat to the administration of justice.
The accused SANDF members were arrested in June.
IOL previously reported that some of the soldiers were arrested at different places, including the OR Tambo International Airport and Centurion in Tshwane.
Following the arrests, spokesperson for the Hawks, Lieutenant Colonel Christopher Singo, stated that the arrests were carried out by members of the Johannesburg-based Hawks' Serious Organised Crime Investigation, the headquarters' Serious Organised Crime Investigation, and the Tactical Operations Management Section (Toms).
'The arrests are linked to the murder of Lieutenant Colonel Frans Mathipa, who was fatally shot while driving on the N1 highway near Hammanskraal on August 6, 2023. Following the shooting, his vehicle lost control and veered into a ditch,' Singo said.
Mathipa, who was attached to the Hawks' Crimes Against the State Unit within the Serious Organised Crime Investigation in Gauteng, was on duty conducting an investigation at the time of his death.

Fourth suspect in R7m transformer theft awaits bail hearing, case postponed
The case of the three Tshwane officials accused in the brazen theft of a transformer worth R7-million has been postponed to July 11. This comes after a fourth accused, Katlego Molepo (32), handed himself over to the Atteridgeville police station on July 6, according to the NPA. National Prosecuting Authority (NPA) spokesperson Lumka Mahanjana said the case was postponed for Molepo's bail hearing, which the state opposes. 'The case was postponed to July 11 for the Schedule 6 opposed bail application of the fourth accused,' she said. She said Molepo is the alleged buyer of the transformer and would be facing the same charge as the three officials accused of stealing a transformer valued at R7-million. 'All three are facing a charge of theft of essential infrastructure, relating to a transformer stolen from the Claudius Substation in Laudium.' Mahanjana said on July 8, the Atteridgeville Magistrate's Court granted the three Tshwane officials bail. 'Kleinbooy Mahlangu (45) from Soshanguve was granted bail of R35 000, while Thomas Baloi (41) from Pretoria North and Daniel Kubayi (50) from Hammanskraal were each granted bail of R30 000.' The three were arrested on July 1 after the Gauteng Organised Crime unit conducted almost a year-long thorough investigation of the theft of the transformer. She said the TMPD and SAPS allegedly responded to a tip-off about a theft in progress at the Claudius Substation on November 7, 2024. 'Upon arrival, they found cranes, trucks, and a City of Tshwane-branded vehicle on-site. When no proof of work authorisation could be provided, 11 people were arrested,' she said. Mahanjana said 10 individuals were later released from custody. She said during investigations, it was found that Mahlangu, Baloi, and Kubayi had fled the scene before police arrived. 'Warrants of arrest were issued, and the three were arrested at their respective workplaces,' she said. Mahanjana added that the state did not oppose their release on bail. 'Prosecutor Grace Komane submitted an affidavit from Investigating Officer Sergeant Thabo Lukhele, stating that the accused had co-operated with the police, is permanently employed by the City of Tshwane, and therefore they do not pose a flight risk,' she said. KZN man sentenced to life for girlfriend's brutal murder
The Vryheid Regional Court has sentenced a 51-year-old Mondlo man to life imprisonment for the brutal murder of his girlfriend, bringing justice in a case that sent shock waves through the local community. According to Northern Natal News, Innocent Fanyane Dubazane was found guilty of killing 45-year-old Nonsikelelo Nqobile Xaba, whose body was discovered in a ditch in the C-section area of Mondlo on February 8, 2024. Xaba, who was well known in the community, was found wrapped in a duvet cover and shade netting. She had suffered severe blunt force trauma and was fully clothed but barefoot. Although the couple had been in a romantic relationship, they had kept it hidden from their families. It later emerged that Xaba was last seen alive at Dubazane's home. During police questioning, Dubazane made admissions that linked him to the murder. Investigators discovered the victim's blood-stained shoes hidden in a plastic bag in an outside toilet at Dubazane's home. Drag marks at the back of the house led to the spot where her body was found. Police confirmed that the duvet and netting used to conceal the body came from Dubazane's home and that of his brother, who shared the property. The state, represented by prosecutor Andre Symington, presented compelling evidence from community witnesses, family members and police officers. Witnesses identified the victim's shoes and the duvet as belonging to her and the accused respectively. A relative also testified to having seen the couple together before the murder. Symington highlighted the frequency of gender-based violence in South Africa during sentencing arguments, stressing that Dubazane showed no remorse and that the attack was both brutal and calculated. The court found Dubazane and the deceased had been in a domestic relationship and ruled there were no compelling reasons to deviate from the minimum prescribed sentence for femicide. As a result, Dubazane was sentenced to life imprisonment and declared unfit to possess a firearm. In response to the outcome, NPA regional spokesperson Natasha Ramkisson-Kara reaffirmed the organisation's commitment to fighting gender-based violence and femicide. 'There is no place in our society for perpetrators of such cruelty. We will continue to prioritise these cases and ensure that justice is delivered swiftly and decisively,' she said. The sentence brings closure to a case that deeply affected the Mondlo community and stands as a strong warning to perpetrators of violence against women. UIF fraud case: More suspects to appear in Bloemfontein court According to the NPA, more suspects are expected to appear in a Bloemfontein court today in connection with a UIF fraud and corruption scheme, reports Bloemfontein Courant. 'Additional suspects are expected to be added to the case and will appear in court on July 9,' said NPA spokesperson Mojalefa Senokoatsane. Senokoatsane revealed a syndicate was uncovered that allegedly recruited individuals and used their personal information to submit fraudulent UIF claims. 'These claims were registered using legitimate company names – without the knowledge of the companies involved – and were processed as if they were valid. The fraudulently obtained funds were then allegedly shared among recruiters, the implicated government official and, in some cases, the identity holders themselves,' he added. With the Department of Labour having suffered a financial loss of over R1.5m, the accused face various charges including fraud, corruption and money laundering. Sixteen suspects who appeared in court earlier this week were granted bail. All 16 appeared in the Bloemfontein Magistrate's Court on Monday for their initial appearance. Bail was granted as follows: Kelopa Bethuel Mahlatsi – R10 000; Kamoho Letuka – R3 000; Bongani Radebe – R2 000; and the remaining 13 accused – R1 000 each, Mojalefa added.
