Place details of Bhoodan lands before court: HC

The Hindu4 days ago
The Telangana High Court on Wednesday instructed the Bhoodan Board and the State government to place before it the details of lands donated by different persons during Bhoodan movement.
Hearing two separate pleas seeking an inquiry into status of Bhoodan lands in Nagaram village of Maheshwaram mandal in Ranga Reddy, Justice K. Lakshman passed the interim direction. He also wanted the Bhoodan Board and the government to furnish details of the lands redistributed to the landless and the current status of all land parcels held by the Board.
Additional Advocate General T. Rajanikanth Reddy said the government was ready to constitute a commission of inquiry if the court ordered for probe into all the lands belonging to Bhoodan Board and issues related to it. However, the government was opposing setting up such an inquiry commission in the present case as the petitioners were espousing a private cause, he said.
The petitioners contended that some persons got ownership of the lands held by Bhoodan Board transferred in conspiracy with the Revenue and other department officials. According to them, parts of these lands under specific survey numbers were sold off by middlemen to scores of IAS and IPS officers. Some of them are retired now.
Earlier, a single judge of the HC directed the government to keep certain lands specified by one of the petitioners under prohibited list till adjudication of the plea. The serving and retired officials, who were made respondents in this writ petition, moved the division bench headed by the then Acting Chief Justice for vacation of the restraint order.
The bench, however, directed them to approach the single judge bench for modification of the order that was passed. The officers contended that the issues raised over transfer of Bhoodan lands belonged to four different survey numbers. They maintained that the lands they had purchased were not at all connected to Bhoodan Board.
The counsel for the petitioner who sought constitution of the enquiry commission did not turn up for the hearing on Wednesday and sought time for presentation of arguments. The counsel for the senior officials argued that the petitioners moved the HC without any locus standi. The courts cannot pass orders to put the lands in prohibited list without the petitioners presenting proof of ownership of the land under dispute, he said.
The pleas would be heard again on Thursday.

HC overturns MPCA's dissolution of Jabalpur cricket assn

Bhopal/Jabalpur: The MP high court has set aside an order of the MP Cricket Association (MPCA) dissolving the executive of the Jabalpur District Cricket Association (JDCA) and recognising a new body in its place. A division bench of chief justice Sanjeev Sachdeva and justice Vinay Saraf also quashed the MPCA's directive blocking the JDCA's restoration, but allowed intervener in the case Surendra Verma the liberty to initiate fresh proceedings against the JDCA. Senior lawyers Shashank Shekhar and Samresh Katare, while appearing on behalf of JDCA, said the district cricket association was constituted in 1999. Surendra Verma was its joint secretary till 2006. In 2006, a new executive of JDCA came into existence. Registrar, firms & societies asked for information on the annual general meeting of the body. Since the previous executive had not furnished information for 2004 to 2006, the new GDCA executive failed to provide complete information sought by the registrar. The registrar subsequently dissolved JDCA in 2013. After all the desired information was provided to the office of the registrar, the JDCA executive was restored in 2014. Verma had moved the court challenging the registrar's order to restore the JDCA executive. A single-judge bench had quashed the order of the registrar on the ground that information was provided to the registrar by the JDCA late. The JDCA had challenged the order before a HC division bench, which overturned the order of the HC single bench. Allahabad HC directs Ghaziabad development body to maintain status quo on demolition notice

PRAYARGRAJ: The Allahabad High Court has directed that status quo be maintained with regards to the demolition notices issued by Ghaziabad Development Authority ( GDA ) over alleged illegal properties built on public land. Hearing a writ petition, a division bench comprising Justice Mahesh Chandra Tripathi and Justice Prashant Kumar granted time to the district administration and GDA to place on record how they intend to rehabilitate the old inhabitants of the properties. The court also restrained the petitioners from creating any third-party interests or undertaking any development on the disputed property. The court also observed, "In the facts and circumstances of the case, we also find that it is not in dispute that the petitioners have been occupying the place for the last 40-50 years." "At this stage, we find that some indulgence and reprieve is to be accorded to the inhabitants who belong to the weaker sections of society and we further direct the authorities to ensure the formulation and implementation of a rehabilitation scheme for such persons," it said. The bench said the rehabilitation scheme shall be provided by the district administration and the GDA in the next hearing. The next hearing is listed for August 22. The petitioners filed the present writ petition for quashing the demolition notice dated June 16, 2025, issued by the GDA under section 26-A of the UP Urban Planning and Development Act, 1973. The GDA initially issued notice to 172 illegal occupants of public land on September 6, 2024, which is earmarked in the master plan. Consequently, 89 persons filed their objections which were considered and the impugned order (order under challenge) was passed. During the course of hearing, the counsel for the petitioner submitted that the petitioners are old inhabitants and in absence of any rehabilitation scheme as per the law, the old inhabitants, who are occupying small pieces of land for their shelter and admittedly belong to the lower sections of society, will suffer irreparable loss, if uprooted. After hearing both sides, the court in its order dated July 31 passed the above directives and observed, "It is informed that in response to the earlier court's order, till date the GDA has not taken any remedial measures to rehabilitate the persons who were in illegal occupation for the last 40 years."

A software engineer, accused of raping a woman on a false pretext of marriage, has moved the Supreme Court challenging an order of the Rajasthan High Court which directed his wife to be present in the country if he wished to travel abroad for a job. The plea, filed by advocate Ashwani Dubey, called the HC order erroneous and a violation of Article 21.(HT_PRINT) The petitioner in his plea said the high court, in a clear violation of the "procedural impropriety" and without hearing or impleading his wife, who is currently employed in the US, and ignoring that she is not a part of the criminal case, directed her to remain in India. The petition, filed through advocate Ashwani Dubey, submitted that the said impugned direction passed by the high court was "erroneous" and violative of the fundamental rights under Article 21 of the Constitution. "He will be going for a specific period and he undertakes a specific oath before this Court that he shall make himself available for trial as and when directed, therefore, there is no question of delay in trial and also there is no question of his absconding," the plea said. The engineer was booked for rape at the Christianganj Police Station of Ajmer.
