SIS Forum Appeal Not Concerned With Substantive Beliefs, Doctrine Of Islamic Faith, Says Federal Court

Barnama21-06-2025
PUTRAJAYA, June 21 (Bernama) — The appeal by Sisters in Islam (SIS) Forum (Malaysia) does not concern the substantive beliefs in the religion of Islam, its mandates or doctrines relating to the Islamic faith but relates to the exercise of legal powers by certain state authorities, says the Federal Court in its judgment.
Chief Justice Tun Tengku Maimun Tuan Mat said the challenge only concerned the review of the Selangor State Fatwa Committee, the Selangor Islamic Religious Council (MAIS) and the Selangor government's exercise of certain powers under the law, which is distinct from the substance and contents of their decisions.
'While it concerns a certain fatwa (religious edict), the case has neither to do with the substantive beliefs held in the religion of Islam nor does it have anything to do with the administration of the substantive aspects of the religion of Islam,' she said in the 40-page majority judgment.
The top judge said in all civilised democracies with independent judiciaries, it is routine for the executive's decisions to be subjected to judicial review and in most cases, the subject matter of the exercise of discretion in the plaint is not the main issue rather the manner in which the decision was made.
On Thursday, the Federal Court bench, in a 3-1 majority ruling, held that the 2014 fatwa issued by the Selangor State Fatwa Committee and gazetted by the Selangor state government is valid, but only insofar as it applies to individuals, not companies.
The court ruled that a fatwa cannot be imposed on an organisation like SIS Forum as it is not capable of professing a religion.
The ruling partially allowed the appeal by SIS Forum and its co-founder Zainah Mahfoozah Anwar to quash the 2014 fatwa, which had declared the group as deviating from Islamic teachings.
In the written judgment released on the judiciary's website, Justice Tengku Maimun explained that the Selangor state government and the religious bodies are part of the executive branch and are empowered by the Federal Constitution and laws passed by the Selangor State Legislative Assembly (SLA).
'The fact that they deal with matters pertaining to Islamic faith, dogma and doctrine – are beside the point and these matters are, in any event, not within our purview (of the Civil Court),' she said.

No rush to fill ministerial posts

On duty: Johari (left) and Amir Hamzah covering roles in meantime. PUTRAJAYA: The government is not short of replacement candidates to take over vacant ministerial posts, says Datuk Seri Anwar Ibrahim. The Prime Minister said permanent appointments must be made in accordance with the Federal Constitution. 'There is no need to rush. Some people are saying that the government does not have (credible) candidates to appoint, so it has to rely on acting ministers. That's not true. 'They (Amir Hamzah and Johari) are simply covering these roles until new appointments are made. 'It's unfortunate when opposition MPs can't understand that,' he told reporters after performing Friday prayers at Surau Ar-Rahim here yesterday, Bernama reported. Ministers Datuk Seri Johari Abdul Ghani (pic) and Datuk Seri Amir Hamzah Azizan have been appointed to perform the duties and functions of Natural Resources and Environmental Sustainability Ministry and Economy Ministry, respectively, This follows the resignations of Nik Nazmi Nik Ahmad and Datuk Seri Rafizi Ramli after both of them failed to retain their party positions in the PKR elections in May. Amir Hamzah has been acting Economy Minister since June 27 while Johari took over the duties and functions of the Natural Resources and Environmental Sustainability Minister from yesterday. Chief Secretary to the Government Tan Sri Shamsul Azri Abu Bakar, who also serves as the Cabinet secretary, said Johari's appointment was conveyed during the Cabinet meeting on July 9. Anwar urged all parties to give Amir Hamzah and Johari space to carry out their responsibilities effectively. On a separate matter, the Prime Minister reiterated that he has never interfered in the affairs of the judiciary, including the appointment of judges or any court decisions. 'The process of judicial appointments must be carried out in accordance with the provisions of the Constitution and established jurisdiction. 'For more than two and a half years (as Prime Minister), I have never interfered. What is important is that we adhere to the process,' he said. Commenting on the Malaysian Bar's intention to organise a peaceful assembly and march on July 14, Anwar said it was the decision of the organisers. Anwar also said the issue of judicial independence has already been explained by the Attorney General (Tan Sri Mohd Dusuki Mokhtar), Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said and the Yang di-Pertuan Agong. 'If there were proposals to change the mechanism for judicial appointments, it would need to be done through amendments to the Constitution. 'For this area (judicial appointments), we follow the process that has been practised,' he said. Responding to Umno's statement urging for the implementation of the house arrest order for former prime minister Datuk Seri Najib Razak, Anwar said the government respects the views of all parties regarding the royal addendum issue. 'However, the document is subject to judicial process and it is still under court proceedings. 'This additional document is a court matter now, no issue. Let the court handle it. 'Everyone is entitled to their opinion. We respect that but (we) must follow due process,' he added. Yesterday, Umno secretary-general Datuk Dr Asyraf Wajdi Dusuki said the request followed confirmation of the additional document's existence by the Attorney General. Last Wednesday, the Attorney General's Chambers (AGC) did not dispute the existence of the additional document which would allow Najib to serve the remainder of his jail term under house arrest. However, the AGC contested the procedure for submitting the document as new evidence in Najib's judicial review application at the High Court.

In addition, Court of Appeal president Abang Iskandar Abang Hashim also retired on July 3, with no replacement named. Federal Court judge Zabariah Yusof has temporarily assumed the role. Bringing registration services to doorsteps

Kota Kemuning assemblyman Preakas Sampunathan (left) attends to a senior citizen applying for adoption at the MyIdentiti programme in Kota Kemuning. — IZZRAFIQ ALIAS/The Star FOR decades, a child of a Malaysian woman would not be automatically recognised as a citizen if the father was a foreigner. But, with landmark amendments to the Federal Constitution last year, the rights of these mothers and their children have finally been acknowledged. Now, such children under 18 can apply for citizenship under Article 15(2) of the Federal Constitution. This change has given hope to countless families. This new legal avenue is supported by a government initiative called the myIdentiti programme, which brings registration services to residents' doorsteps. It offered services for birth registration, MyKad renewals, Disabled Person (OKU) card and document corrections. Kota Kemuning assemblyman Preakas Sampunathan said myIdentiti ensures government services are more accessible, especially for vulnerable groups such as the elderly, low-income families and those in remote areas. 'The myIdentiti programme is proof of our continuous efforts to ensure the people can access basic services without difficulty,' said Preakas during the event, which was held at Dewan MBSA in Kemuning Utama, Shah Alam. The programme was timely for Malaysian mothers hoping to register their overseas-born children as it removes logistical obstacles and provides assistance to families navigating the amended citizenship procedures. 'We want every Malaysian-born child to be registered and every individual to have a valid personal identification document,' added Preakas. Queues formed early at the hall as families turned up with documents in hand, eager to secure identification papers that would open doors to education, healthcare and legal protection. 'Not every problem can be solved today. Even if they are eligible, we still need to follow the rules. 'If they are not entitled, we will tell them. They need to be clear on the processes,' said Preakas. Among those present was an Indonesian woman, who declined to be named, and her twin teenage daughters. She was there with her Malaysian husband to apply for her daughters' Malaysian citizenship. Holding back tears, she said her husband has late stage cancer and expressed the hope that they will be successful this time without further setbacks. A Malaysian woman, who wanted to be known as Sherry, was also there to expedite the adoption process of her 14-year-old daughter. 'Today, I hope to get some clarity from the authorities because I have been through this process many times with no success,' she said. Officials at the event guided attendees through the required paperwork, explaining procedures and helping to verify documents on the spot. The JPN van was also at the premises to help people renew or replace their MyKad. Regarding floods in Kota Kemuning, Preakas said he was disappointed at the lack of attention given to his constituency. 'They (state and federal governments) know Kota Kemuning is a flood-prone area, but every time we ask, they cite a lack of funds. 'I wrote to the Works Ministry seeking funds as the drains in Kota Kemuning need to undergo maintenance and upgrades. 'Until today, the JKR (Public Works Department) Selangor director has not got in touch with me. 'Climate change is happening; we have to be proactive to ensure people are safe and do not have to suffer unnecessarily,' he said.
