Former attorney swindled clients out of R4.1m in accident fund payouts
A Mpumalanga attorney has been found guilty of theft after stealing Road Accident Fund payouts from her clients.
On Thursday, the Mpumalanga specialised commercial crimes' court sitting in Middelburg convicted the former attorney, Mantladi Jo-Anne Mmela, 43, on four counts of theft.
According to NPA spokesperson Monica Nyuswa, the woman was practising as a sole practitioner for Mmela Attorneys when the crimes were committed between June 2019 and March 2022.
'The accused lodged claims against the Road Accident Fund (RAF) on behalf of her clients which were subsequently paid out. The money was paid by the RAF into the trust account of Mmela Incorporated Attorneys for the benefit of her clients, totalling more than R4.1m,' Nyuswa said.
However, it appears Mmela never paid the money to her clients.
Nyuswa said one of the victims reported that Mmela had failed to pay her. The investigation ensued and led to Mmela's arrest in 2022.
She was granted bail and absconded, which resulted in a warrant of arrest being issued. Mmela was rearrested in February 2024 and has been in custody since.
'During the trial, the accused pleaded not guilty and senior state advocate Henry Nxumalo presented evidence from the witnesses. The accused was convicted on four counts of theft, and the matter was postponed to August 21 2025 for sentencing in the same court,' Nyuswa said.
She said the NPA welcomes the conviction as a significant step in the fight against theft of trust monies by attorneys.
'The NPA remains committed to fighting financial crimes in ensuring that those who deprive claimants of their monies are prosecuted,' she said.

Young people are often injured or killed when not behind the wheel, as pedestrians (38%) or passengers (35%). From 2019 to 2023, 24,098 young people were tragically killed on South African roads in the 15 - 34 age group. 'The high number of young people injured and killed on our roads is deeply troubling. Human error is a major factor, and South Africans, especially the youth, must reflect on their behaviour and make better choices.'

Zimbabwean man gets 50 years for armed robbery, kidnapping
The Booysens Magistrate's Court has sentenced 30-year-old Zimbabwean national Nxinxi Tshabalala to 50 years in prison for hijacking, robbery, kidnapping, and unlawful possession of a firearm and ammunition. The Booysens Magistrates' Court convicted Tshabalala on Friday, 27 June, after he terrorised a family during a home invasion in Johannesburg. The court heard that Tshabalala entered the home while the complainant's wife, 16-year-old son, 12-year-old son, and four-year-old daughter were inside. He demanded money while pointing a firearm at the youngest child. After Tshabalala fled with four stolen cellphones, the complainant used a nearby shop's services to trace one of the phones. Police assisted in locating the suspect at an address where they recovered the stolen devices and subsequently arrested him. During sentencing, regional court prosecutor Licel Hlungwane called for a strong punishment to deter similar violent crimes, while the defence pleaded for leniency, citing Tshabalala's circumstances. However, the court rejected the plea and handed down a cumulative sentence of 50 years. 20 years for robbery, 10 years for kidnapping. 15 years for possession of a firearm, and five years for possession of ammunition. National Prosecuting Authority (NPA) spokesperson Phindi Mjonondwane welcomed the outcome and praised the work of the investigating team and the prosecution.
