
Chidambaram slams new criminal laws as ‘wasteful cut-and-paste', says they've created confusion

His remarks came a day after Union Home Minister
Amit Shah
termed the enactment of the three new criminal laws as the biggest reform in independent India and said they will make the judicial process process not only affordable and accessible but also simpler, time-bound and transparent.

Shah stressed that the Narendra Modi government framed the new laws --
Bharatiya Nyaya Sanhita
(BNS), the
Bharatiya Nagarik Suraksha Sanhita
(BNSS) and the
Bharatiya Sakshya Adhiniyam
(BSA) -- to ensure that all rights of citizens are protected and no criminal goes unpunished.
Hitting out at the government, Chidambaram said it has claimed repeatedly that the three Criminal Law Bills, now Acts, are the biggest reforms since Independence, but "nothing can be farther from the truth".

"I had sent a dissent note to the Parliamentary Standing Committee that examined the three Bills, and it is part of the Report tabled in Parliament," the former home minister said in X.
"In my dissent note, after comparing section by section the IPC, CrPC and Indian Evidence Act with the corresponding new Bill, I had asserted that: 90-95% of the IPC, 95% of the CrPC and 99% of the Evidence Act, have been cut and pasted in the corresponding new Bill," he said.
Chidambaram's assertion in his dissent note was not challenged in Parliament or elsewhere.
"I maintain that the new Bills, now Acts, are overwhelmingly a 'cut and paste' exercise, with a few new provisions added -- some acceptable and some not acceptable," he said.
"The whole exercise was a waste and has only created confusion in the the administration of justice among judges, lawyers and the police," Chidambaram said.
Addressing an event marking one year of the rolling out of the three criminal laws, the BNS, BNSS and the BSA, Shah had said since all processes are online, nothing will be overlooked and justice will be delivered on time.
"These laws are going to transform the criminal justice system in the country significantly. I assure all the citizens of India that it will take a maximum of three years for the full implementation of the new laws. I can also confidently say that anyone can get justice up to the Supreme Court within three years of filing an FIR," he had said.
The BNS, BNSS and the BSA replaced the colonial-era
Indian Penal Code
, the
Code of Criminal Procedure
and the Indian Evidence Act of 1872, respectively. The new laws came into effect on July 1, 2024.

Sanquelim man held for Rs 3.3L delivery fraud
Bicholim: Bicholim police arrested Sanquelim resident and native of Kolhapur, Maharashtra, Pankaj Prakash Gurav (24) on Sunday for allegedly misappropriating Rs. 3.3 lakh to be paid to Instakart Services Private Limited, Sanquelim. Man held for cheating US & NZ job-seekers of 80L
Mumbai: A conman, under the pretext of availing several aspirants seeking overseas jobs and permanent visas for the USA and New Zealand, duped them of Rs 80 lakh. To win their trust, the accused even issued fake foreign visas and air tickets. Most of those duped were from Gujarat. The accused, Mohammed Shafiq Khan (42), was earlier arrested by Thane police and Haryana police in a similar case. Khan was taken into custody on Tuesday from his Mira Road home. Crime branch Unit 2 said he had promised job aspirants lucrative employment opportunities abroad and furnished them with fake visas, air tickets, and offer letters. Police are now looking for his accomplice, Zarina, who used to run an office in Mira Road. They alerted their representative who lodged a complaint. According to the police, Khan and his accomplice would periodically send forged documents and make up excuses to delay the job-seekers' departure. Based on the complaint, a case was registered at Agripada police station under BNS sections of cheating, forgery, and breach of trust. The matter was transferred to the crime branch.

Health dept distances itself from rape accused
Gaya: The health department has clarified that the ambulance driver and technician accused of raping a home guard job aspirant in Gaya are not its regular employees but were hired through a private agency. The alleged incident took place on July 24 when the woman was raped inside a slow-moving ambulance between the Bihar Military Police (BMP) ground and Anugrah Narayan Magadh Medical College Hospital. Speaking to reporters, Gaya civil surgeon Dr Raja Ram Prasad said, "Both the driver and the technician are not regular employees of the health department. Their recruitment was done by a private agency engaged at the state level. Therefore, the question of departmental action against them does not arise." When asked whether background checks had been conducted before the duo were deployed, the civil surgeon said, "It is for the agency to explain." On the medical report of the survivor, Bodh Gaya SDPO Saurav Jaiswal said it was expected to be made available soon.
