Bail plea of Elgar Parishad case accused to take care of ailing father rejected

India Today4 days ago
A special NIA court in Mumbai has rejected the interim bail plea of Ramesh Murlidhar Gaichor, an accused in the Elgar Parishad case, who had sought a two-week release to care for his ailing father. The court ruled that the application lacked genuine urgency and cited contradictions in the plea as grounds for rejection.Gaichor had approached the special court requesting temporary bail, stating that his elderly father's health was deteriorating and that he had been recently hospitalized. His counsel, advocate Deepa Punjani, submitted medical reports mentioning symptoms such as breathlessness, weakness, chest pain, loss of appetite, and hyperacidity.advertisementHowever, Special Public Prosecutor Prakash Shetty, representing the National Investigation Agency (NIA), opposed the application, arguing that Gaichor is a "habitual and repeat offender" facing serious charges. He maintained that the grounds cited did not justify interim bail.
Special Judge CS Baviskar, after examining the medical documents, stated that the reported symptoms were common among many senior citizens and even younger individuals, and did not establish a critical condition requiring the accused's presence. The court also pointed out that updated information from the hospital revealed that Gaichor's father had been discharged and was no longer in a serious condition. "Nothing serious is observed by the medical officer concerned," the judge noted.Furthermore, the court highlighted a major contradiction in Gaichor's application. While he claimed no bail plea was pending in any court, his main bail application is currently before the Bombay High Court. The judge remarked that this inconsistency was significant enough to warrant dismissal of the plea. "This application is filed just for the sake of filing, just to take a chance to persuade this Court on emotional ground and nothing else," the order read.Gaichor is amongst several accused in the Elgar Parishad case, where the NIA alleges links to banned Maoist organisations and anti-state activities.- Ends

NIA gets custody of two Pahalgam terror attack accused for 10 more days

A special court in Jammu on Monday granted the National Investigation Agency (NIA) 10 more days' remand of the two accused arrested for allegedly harbouring Pakistani terrorists involved in the deadly Pahalgam terror attack in April, officials said. NIA said the accused disclosed the identities of the three armed terrorists involved in the attack.(Representative Image) After the expiry of the earlier 10-day remand, Parvaiz Ahmad Jothar and Bashir Ahmad Jothar were produced before the Special NIA Court, which extended their remand to enable the NIA to carry out its investigation in the case, the officials said. The two were arrested on June 22 and were presented in a local court in Jammu the next day. The court initially granted the NIA five days' remand before the case was shifted to the special court. According to the NIA, the accused disclosed the identities of the three armed terrorists involved in the attack and confirmed that they were Pakistani nationals affiliated with the banned terrorist outfit Lashkar-e-Taiba (LeT). The federal agency alleged that Parvaiz and Bashir had knowingly harboured the terrorists at a seasonal 'dhok' (hut) in Hill Park in Pahalgam before the April 22 attack that left 26 people, mostly tourists, dead and 16 others injured. The two provided food, shelter and logistical support to the terrorists, who, on the fateful afternoon, selectively targeted and killed tourists based on their religious identity, making it one of the most gruesome terrorist attacks in recent memory, the NIA said, as it continues its probe into the terror network behind the massacre in Kashmir's tourism hub.

Security forces recover 16 IEDs planted by Maoists; diffuse them on the spot in Jharkhand

'During the combing operation in the Kotsona and Langi hill areas, the security forces recovered 16 IEDs, each weighing approximately 2 kg, planted by Maoist cadres to target security personnel and hinder ongoing operations,' stated The official communique was released by the Chaibasa police. The bomb disposal squad safely defused all the explosives on the spot, eliminating any potential risk to civilian lives or security forces, it said. The search operation continues. Notably, Maoists are now restricted only to the Saranda jungles in Jharkhand as they have been wiped out from other pockets of the state. According to an estimate, around 85 - 90 Maoists are supposed to be hiding in the Saranda jungles, where they have planted thousands of IEDs, which have become a challenge for the security forces. Even though Maoists have planted IEDs in the entire area, forces are advancing slowly into the jungles with full determination and have established several temporary security camps in their core areas, he said. The state police have launched a joint operation in Kolhan jungles in November 2022 after a tip-off that some of the senior Maoist leaders, including Misir Besra and Patiram Majhi alias Anal Da, are hiding in that forest stretch, which is said to be strategically important.
