Bail plea of Elgar Parishad case accused to take care of ailing father rejected
Special Judge CS Baviskar, after examining the medical documents, stated that the reported symptoms were common among many senior citizens and even younger individuals, and did not establish a critical condition requiring the accused's presence. The court also pointed out that updated information from the hospital revealed that Gaichor's father had been discharged and was no longer in a serious condition. "Nothing serious is observed by the medical officer concerned," the judge noted.Furthermore, the court highlighted a major contradiction in Gaichor's application. While he claimed no bail plea was pending in any court, his main bail application is currently before the Bombay High Court. The judge remarked that this inconsistency was significant enough to warrant dismissal of the plea. "This application is filed just for the sake of filing, just to take a chance to persuade this Court on emotional ground and nothing else," the order read.Gaichor is amongst several accused in the Elgar Parishad case, where the NIA alleges links to banned Maoist organisations and anti-state activities.- Ends

Three Maoists surrender
Phulbani: Three Maoists, including two women, hailing from Chhattisgarh, on Monday surrendered before security forces in Kandhamal district, police said. They surrendered here before senior Odisha Police and CRPF officers, including IGP, Southern Range, Niti Shekhar, Kandhamal SP and CRPF's 127 battalion commandant. 'They surrendered as they were disillusioned because of the intensified and sustained combing operations, and also due to the attractive surrender policy of the government,' Kandhamal SP Harish B C said. 'We have intensified combing operations in Maoist-affected areas to curb LWE activities in Kandhamal,' Harish added. The surrendered cadres were involved in several violent incidents in both Odisha and Chhattisgarh. Bail to NDFB ex-cadres due to violation of arrest norms
Guwahati: A lower court in Assam's Baksa district granted bail to 10 former cadres of the now-disbanded National Democratic Front of Bodoland (NDFB) stating an error and violation of the statutory provision of law at the time of the arrest of the accused. The accused were arrested for allegedly killing at least 39 civilians in Khagrabari and Narsingbari villages under the jurisdiction of Gobarbandha police station in Baksa in 2014. The case was registered at the Gobardhan police station initially and was transferred to the NIA later. In July 2015, the NIA filed chargesheets against the 10 accused: Bikunash Narzary alias N Birlangbari alias Lengra, Swmkhwr Basumatary alias B Simang, Lankeswar Boro alias B Laswi alias Langtha Boro alias Lonkeswar Boro, Santosh Boro alias Santosh Kherkatary alias K Simang alias Santosh Fiswa, Binod Mushahary alias M Biban alias Batha alias Binod Muchahary, Surjoy Goyari alias G Sijulang, Rahul Islary alias I Ramwila, Enon Borgoyary alias Erkhang, Joleswar Basumatary alias B Jakrup, and Anon Brahma alias B Aorai. Sessions Judge, Baksa, Mushalpur, S Bhuyan was hearing the bail pleas of the accused. Counsel for the accused, advocate Kankan Kalita, submitted before the judge that the accused have been languishing in judicial custody for the last 10 years and there is a long delay in the trial. Moreover, the advocate submitted that 79 out of the 143 listed witnesses in the charge-sheet have been examined in the last 10 years, and they have not implicated the accused persons in their evidence. This is a constitutional right of the accused persons to know about the ground and reason for their arrest, and hence, the arrest of the accused persons was illegal. Meanwhile, public prosecutor Ranjit Kumar Chetry submitted in writing that the investigation of the case has been completed and, in connection with this case, sufficient witnesses have been examined in the Court of Special Judge (NIA), Assam in Guwahati. He further submitted that the banned NDFB has come into the mainstream by signing an agreement with the Government of India and the state govt on Jan 27, 2020, and NDFB is no longer a banned organisation at present. He added that most of the cases of the NDFB members pending in Mushalpur district court have been withdrawn by the state govt. After hearing the parties in the case, the judge stated, "It appears that there is an error and violation of the statutory provision of law. When the accused persons were arrested, their ground of arrest was not disclosed to them, which is the fundamental right of the accused persons granted to them by the Constitution of India."

They will be suitably rehabilitated under the surrender rehabilitation scheme of the govt, he said. Sekhar appealed to other ultras to shun violence and join the mainstream.
