Delhi HC reduces convict's sentence in rape case for ‘good conduct'

The Delhi High Court has reduced the 30-year sentence of a rape case convict to 20 years.
The court modified the jail term after it came on record that the convict was working as a safai sahayak (helper of cleaning staff) in jail and his overall conduct was satisfactory. The court further observed that he had been in custody since his arrest on April 6, 2015.
The court upheld his punishment under Sections 3 and 4 (penetrative sexual assault) of the POCSO Act aside from Sections 376(2)(i) (committing rape on a woman when she is under 16 years of age) and (n) (committing rape repeatedly on the same woman), 450 (house-trespass), 506 (criminal intimidation) of the IPC.
The convict had appealed against the trial court's 2013 verdict holding him guilty for the rape of a 12-year-old girl. The minor and her mother on April 4, 2015 went to the police and alleged the man, who was their neighbour, had repeatedly raped her.
The girl said in December 2014 when her family members were not at home, he came over to her house, offered food and showed her obscene photos on his phone and sexually assaulted her.
The matter unfolded after her mother took her to a doctor after the minor complained of stomach ache.
She was found pregnant and doctors advised her to undergo medically termination of pregnancy following which DNA samples were preserved and sent to the forensic science laboratory for analysis.
The man had claimed 'discrepancies in the girl's testimony' making it unreliable.

Three days after a 19-year-old migrant worker was lynched by locals in Arunachal Pradesh's Roing town over allegations of sexually assaulting multiple children in the school where he worked, police are yet to make any arrests. The deceased Rizaul Karim, originally from Assam's Bongaigaon district, had succumbed to his injuries after being assaulted by a mob in police presence in different locations on July 11. Two cases had been registered in Roing police station over this incident: one pertaining to criminal conspiracy, rioting, causing grievous harm and the Prevention of Damage to Property Act; another under multiple sections, including murder and mob lynching. Arunachal IGP (Law & Order) Chukhu Apa said that the police were moving with caution on the case, saying that 'it is a sensitive matter'. 'As of now, there are no arrests. We are examining video footage and collecting evidence. After we are done, we will definitely take action and make arrests. We need some time since this is a sensitive matter in which so many minor children are affected,' he said. IGP Apa said that the deceased worked as a labourer in the premises of a residential school. 'Over a period of time, he had systematically been sexually assaulting minor girls in the school. Based on information they had received, a group of parents arrived at the school on July 10 and began questioning who were there. There was a big commotion but the police intervened and the situation was brought under control. However, the main accused had run away,' said Apa. That night, an FIR had been registered in Roing police station against the deceased under the POCSO Act and sections of the BNS pertaining to rape and sexual harassment. Apa said that while police launched a manhunt for Karim, a group of locals, including parents, also began looking for him. A 'significant number' of girls aged between ages 6 and 9 had allegedly been sexually assaulted in the school hostel and had undergone medical examinations, he said. 'They found him in the suburbs of Roing town the next morning, and began assaulting him. When police received information, they rushed there, rescued him and took him for emergency care to a district hospital. But the mob followed them there, so he was then taken to Roing police station, but they followed there too. As word spread, more and more people joined in, and it was a crowd of over 200-300 people who overpowered the police and dragged him out of the police station to assault him. Police were outnumbered and did not have enough time to act because everything happened very quickly,' Apa said. He said Karim succumbed to his injuries in the district hospital, where he was taken again for medical treatment in the afternoon after this incident. The same day, the Lower Dibang Valley district administration also issued an order to close down the school indefinitely, citing 'untoward incident of molestation of minor girls in girls' hostel'. The district authorities have advised parents to withdraw their children from the school and send them to the nearby ones.

The court underlined multiple factors that convinced it to deny bail to Verma, such as the complexity and expanse of the economic crime alleged against him, the continuance of collection of investments in the business of cryptocurrency by Verma from credulous investors, "swayed by the mirage of 20% to 30% profit assured by the accused/applicant, despite the de-recognition of cryptocurrency; blatant misuse of the mediation system by the accused/applicant by alluring execution of mediation settlements and not complying with the same despite adjournments across more than two years before the predecessor benches. " The court also noted that the accused was a "serious flight risk" and the probe against him is still on, with more and more victims coming to light.

Ahmedabad: The Gujarat high court has dropped the charge of culpable homicide for the manager of the Amos Corporation, from where methyl alcohol was allegedly stolen and used to make hooch that claimed 42 lives near Dhandhuka and Barwala in 2022. Rajendra Dasadiya, the manager of the company, was arraigned in the case during the investigation when the prime accused, Jayesh Khavadiya, admitted to bringing 600 litres of methyl alcohol from the company. The manager, along with four directors of the company — Samir Patel, Pankaj Patel, Chandu Patel, and Ranjit Choksi — were charged with culpable homicide not amounting to murder. In Jan, the HC discharged the directors from Section 304 of IPC pertaining to culpable homicide by quashing a trial court's refusal to discharge them in the case. However, it was argued on behalf of Dasadiya that his involvement was limited to procedural roles such as internal communication and documentation. After hearing the case, Justice L S Pirzada said that there is no evidence that Dasadiya had any knowledge about Khavadiya stealing methyl alcohol and seeking other co-accused persons. "There is no material available on record for framing the charge against the present applicant for an offence punishable under Section 304 of the IPC. As Section 304 of the IPC is not being attracted from the material produced with the chargesheet papers, Section 308 of the IPC cannot be invoked as it pertains to the attempt to commit culpable homicide.
