Excess fare: warrants issued against MD of TNSTC, Coimbatore, and RTO, Coimbatore North
An execution petition filed by K. Kathirmathiyon, secretary, Coimbatore Consumer Cause, during November 2023, cited the dismissal of an appeal made against the order by the State Consumer Commission and also a review petition in 2023.
During 2018, three years after he had filed a case before the District Consumer Disputes Redressal Forum, Coimbatore, the complainant was refunded the excess fare of ₹6 charged from him for to and fro travel between Vadavalli and Railway Station, along with ₹6,500 towards legal expenses.
The petitioner had called for deposit of the excess fare collected during the three-year period in the Chief Minister Relief Fund.
The TNSTC, Coimbatore, and the Regional Transport Officer, Coimbatore North, had paid the costs and the TNSTC, Coimbatore, had also deposited the fine of ₹ 10,000 along with interest at 9% for three years amounting to ₹ 7,532 to the Chief Minister's Public Relief Fund.
A copy of the order was sent to the Chief Secretary and to the Transport Commissioner of Tamilnadu Government to stop such excess collection.
However, the TNSTC had claimed that the details of collection from 2015 to 2018 had been destroyed, and, hence, could not file the statement of excess collection.
The Hon'ble Commission had, in its verdict cited the Government Rule mandating all the State Transport Corporations to preserve money value documents at least for a minimum period of 8 years as stipulated in the Companies Act 1956. The TNSTC, Coimbatore, had violated the Rule and the order of this Commission, Mr. Kathirmathiyon had contended in his executive petition.
The bailable warrants were issued under Section 72 of Consumer Protection Act 2019.

The PIL filed by Ashwini Kumar Upadhyay , a practising advocate, has sought a direction to the Centre and states to mandate the display of essential seller information, including registration, address, phone number and number of employees at their entry gates on a display board visible to an ordinary person. He also urged the court to order that that every consumer has right to know not only about the quality, quantity, potency, purity, standard, manufacturing date, expiry date and various certification of good and products, but also about the details of the shop owner, so as to seek redressal against unfair trade practices. Live Events "Right to Know" about distributor, dealer, trader, seller and shop owner was secured under the Consumer Protection Act and, therefore, every consumer has the right to access details of product, service as well as distributor and shop owner before making a purchase, Upadhyay said. Faulty AC in bus: TNSTC GM, MD told to pay Rs 35,000 to passenger
TIRUNELVELI: In a significant ruling, the Tirunelveli District Consumer Disputes Redressal Commission has directed the managing director and general manager of the Tamil Nadu State Transport Corporation (TNSTC), Tirunelveli, to pay compensation of Rs 35,000 from their personal funds to a passenger who suffered inconvenience due to a non-functional air-conditioner in a bus. The complainant V Rajesh (36) of NGO A Colony in Palayamkottai stated that he travelled on an AC bus from Madurai to Tirunelveli paying Rs 190 for the ticket, which included an additional Rs 37 over the standard fare, in 2024. However, the AC system in the bus did not function during the entire journey, causing severe discomfort to him. Despite lodging a complaint with TNSTC's general manager, no action was taken, prompting Rajesh to approach the commission through his counsel A Bramma. During the hearing on Thursday, commission president Y Gladstone Blessed Tagore and member M Kanagasabapathi held that deficiency in service caused mental strain and hardship to the complainant. They ordered the TNSTC GM and MD to pay consolidated compensation of Rs 25,000 for mental agony and Rs 10,000 towards legal costs within one month of receiving the order, from their pockets. The commission also made it clear that the officers must not use TNSTC funds. In case of default, the officials will be liable to pay the amount with 9% interest, and the complainant could initiate an execution application against them.
