SC judge flags gaps in child protection framework, calls for major shift

The child protection framework in the country remains disjointed and under-equipped, and what is needed is a fundamental shiftone that sees the child not as a passive witness in a criminal trial, but as a person in urgent need of sustained and holistic care, Supreme Court Judge Justice Surya Kant said on Saturday.
Speaking at the inaugural session of the State-Level Meet 2025 on POCSO, Justice Kant added that the work is far from complete until children experience meaningful restorative justicewhere the systems meant to protect them do not retraumatise them.
Chief Minister A Revanth Reddy, in his address, said child survivors must be placed at the centre of India's legal and moral framework in fighting this heinous crime against humanity.
Justice Surya Kant emphasised that the system should prioritise the healing of children both within and outside the four walls of the courtroom, alongside ensuring accountability.
"Our child protection framework, though well-intentioned, remains disjointed and under-equipped. What we need is a fundamental shiftone that sees the child not as a passive witness in a criminal trial, but as a person in urgent need of sustained and holistic care," Justice Kant reiterated.
He also stated that justice for a child begins not in the courtroom, but the moment the child feels safe and secure, both within and outside their environment. Reintegration, he said, must not be an afterthought, but the foundation of our response.
"Consider the case of a 10-year-old child made to recount trauma repeatedlybefore a teacher, a police officer, a medical examiner, a lawyer, and then a judge. With each retelling, her voice grows fainter until it vanishes altogether," he said.
Justice Kant observed that the distress of the victim is often compounded by the legal process. When the system forgets the child in its pursuit of the accused, it fails them both. He noted that this imbalance is not incidental, but structural.
"The child's healing is not just a legal requirementit is a moral obligation. In the Indian societal context, it is also a constitutional commitment," he said.
He stressed that the task of protecting and supporting child victims is too important to be left to the legal system alone. It is not only the responsibility of the judiciary, police, and social workersbut a collective national duty.
"We must move away from reactive justice to a more proactive, compassionate model, where rehabilitation is not a footnote, but the foundation," he said.
In his speech, Chief Minister Revanth Reddy said, "We must protect our children from sexual abuse at any cost and by all possible means. My government gives top priority to the protection of children and women," Reddy said.
He highlighted that the Telangana Bharosa Project has 29 centres, which provide police support, legal aid, medical assistance, and counselling in a friendly environment. He added that the goal is not merely faster disposal of cases, but complete child protection and development.
Reddy acknowledged that while the POCSO Act and the Juvenile Justice Act are highly progressive legal instruments, they are not without challenges.

Vaibhav Taneja is a seasoned financial executive and the current CFO at Tesla. ANI 06 Jul 2025, 17:06 GMT+10 New Delhi [India], July 6(ANI): The Supreme Court administration has formally written a letter to the Ministry of Housing and Urban Affairs, asking for immediate action to vacate Bungalow No 5, Krishna Menon Marg, currently occupied by former Chief Justice of India, Justice DY Chandrachud. The administration said that ex-CJI Chandrachud has continued to occupy the official residence beyond the permitted period and sought that the official Chief Justice residence be urgently vacated and returned to the court's housing pool. The letter from the Supreme Court administration to the Ministry's secretary dated July 1 stated, 'I am to request you to take the possession of Bungalow No. 5, Krishna Menon Marg, from Justice DY Chandrachud without any further delay as not only the permission that was granted for retention... has expired on 31st May, 2025, but also the period of six months provided in Rule 3B of the 2022 Rules has expired on 10th May, 2025.' Under Rule 3B of the 2022 Supreme Court Judges Rules, a retired Chief Justice is allowed to retain official accommodation for up to six months post-retirement. The letter stated that the six-month period had expired on May 10, 2025, and that the special retention permission granted had also lapsed on May 31, 2025. According to the Supreme Court administration, the bungalow is part of the official Supreme Court housing pool and should now be returned for reallocation. (ANI)

Shimla (Himachal Pradesh) [India], July 6 (ANI): The Dalai Lama's 90th birthday celebration was marked with great enthusiasm, with the Chief Representative Officer of the Central Tibetan Government in Exile, Lhakpa Tsering highlighting the Tibetan spiritual leader's 14th Dalai Lama's contributions to global peace and harmony. Speaking to ANI, Lhakpa Tsering said, 'He is not only a religious leader but also a peace promoter across the world, and he usually promotes human value, religious harmony, Tibetan culture, and ancient Indian traditions.' The celebration underscores the long-standing relationship between India and Tibet, with the Deputy CM of Himachal Pradesh, Mukesh Agnihotri, saying, 'India and Tibet have a long relationship and history in culture and tradition.' Lhakpa Tsering also acknowledged India's support, stating, 'India was the first country to welcome us when we crossed the borders.' Since we came from a country where the Buddhist religion and spirituality have spread, there is a strong sense of brotherhood and sisterhood amongst us. The main practice is, as said in the Bodhisattva way of life -- considering all beings as my friends and relatives, and I always think of serving beings with the best of my abilities,' he said. He thanked the gathering for attending the celebration with joy and warmth. 'Today, my dear Dharma friends, and to all my friends, I wish to say that it is my 90th birthday celebration, and you have happily and with great excitement gathered here and with joy in our hearts. I would like to thank you for that. So, on this 90th birthday celebration of mine, you have come here with great joy in your heart. So thank you,' he said.
