Maria Chin case: Syariah Court acts in line with Malaysia's legal framework — Mohd Na'im
Minister in the Prime Minister's Department (Religious Affairs) Datuk Dr Mohd Na'im Mokhtar said the filing of a judicial review against the Syariah High Court proceedings constituted an attempt to interfere with the lawful functioning of the judiciary, which the Federal Court had now firmly rejected.
He said that Article 121(1A) of the Federal Constitution clearly establishes the separation of jurisdiction between civil and Syariah courts, meaning Syariah court decisions cannot be retried or challenged in civil courts.
"This is because Syariah courts have their own jurisdiction conferred legally.
"Any attempt to allow civil court intervention in Syariah court decisions goes against the spirit of the Constitution and threatens the stability of Malaysia's dual legal system, which is a unique feature of our legal framework," he said.
Mohd Na'im also urged all parties to respect the authority of both the Federal Court and the Syariah High Court as sovereign judicial institutions.
"The civil and Syariah courts should be seen as complementary rather than competing institutions, both with the shared goal of upholding justice and truth within the country's legal framework," he remarked.
The minister also called on the public and political actors to avoid politicising the decision, and instead to reinforce a collective commitment to the rule of law and the harmony of the dual legal system.
"As the minister responsible for Islamic affairs, I remain committed to upholding the stature and integrity of the Syariah courts so they continue to be respected, trusted, and credible, preserving the integrity of a just and constitutional Islamic judicial system," he added.
Earlier today (June 26), the Federal Court unanimously dismissed Maria Chin's application to obtain leave to appeal against the Court of Appeal's decision, which rejected her bid for judicial review of a Syariah High Court's show-cause notice for contempt.
The three-member panel comprising Justices Datuk Nordin Hassan, Datuk Abu Bakar Jais, and Datuk Vazeer Alam Mydin Meera ruled that there was no novel issue warranting the Federal Court's consideration. — BERNAMA

Communications Minister Datuk Fahmi Fadzil said his Ministry provided internet access at Nadi centres so that rural residents and users could access accurate and verified information on current issues. 'When we provide internet services, but the websites visited by residents and users are inappropriate, it's very unhelpful,' he said in his speech at the 'Sembang Santai' programme with the Madani community for the Papar parliamentary constituency here. Dewan Rakyat approves Auditor-General's Report 2/2025
KUALA LUMPUR: The Dewan Rakyat today approved the Auditor-General's Report (LKAN) 2/2025 on the Activities of Ministries/Departments/Statutory Bodies/Federal Government Companies, which contains matters raised from audits on five programmes, activities, and projects across seven ministries. The motion on it, tabled by Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said, was passed by a majority voice vote after being debated by 32 Members of Parliament. Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran, when winding up debate for the department, clarified that the Auditor-General may be appointed from among public service officers. 'For the information of Honourable Members, Clause 1 of Article 105 of the Federal Constitution provides that the Auditor-General shall be appointed by the Yang di-Pertuan Agong (King) on the advice of the Prime Minister after consultation with the Conference of Rulers. 'Referring to Article 105 read together with subparagraph 1(1) of the First Schedule to the Audit Act 1957 (Act 62), the Auditor-General may be appointed from among members of the public service, and such appointment is valid,' he said. Kulasegaran was responding to Datuk Seri Takiyuddin Hassan (PN-Kota Bharu), who had questioned the appointment of Datuk Wan Suraya Wan Mohd Radzi as Auditor-General while she was still serving in the civil service. Meanwhile, Higher Education Minister Datuk Seri Dr Zambry Abd Kadir, during his winding-up speech for his ministry, said continuous improvements were being undertaken following LKAN's investigation into procurement management at Universiti Kebangsaan Malaysia (UKM). He said that since February 28, several measures have been taken to align with the Higher Education Strategic Direction 2025, including encouraging the Internal Audit Committee to take follow-up action after discovering that several procurement circulars previously used were outdated. 'For example, UKM was still referring to Treasury Procurement Circular 2.0 when it had already been updated to version 2.2. The Pre-Tender and Coordination Committees have also been dissolved, effectively ending their functions,' he said. Deputy Minister of Rural and Regional Development Datuk Rubiah Wang, while responding on behalf of her ministry, said it had taken note of LKAN 2/2025's criticisms concerning FELCRA Berhad's oil palm estate performance. She explained that plantation yields could only be seen progressively, with three out of four estates having shown increased output and profits, including Estet Telupid in Sabah, and Sungai Rawit 2 and Aring estates in Kelantan. 'However, the current performance of one estate, Estet Dabong, has yet to reach the targeted level. This must be understood in light of unexpected factors, such as a shortage of skilled plantation workers and extreme weather affecting harvesting operations. 'Nevertheless, FELCRA has taken proactive measures, including increasing the number of harvesters and progressively repairing agricultural roads. Recovery efforts are expected to yield more positive results moving forward,' she said. During the winding-up session for the Ministry of Works, its minister Datuk Seri Alexander Nanta Linggi said the contractor selection process for Phase 1B of the Pan Borneo Sabah Highway Project was carried out through a selective pre-qualification open tender. He said this approach was vital to ensure that only companies with proven technical, financial, and experience capacity were awarded the large-scale, high-impact project. Nanta also acknowledged other challenges, including delays in land acquisition, utility relocation, and shortages of labour and construction materials, which had impacted project timelines. However, he said the ministry had taken improvement measures through engagements with relevant agencies. Meanwhile, Deputy Minister of Energy Transition and Water Transformation Akmal Nasrullah Mohd Nasir, during the winding-up for his ministry, said that all comments and criticisms, including on procurement management, would be taken into account. Easing the people's burden for a stronger economy
PETALING JAYA: Motorists will be spared from paying higher toll rates for 10 highways this year, following a government's decision to postpone the move. Among the highways are Senai-Desaru Expressway (SDE), East Coast Expressway 2 (LPT2), South Klang Valley Expressway (SKVE), Butterworth Outer Ring Road (LLB) and KL-Putrajaya Expressway (MEX). Prime Minister Datuk Seri Anwar Ibrahim said, according to an agreement with highway operators, the toll rates are supposed to increase this year. 'These are old agreements between the companies and the previous governments. To facilitate this, the government will bear the cost of more than RM500mil,' said Anwar in a special announcement aired live on his social media platforms yesterday. On the recent restructuring of electricity tariffs effective July 1, Anwar said despite the move, over 85% of domestic users would see a reduction in their bills from this month. 'Although the restructured electricity tariff began in July, the people's electricity bill has not increased,' he said. Some users, he said, saw up to a 14% reduction. 'This is unlike the slander that was spread. When the tariff increases, the cost would reduce; hence, the bill would be lower. Check your electricity bills,' he explained. Anwar also said everyone could enjoy a long weekend to celebrate Malaysia Day this year while declaring Sept 15 an additional public holiday. The long weekend would be from Saturday (Sept 13) up to Malaysia Day on Tuesday (Sept 16). The public holiday, he said, would enable Malaysians to enjoy the long break with their family or take a much-needed vacation. 'This public holiday is intended to recognise the unity and significance of Malaysia's formation. 'This will also encourage people to strengthen family bonds by visiting their hometowns or vacationing locally,' he said. Explaining the current economic situation of the country, Anwar, who is Finance Minister, said the nation's economy remained on a strong footing, supported by consistent growth, record investments and a strengthening ringgit. He said the country posted a 4.4% gross domestic product (GDP) growth in the first quarter of this year, with the second quarter expected to reach 4.5%. Malaysia also jumped 11 places to 23rd in the 2025 World Competitiveness Index, while approved investments hit an all-time high of RM384bil last year, up 17% from 2023. He added the ringgit's more than 5% gain against the US dollar this year, reaching RM4.23 and becoming one of Asia's top-performing currencies, has allowed the government to enhance living standards. He also said the unemployment rate dropped to 3% in May, the lowest in over a decade, while over 250,000 jobs were created between 2023 and 2024. Minimum wage was also raised to RM1,700 effective Feb 1 and fully implemented on Aug 1, he said, adding that 153,000 workers under government-linked companies now earned a living wage of RM3,100 monthly.
