Encroachers can't claim right to continue occupying public land: Delhi HC
The high court made the observation while granting liberty to the DDA to proceed with the demolition action at Bhoomiheen Camp in South Delhi's Kalkaji in accordance with law.
Justice Dharmesh Sharma said the writ petitions were not only flawed due to the misjoinder of multiple parties with multiple causes of action, but also failed to meet the essential threshold provided by the Delhi Slum and JJ Rehabilitation and Relocation Policy for being considered eligible for relocation and rehabilitation.
'None of the petitioners have any legal right to continue occupying the JJ cluster incessantly, to the detriment of the public at large," the court said in its order passed on June 6.
The court passed the judgment on a batch of petitions, involving around 1,200 people, seeking direction to the Delhi Development Authority (DDA) to suspend any further demolition activity, maintain the status quo at the site, and refrain from physically evicting the petitioners from their respective 'jhuggi jhopri' clusters.
The petitioners also sought a direction to the DUSIB to conduct a proper and comprehensive survey of the affected residents and rehabilitate them in accordance with the 2015 policy.
The high court said there can be no gainsaying that the petitioners have no vested right to seek rehabilitation, as it is not an absolute constitutional entitlement available to encroachers such as themselves.
'The right to rehabilitation arises solely from the prevailing policy that binds them. The determination of eligibility for rehabilitation is a separate process from the removal of encroachers from public land.
'Encroachers cannot claim a right to continue occupying public land pending the resolution of their rehabilitation claims under the applicable policy, as this would unduly impede public projects," it said.
The court, however, allowed rehabilitation of some of them and directed the DDA to allocate the EWS category flats.
The nearly three-decades-old slum cluster at Bhoomiheen Camp was home to migrants from Uttar Pradesh, Bihar, and West Bengal, among others. PTI SKV RHL

Madras High Court Dismisses Appeal Challenging NEET UG 2025 Re-Exam Order
The Madras High Court dismissed an appeal seeking NEET re-exam, stating it would severely impact over two million students across the country. The Madras High Court on Thursday dismissed an appeal filed by a group of medical aspirants seeking a re-examination of NEET UG 2025. The court observed that allowing such a request would significantly impact over two million students who took the test across the country, as reported by news agency PTI. The appeal was filed by S Sai Priya and 11 others against the High Court's earlier order on June 6, which had rejected a batch of petitions requesting that the National Testing Agency (NTA) be restrained from declaring the results of NEET UG 2025. The petitioners had argued that they experienced power outages at four examination centres in Chennai and urged the court to direct the NTA to conduct a re-exam for affected students. However, a division bench comprising Justice J Nisha Banu and Justice M Jothiraman upheld the earlier verdict and dismissed the appeal. The bench stated, 'It is to be noted that the integrity of the exam is particularly ensured through human supervision including the presence of the Centre Superintendent, Invigilators, NTA appointed Observers and City Coordinator. All these officials have examined and confirmed that the examination was conducted smoothly. A factual enquiry was undertaken by the NTA and the enquiry was conducted with regard to the field verification through the reports of the examination functionaries and an independent statistical analysis of candidate performance data." The court further noted that an expert committee conducted a statistical analysis using anonymised data, comparing the average number of questions attempted by students at the concerned centres with those from other centres in Thiruvallur District. 'This analysis found no statistically significant difference in the number of questions attempted, confirming that the alleged power outage did not materially impact candidate performance. Furthermore, NEET (UG) 2025 is a time sensitive and large scale national examination," the bench observed. Highlighting the importance of maintaining the integrity of educational assessments, the court said, 'This Court cannot sit in an appellate jurisdiction against the considered decision of the speaking order passed by the NTA, after field verification of examination centre and statistical analysis by an independent expert committee with no affiliation to the NTA, unless such decision is demonstrated to be manifestly arbitrary, mala fide or illegal." The bench concluded that allowing a re-exam under such circumstances would severely disrupt the process and disadvantage the larger pool of candidates. 'In such circumstances, if any re-examination is permitted, the same would severely affect more than two million candidates. Therefore, we do not find any reason to interfere with the order impugned and the writ appeal lacks merit and the same is liable to be dismissed. In the result, this writ appeal stands dismissed," the court ruled.

Viral Video Of Debt-Hit Farmer Pulling Plough Moves Minister To Clear His Rs 42,500 Loan
Last Updated: The video had evoked tremendous empathy from netizens for the plight of 75-year-old Ambadas Pawar, a resident of Hadolti village in Ahmedpur tehsil. In a commending move, Maharashtra minister Babasaheb Patil on Saturday cleared a farmer's loan of Rs 42,500 after a video of the debt-hit farmer pulling a plough all by himself to till his field in Latur district went viral on social media platforms. In the now viral video, the farmer, identified as 75-year-old Ambadas Pawar, a resident of Hadolti village in Ahmedpur tehsil, was seen pulling a plough all by himself on a dry patch of land with his wife by his side in the absence of oxen due to financial constraints. The video had evoked tremendous empathy from netizens for their plight. With no means to hire oxen or tractors that cost nearly Rs 2,500 per day, Pawar had said that he and his wife had turned into human ploughs. After coming across the heartbreaking visual, the state's cooperation minister, Babasaheb Patil, reached out to the poor farmer and promised to repay his pending crop loan, according to the government press release. Pawar had an outstanding loan of Rs 42,500 from the Hadolti Multi-purpose Cooperative Society. Patil visited the village on Saturday to hand over the amount to the society's office-bearers and instructed them to issue a clearance certificate to Pawar. The minister said the government is determined to address farmers' problems and is implementing various welfare schemes to improve their conditions. On Friday, the Latur district unit of Krantikari Shetkari Sanghatana presented Pawar, who owns 2.5 acres of land, with a pair of bullocks. The bovine animals were brought to his house in Hadolti in a procession amid music and dance.
