Allahabad HC rejects Abbas Ansari's plea in hate speech case

Prayagraj: The Allahabad High Court on Wednesday dismissed a petition filed by ex-MLA Abbas Ansari in a 2022 hate speech case as 'infructuous'.
Justice Samit Gopal dismissed the petition as the trial court in Mau has already concluded the trial and awarded two years jail term to Ansari on May 31 resulting in the termination of his Assembly membership.
Abbas Ansari, son of late mafia don Mukhtar Ansari, had been elected on a Suheldev Bahujan Samaj Party (SBSP) ticket.
In his petition, Ansari claimed that his speech was misrepresented and that the video evidence had been distorted.
The court observed: "In the opinion of the court since an order dated April 9, 2025, was impugned (under challenge) in the present application/petition and the trial of the matter has concluded and a judgment has been pronounced, thus the present application/ petition has rendered infructuous."
"The judgment can always be subjected to challenge before the concerned trial court if the parties therein agitate the same on the available grounds. In view of the same, the present application under section 528 (inherent powers of high court) Bhartiya Nyaya Suraksha Sanhita (BNSS) is dismissed as infructuous," the court observed.
The hate speech case dates to March 3, 2022, during the Uttar Pradesh Assembly election campaign, when Abbas Ansari, then a candidate from Mau Sadar, allegedly made inflammatory remarks targeting government officials.
