Telangana HC bars demolition of heritage structures for Metro works in Old City
The directive came from a division bench, comprising Acting Chief Justice Sujoy Paul and Justice Renuka Yara, while hearing a petition filed by the Act Public Welfare Foundation, represented by Rahim Khan. The petitioner alleged that several heritage sites in the Old City were being targeted for demolition as part of the Metro project.
In April, the Additional Advocate General (AAG), Imran Khan, had assured the court that no declared heritage structures would be touched, and sought time to submit a report based on heritage conservation committee notifications.
On Thursday, the AAG sought more time again. Opposing the plea, petitioner's counsel, MA Basith, accused authorities of deliberately stalling and misleading the court. He also submitted RTI replies questioning whether statutory clearances were obtained for the project.
Taking serious note of the delay, the court gave the government three weeks to file the report and barred any demolition or alteration of heritage structures in the meantime.

School merger order violates RTE Act: Petitioners' counsel
LUCKNOW The Lucknow bench of the Allahabad high court on Tuesday began hearing two special appeal petitions challenging the merger of primary schools. The division bench, headed by Chief Justice Arun Bhansali and Justice Jaspreet Singh, heard arguments from the petitioners' lawyers. The hearing will continue on Wednesday. The two petitions have been filed in high court challenging the July 7 order of the single bench which had dismissed the petitions challenging merger of primary schools. Senior advocate LP Mishra and advocate Gaurav Mehrotra are representing petitioners in court. They have completed their arguments in court. Mishra argued that the state government's order to merge schools violates the Right to Free and Compulsory Education Act, for children aged 6-14. He also raised concerns that the merger would create problems for young children as they would have to travel long distances to attend school. Now, the state government's lawyers are presenting their counter-arguments. Both sides are supporting their claims with precedents. On the other hand, the state government, represented by additional advocate general (AAG) Anuj Kudesia and chief standing counsel Shailendra Kumar Singh, argued that the merger was in the best interest of children, aiming to optimise resource utilisation. The government cited 18 primary schools with zero students and stated that merging such schools with nearby ones would ensure better use of teachers and facilities, ultimately improving education quality.

Supreme Court declines to interfere in Telangana HC order granting bail to 4 men accused of supplying explosives to Maoists
The Supreme Court on Tuesday dismissed a petition filed by the Telangana Government challenging a Telangana High Court order that granted bail to four men accused of conspiring and supplying explosives and material such as drones to members of the outlawed Communist Party of India (Maoist). The case was heard by a bench of Justices M M Sundresh and Nongmeikapam Kotiswar Singh, who declined to interfere in the high court's order. The case was registered in the Cherla police station of Bhadradri Kothagudem district and later transferred to the National Investigation Agency (NIA). The trial court dismissed their bail petitions on November 7, 2023, and January 18, 2024. The four bail applicants are accused 1, 3, 6, and 7 in the case. In the trial court, the special public prosecutor for the NIA had contended that the offences, charged under the Unlawful Activities (Prevention) Act and other laws, were grave and serious in nature, and since some of the accused in this case were absconding, it was not safe to grant bail. The police caught them on June 5, 2023, on the outskirts of Cherla Mandal during a vehicle check drive. They were found in possession of 'incriminating material objects, such as one drone, cortex wire bundles – 2 each 80 meters length, gelatin sticks – 10, detonators – 5. The accused 1 to 7 conspired to hand over the same to the underground cadres of proscribed organization of CPI (Maoist) i.e., accused 8 to 11 and others, for making landmine and IED firearms', the police alleged. However, while hearing the batch of petitions challenging the rejection of bail applications by the trial court, a Telangana High Court bench of Justices K Lakshman and P Sree Sudha granted them bail with certain conditions, including some general ones, bail bonds, and weekly reporting. The high court, in its order dated March 21, 2024, acknowledged the NIA's primary concern that the accused might threaten witnesses, including protected ones, and potentially disrupt the fairness of the trial. Should this occur, the special court might be unable to conduct a fair trial. In such a scenario, the NIA is free to apply for the cancellation of bail, the bench said.
