Madras High Court refuses to reject election petition against AIADMK MLA Natham Viswanathan
Justice P.T. Asha concurred with advocate Richardson Wilson, representing the election petitioner, that his client had made out a prima facie case for conducting a full-fledged trial on the election petition and therefore it could not be rejected in limine at the request of the MLA.
In his election petition, Mr. Andiambalam stated he was declared to have lost the 2021 election by a margin of 11, 932 votes since he secured 95,830 votes as against 1,07,762 votes polled by Mr. Viswanathan. He claimed that the election of his rival candidate ought to be set aside in view of various corrupt practices.
The petitioner alleged the AIADMK MLA had violated many provisions of the Representation of the People Act of 1951, the Conduct of Election Rules of 1961 and also a series of notifications issued by the Election Commission of India thereby materially affecting the result of the polls.

Stalin orders Madurai zonal chiefs to quit amid property tax scam
Madurai: In a political purge within the DMK's Madurai unit, chief minister M K Stalin ordered all five zonal chairpersons of the Madurai corporation to resign from their posts. The move followed the recent expulsion of the mayor's husband from the party and came amid the recent property tax scam. The zonal chairpersons are Vasuki Sasikumar (Madurai East), Saravana Bhuvaneshwari (Madurai North), Pandi Selvi (Madurai Central), Mugesh Sharma (Madurai South), and V Suvitha (Madurai West). Highly placed sources from DMK said the directive was issued during Stalin's ongoing 'Udanpirappe Vaa' one-on-one outreach with party functionaries, where he warned that positions would be withdrawn wherever necessary, without leniency. The discontent simmered for months, especially after a controversial corporation council meeting in May. The council meeting, which coincided with a consultative meeting chaired by commercial taxes minister P Moorthy, ahead of DMK's general council meeting, was held without quorum. Of the 100 councillors, only 25 were present initially. With the support of AIADMK councillors, quorum was managed, and resolutions were passed — an unusual move that triggered concerns within DMK ranks. In the lead-up to the party's general council meeting in Madurai on May 29, the party suspended mayor Indrani Ponvasanth's husband, Vasanth. A directive from DMK general secretary Durai Murugan cited that Vasanth acted against party interests. Sources said he insisted on conducting the corporation meeting despite internal opposition, creating a rift in the local leadership. Adding to the controversy, a property tax scam rocked the city corporation. A 10-month probe by the central crime branch of Madurai city police uncovered large-scale irregularities in the property tax assessment process by changing the data in the Urban Tree Information System (UTIS). At least five temporary revenue staff were arrested for allegedly reducing property tax for more than 150 buildings, causing financial loss to the Madurai corporation. Official sources confirmed that the role of zonal chairpersons was also under scrutiny. Intelligence reports sent to the DMK leadership reportedly allege that several zone heads may have colluded with local bill collectors in the scam. According to party sources, minister of municipal administration K N Nehru, commercial taxes minister P Moorthy, and IT minister Palanivel Thiaga Rajan met all the zonal chairpersons recently and held discussions in Madurai on Monday. "We met the mayor and the chairpersons to review and speed up civic works ahead of the elections, not for any internal party matter. The party high command will make decisions regarding resignations, Nehru informed TOI. However, a highly placed party source, on condition of anonymity, said that the party leadership is also unhappy with the functioning of the mayor, and she may not continue in the post for long. When contacted, Vasuki Sasikumar said she had not received any official intimation about her resignation. "If I receive a directive, I will respond accordingly," she told TOI. However, DMK sources said all five zonal chairpersons have to resign, and communication in this regard might not have reached them. The other four zonal chairpersons were unavailable for comment.

Opposition united in SC on SIR: 'Will snatch votes of lakhs'
NEW DELHI: The Supreme Court on Monday agreed to hear challenges by Congress and and 10 other opposition parties, including DMK and NCP (Sharad Pawar), to the 's decision for special intensive revision (SIR) of electoral rolls in Bihar. They said the squeezed timeline fixed by the EC was impractical and it was impossible to complete the process in such a short span of time. After a brief hearing, the apex court agreed to examine their plea and posted it for Thursday (July 10). are likely to be held in November. The petitions have been filed on behalf of Congress, NCP (Sharad Pawar), CPI, CPM, CPI (ML), DMK, SP, Shiv Sena (UBT), JMM and RJD. Besides, TMC MP Mahua Moitra, NGOs - Association for Democratic Reforms and People's Union for Civil Liberties - and a few residents of Bihar have also filed petitions against the EC's drive. The petitioners took the identical stand that the timeline fixed by EC was not practical and would lead to disenfranchisement of lakhs of voters, particularly migrant workers and people from marginalised communities who do not have requisite documents and may not be able to procure it within the short span fixed by EC. Congress general secretary KC Venugopal posted on X: 'It (SIR) has wreaked havoc across villages and towns of Bihar — giving crores of voters anxiety about whether their right to vote will be stolen. RJD MP Manoj Jha sought direction to EC to conduct the forthcoming polls in Bihar on the basis of the existing electoral rolls. Though at present SIR is confined to Bihar, parties apprehend that it could be replicated in other states too. Moitra urged SC to restrain EC for undertaking such an exercise. 'The impugned order is discriminatory, unreasonable and manifestly arbitrary and violates Articles 14, 21, 325 and 326. The order is a tool of institutionalised disenfranchisement. It is submitted that it is being used to justify aggressive and opaque revisions of electoral rolls that disproportionately target Muslim, Dalit and poor migrant communities, as such, they are not random patterns but it is engineered exclusions. The present SIR process is not only hasty and ill-timed, but has the effect of disenfranchising crores of voters, thereby robbing them of their constitutional right to vote. Moreover, this exercise has been launched during monsoon season in Bihar, when many districts are affected by floods and local population is displaced, thereby making it difficult and almost impossible for a large section of population to meaningfully participate in the process,' Jha said in his plea. Seeking the court's direction to set aside the EC's order, Moitra in her petition, filed through advocate Neha Rathi, submitted that the order unlawfully shifted the burden of proving eligibility from the state to the individual elector and arbitrarily excludes commonly accepted identity documents such as Aadhaar and ration cards. PUCL, in its petition through advocate Talha Abdul Rahman, questioned EC's timing, alleging Bihar's massive migrant population faces systematic exclusion as workers lacking local address proofs struggle with complex procedures from distant locations, possibly missing compressed timelines due to work commitments.
