Repeat offender in Kuching gets five years' jail, one stroke for drug abuse

KUCHING (June 16): The Sessions' Court here today sentenced a 41-year-old repeat drug offender to five years in jail and one stroke of the cane for amphetamine and methamphetamine abuse.
Judge Musli Ab Hamid meted out the sentence against Jonathan Fu Won Yen after he pleaded guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39C(1)(b) of the same Act.
Section 15(1)(a) of the DDA 1952 provides for a fine of up to RM5,000, or up to two years in prison, or both, while Section 39C (1)(b) of the same Act provides for up to seven years imprisonment and not more than three strokes of the cane upon conviction.
Musli also ordered Fu to undergo supervision for two years following the completion of his sentence.
The offence was committed at the Kuching District Police Narcotics Crime Investigation Department office on March 19, 2024.
Fu has two previous convictions for the same offence under Section 15(1)(a) of the DDA 1952, both on Oct 19, 2022.

The grandfather described his grief over losing his eldest grandchild, emphasising the strong bond Zayn shared with his parents. Under cross-examination by Deputy Public Prosecutor Raja Zaizul Faridah Raja Zaharudin, Zahari confirmed that Zayn, who was autistic, needed constant care and had a close relationship with both parents. He also agreed that Ismanira and Zaim treated Zayn and his younger sibling equally. On Monday, Judge Dr Syahliza Warnoh ruled that the prosecution had established a prima facie case, requiring Ismanira to enter her defence. Her husband, Zaim Ikhwan, 30, was acquitted of the same charge. The couple had been accused of neglecting Zayn in a manner likely to cause physical harm between December 5 and 6, 2023, near Block R of Idaman Apartment, Damansara Damai, and a nearby river. They faced charges under Section 31(1)(a) of the Child Act 2001, read with Section 34 of the Penal Code, which carries a maximum penalty of 20 years' jail, a RM50,000 fine, or both. If either of his parents were not working, I would make sure they came over to spend time with him. "He was very close to his parents. I believe my son (Zaim Ikhwan) and daughter-in-law (Ismanira) were not involved in his death," Zahari said during examination-in-chief by defence lawyer Haresh Mahadevan. The second defence witness added that he was heartbroken by the loss of his eldest grandchild. When questioned by Deputy Public Prosecutor Raja Zaizul Faridah Raja Zaharudin, Zahari confirmed that Zayn Rayyan, who was autistic, required constant care and shared a close bond with both parents. He also agreed with the prosecution's suggestion that Ismanira and Zaim treated Zayn Rayyan and his younger sibling equally. They were charged under Section 31(1)(a) of the Child Act 2001, read together with Section 34 of the Penal Code. If convicted, the offence carries a maximum sentence of 20 years' jail, a fine of up to RM50,000, or both. The trial continues tomorrow. – Bernama
