UP mulls hike in compensation to hit-and-run mishap victims

LUCKNOW The Uttar Pradesh government is set to substantially increase compensation in hit-and-run accident cases. The cabinet is soon expected to give its nod to the transport department's proposal that seeks to make separate rules to grant enhanced compensation under the State Road Safety Fund, said officials.
Currently, the state's compensation stands at ₹25,000 in case of death and ₹10,000 for injuries. The compensation given on district magistrates' reports is seen to be too meagre. The Centre may give compensation separately under the Motors Vehicles Act.
'Under the newly drafted rules, the government plans to increase the payout to ₹5 lakh for fatalities and ₹2-4 lakh for injuries, depending on the seriousness and nature of injuries,' a senior transport department official said. 'The rules under which the compensation is proposed to be granted will be known as Road Accident Relief Fund Rules,' he added.
The proposal is expected to be placed before the cabinet for approval soon, another senior official said, adding that the revised compensation structure was aimed at offering more substantial support to affected families, particularly in severe accident cases.
'The current compensation amounts are inadequate, given the rising cost of medical treatment and the financial burden on the victims' families. The proposed increase seeks to address this gap,' the official stated.
Hit-and-run cases are road mishaps where the identity of the offending vehicle or driver remains unknown.
In January last year, the Supreme Court directed the Centre to consider amending the Motor Vehicles Act to enhance the compensation granted to the victims of hit-and-run accidents. The Act allows the victims to be paid a compensation of ₹2 lakh in case of death and ₹50,000 for injuries.
The court also observed that very few victims claimed compensation because they did not know about the existence of any such compensation scheme.
According to the last available National Crime Record Bureau (NCRB) data, 954 hit-and run accidents were reported in Uttar Pradesh in 2022, in which 751 persons were killed and another 406 injured. The number is gradually increasing with the increase in the number of total road accidents in the state.

Lt Col Prasad Purohit, through his counsel Shrikant Shivade (who passed away in 2022) and later advocate Viral Babar, had consistently argued that the UAPA sanction was flawed. Other accused also challenged the validity of the Jan 2009 sanction and another issued in 2011 by the additional chief secretary (home). The trial court held both sanctions to be "defective." So, all the provisions of UAPA will not be invoked," the judge ruled. Advocates Ranjeet Sangle (for Sudhakar Dwivedi) and J P Mishra (for Sadhvi Pragya Singh) also argued that the first sanction bypassed the statutory safeguard under Section 45(2), and that the absence of such review invalidated the trial court's cognisance of UAPA charges. Special public prosecutor Avinash Rasal had contended that the sanction's validity could only be decided during the trial, a view echoed by the Supreme Court in 2018. However, the special judge reviewed the sanctioning procedure and found that UAPA charges could not be sustained due to the faulty sanction. Shivade had also pointed out that the authority did not comply with the mandatory safeguard of an additional review committee required under law since Dec 31, 2008. The prosecution argued that since the crime occurred in Sept 2008, the earlier 2004 provision-without the second review-was applicable. But the Supreme Court clarified in 2023 that the UAPA's procedural safeguards during sanction are mandatory.

Mumbai: The defence cited the Supreme Court judgment of Sept 23, 2023, where it held, in an appeal from the high court of Jharkhand at Ranchi, that the UAPA rules and added safeguards introduced in 2008 were "couched in mandatory language and, therefore, have to be strictly followed. " "This is keeping in view that UAPA being a penal legislation, strict construction must be accorded to it. Timelines imposed by way of statutory rules are a way to keep a check on executive power, which is a necessary position to protect the rights of accused persons. Independent review by both the authority recommending sanction and the authority granting sanction are necessary aspects of compliance with Section 45 of the UAPA," the SC's Justices CT Ravi Kumar and Sanjay Karol had stated. The SC had further said, "Given the severity of these laws and the nature of activities with which they are associated, the effect that they have on the person accused thereunder is not only within the realm of law but also drastically affects social and personal life. It is only after the authority, having been handed this task, is of the considered view that sanction can be granted, should it be so done."TNN
