No bail for jailed nuns as Chhattisgarh court cites jurisdiction issues

A Sessions Court in Chhattisgarh's Durg district on Wednesday (July 30, 2025) disposed of the bail applications of the two nuns and a Narayanpur resident — who were arrested last week on charges of human trafficking and forcible religious conversion — observing that it did not have the jurisdiction to hear the matter. The court said it could not go into the merits of the case.
In his order, Additional Sessions Judge Anish Dubey cited Section 11 of the National Investigation Agency Act 2008 to point out the jurisdiction issue and ordered the applicants — nuns Preethi Mary and Vandana Francis, and Sukman Mandavi — to move a special court for relief.
The court noted that Section 2(1)(g) of the NIA Act, 2008 contains a separate Schedule that includes Section 370 of the now abolished Indian Penal Code, 1860. It further added that Section 143 of the Bharatiya Nyay Sanhita, 2023 [that the applicants are accused of violating] pertains to 'trafficking of a person' which is similar to Section 370 IPC. Citing Chhattisgarh government orders to list courts that have been given the jurisdiction to hear such cases in different divisions, it said that the applicants move the designated court.

Earlier, the applicants submitted that they were accused on the basis of mere suspicion. The application also said due to poverty and lack of employment, the three girls were going to Agra voluntarily to work and learn work. The girls were already followers of Christianity and, hence, there was no question of their conversion, the application added.
The bail was opposed by the Public Prosecutor, who submitted that since Section 143 of the Indian Penal Code was imposed on the accused, 'this court has no jurisdiction to hear the bail application'.
The nuns and Ms. Mandavi were arrested by the Government Railway Police (GRP) at Durg railway station in Chhattisgarh on July 25 following a complaint by a local Bajrang Dal functionary, who accused them of forcibly converting three women from the State's tribal-dominated Narayanpur district and trafficking them. The issue has triggered protests from political parties across the spectrum in the nuns' native State of Kerala.

Senior CPI(M) leader Brinda Karat on Wednesday (July 30, 2025) met the two nuns at the Durg Central Jail in Chhattisgarh following which she called the arrests 'unconstitutional and illegal', and demanded their immediate release.
Ms. Karat also held a press conference in Raipur where she said that the allegations against the nuns were false.

A Faridkot court has framed charges of murder, destruction of evidence and criminal conspiracy against Punjab Cricket Association (PCA) president and Aam Aadmi Party (AAP) leader Amarjit Mehta and five others in a 2016 murder case. The charges were framed under Sections 302 (murder), 201 (causing disappearance of evidence), 120-B (criminal conspiracy), 506 (criminal intimidation), 148 (rioting armed with a deadly weapon) of the Indian Penal Code and Section 27 of the Arms Act. (HT File) The other accused include four Punjab Police personnel — sub-inspector Lachman Singh and constables Parminder Singh, Dharminder Singh and Kabal Singh — and liquor contractor Dharampal Singh Goel. All six are on bail. The charges were framed under Sections 302 (murder), 201 (causing disappearance of evidence), 120-B (criminal conspiracy), 506 (criminal intimidation), 148 (rioting armed with a deadly weapon) of the Indian Penal Code and Section 27 of the Arms Act. The trial will begin on August 8. Hearing the matter on July 30, the court of additional sessions judge Dinesh Kumar Wadhwa said from the material placed before the court, a prima facie case for an offence punishable under these sections was made out against the accused. The case pertains to the killing of kabaddi player Ajmer Singh, who worked for a liquor contractor in Faridkot, on May 25, 2016. According to the FIR, Ajmer was portrayed as a member of the Davinder Bambiha gang and killed in a police encounter that was allegedly in self-defence. Allegations against the accused Bathinda-based businessman Amarjit Mehta and his associate Dharampal Singh Goel, who was involved in the liquor business, had allegedly been pressuring liquor contractors in Faridkot to either sell their shares to them or divert their liquor quotas Ajmer and his brother Ranjit, both kabaddi players, reportedly worked for a rival liquor contractor. Ranjit, who was also later murdered, had alleged that Mehta, Goel and the police chased and killed Ajmer. In 2018, a judicial probe into the killing was initiated after Ajmer's mother Manjit Kaur filed a complaint with the National Human Rights Commission (NHRC). The probe by the sub-divisional judicial magistrate of Jaitu found major inconsistencies in the police account, which it held were aimed at concealing the facts behind Ajmer's murder. What the police claimed The FIR filed on May 26, 2016, by then Jaitu SHO Lachman Singh stated that Ajmer, along with another armed man, opened fire on a night patrol team. In self-defence, a constable used his rifle and one of the gunshots hit Ajmer. The FIR stated that an SUV later arrived and took away the injured man. Ajmer's family, however, contested this, alleging that Mehta, Goel and the police officials chased and shot Ajmer dead. A murder FIR was subsequently registered on June 7, 2021. A special investigation team (SIT), led by DSP Jatsinder Singh, later again backed police's self-defence claim and recommended cancellation of the FIR. Ajmer's mother contested this and the sub-divisional judicial magistrate (SDJM) rejected the cancellation report on July 30, 2024. The SDJM order also cited the judicial inquiry report, which found that the probe by DSP Jagdish Kumar Bishnoi was inadequate, raising suspicions that the probe was designed to protect the real culprits. The order mentioned that the police tortured Ajmer's brother Ranjit and filed false charges against him under the NDPS Act and Excise Act to pressure him. Ranjit was later acquitted in both cases. The SDJM order also noted that Ajmer's family was allegedly offered ₹35-40 lakh by SHO Lachman Singh to withdraw the case, and threatened when they refused.

Nagpur: The Nagpur bench of Bombay high court recently referred the case of prolonged detention of a Nigerian national — despite being granted bail 10 months ago — to a larger bench for consideration as a public interest litigation (PIL), after govt authorities failed to transfer the accused to any foreigner detention centre. The accused, Emeka Udenje, was arrested on May 21, 2023, from Delhi by Nagpur Police's cyber cell, in connection with sections under Indian Penal Code for cheating and criminal breach of trust and Section 14 of Foreigners Act. He was remanded in judicial custody on May 27. On June 19, 2024, the judicial magistrate first class, Nagpur, granted Udenje bail on furnishing a Rs50,000 bond and a surety. Given his lapsed passport and visa, the court directed that he be placed in a foreigner detention centre to ensure his presence during trial, suggesting coordination with the district collector. After complying with the bail conditions, Udenje was released from Nagpur Central Jail on September 24, 2024, but was immediately detained again at the city's cyber police station. His application before the sessions court to modify the detention condition was rejected, prompting him to move the HC through counsels Madan Puranik and HR Nanoti. But two months later, when no transfer was executed, Udenje filed a fresh application, prompting the court to seek clarification. On inquiry, the govt reversed its stand, stating that no foreigner detention centres were operational in Maharashtra. Concerned with this contradiction and continued illegal detention of a foreign national despite being granted bail, the court observed: "Now there is an issue where foreign nationals are to be kept. There are two other foreign nationals, and the investigating agency is unable to decide their accommodation and detention. This aspect is to be dealt with by this court." Justice Joshi-Phalke noted, "If the foreign nationals are permitted to be released, there would be an apprehension of them fleeing away and difficulty in securing their presence." In view of the unresolved systemic concerns, the court directed that Udenje's case be placed before Bombay HC division bench at Nagpur as a PIL. Gujarat police's state monitoring cell (SMC) arrested Bipin Darji — purported to be the partner of Bharat alias Bobby Patel, the 'Dingucha kingpin' allegedly linked to the tragic deaths of a Gujarati family on the US-Canada border in 2022 — from Vijapur in Mehsana. Police say he was part of the network allegedly led by Bobby Patel that promised people with dreams of settling in the US, illegal passage through Canada and Mexico. "Darji worked as a field agent in Mehsana region and was responsible for luring clients desperate to reach the US, collecting their documents, arranging fake passports and visas, and coordinating payment logistics with Bobby Patel and the network of domestic and international illegal immigration agents," said a police officer close to the case. He confessed to his role in the transnational racket. Darji admitted to facilitating the movement of individuals using forged documents and coordinating with international agents," said police. "During interrogation, Darji confessed to being Bobby Patel's partner in the illegal immigration racket and admitted he had been in hiding since the case was filed. To evade arrest, he had moved frequently between Visnagar, Mehsana, Unjha, Vijapur, Jaisalmer, Bikaner, Ranuja, and Mumbai," said police. So far, 12 accused have been arrested in connection with the case. Three, including the main accused, Bobby Patel, were in judicial custody for the past two and a half years. Bobby Patel, 47, dubbed the 'Dingucha kingpin', is suspected to have facilitated the illegal travel of Jagdish Patel, 39, his wife Vaishali Patel, 37, their daughter Vihangi, 11 and son Dharmik, 3, from Dingucha village in Gandhinagar to the US. The journey ended when they froze to death just 10m near the US-Canada border in Jan 2022. Investigations revealed that Bobby Patel had obtained 28 legally issued passports by altering minor details, some even containing biometric data, through various passport offices in Mumbai and Ahmedabad. These multiple passports allowed him to leave and re-enter India undetected. He was arrested by the SMC in Dec 2022 from Bhadaj area of Ahmedabad when he allegedly arrived to meet his ailing partner. "He is suspected of having helped 1,500 people from North Gujarat obtain fake passports. His name cropped up in the investigation into the IELTS paper scam in North Gujarat. We also suspect Bharat Patel had sent six people from North Gujarat to the US. The six had to be rescued by the US authorities after their boat capsized and they almost drowned while illegally crossing the St Regis river on the Canada-US border," said an officer. The Enforcement Directorate (ED) arrested Bobby Patel early this July under the provisions of the Prevention of Money Laundering Act (PMLA), 2002, in connection with a human trafficking case. The ED initiated its investigation based on the FIR registered by Sola High Court police station, which accused Patel and others of illegally sending Indian citizens abroad since 2015. The investigation revealed that Bobby Patel and his associates allegedly charged Rs 60 lakh to Rs 75 lakh for one passenger, Rs 1 crore to Rs 1.25 crore for a couple, and Rs 1.25 crore to Rs 1.75 crore for families with children. Even as further probe is underway, an officer close to the investigation said, "Other accused related to the case still at large include Munna Khatri, reportedly residing in Canada, and Munna Maken, currently in the US, for whom extradition procedures are ongoing."
