"Preamble is not changeable... but this Preamble for Bharat was changed": VP Dhankhar on constitutional changes made during Emergency
Speaking at an event at the Vice-President's Enclave, marking the presentation of the first copy of 'Ambedkar's Messages' compiled by author and former Karnataka MLC DS Veeraiah, Dhankhar emphasised that a preamble of a constitution was 'not changeable' or 'not alterbale' as was the base on which the constitution would grow.
He claimed that, except for India, no other Preamble of any other constitution has undergone any change, referring to the changes made by the 42nd Constitutional Amendment Act of 1976, adding the words 'socialist, secular and integrity'.
'Preamble of any constitution is its soul. The Preamble of the Indian Constitution is unique... Except Bharat, [no other] Constitution's Preamble has undergone change and why? Preamble is not changeable. Preamble is not alterable. Preamble is the basis on which the constitution has grown. Preamble is the seed of the Constitution. It is soul of the constitution, but this Preamble for Bharat was changed by 42nd Constitutional Amendment Act of 1976, adding words Socialist, Secular and Integrity,' the Vice President stated.
Dhankhar's remarks were made as part of a broader reflection on the constitutional changes during the Emergency, which he described as the 'darkest period of Indian democracy'.
He recounted the suspension of fundamental rights and the imprisonment of political leaders and citizens, questioning the legitimacy of altering the Preamble under such circumstances.
'During the Emergency, the darkest period of Indian democracy, when people were behind the bars, fundamental rights were suspended. In the name of those -- we the people -- who were enslaved, we just go for what? Just a flourish of words? It is to be deprecated beyond words,' Dhankar stated, drawing on the landmark Kesavananda Bharati case of 1973, where Justice HR Khanna had affirmed the Preamble's role as a guide to constitutional interpretation, quoting Justice Khanna, 'The Preamble serves as a guide to the interpretation of the Constitution and indicates the source from which the Constitution derives its authority -- namely, the people of India.'
The Vice-President expressed deep concern over the timing and nature of the changes, arguing that they were made when 'We the People were bleeding in heart, in soul -- they were in darkness.'
He criticised the addition of the words 'Socialist', 'Secular', and 'Integrity' during the Emergency as a 'Nasoor (festering wound)' that could create upheaval and signal a betrayal of the framers' mindset, underscoring the sacrilege to the spirit of Sanatana and the civilisational ethos of India.
'We are changing the soul of the Constitution. We are, as a matter of fact, by this flash of words, added during the darkest period of Emergency -- the darkest period for the Constitution of the country. And in the process, if you deeply reflect, we are giving wings to existential challenges. These words have been added as Nasoor (festering wound). These words will create upheaval. Addition of these words in the Preamble during the Emergency signals betrayal of the mindset of the framers of the Constitution. It is nothing but belittling the civilisational wealth and knowledge of this country for thousands of years. It is sacrilege to the spirit of Sanatana,' Dhankhar said.
Dhankhar also highlighted the contemporary relevance of BR Ambedkar's messages, urging that they be honoured and respected by Parliamentarians and policymakers.
'Dr. BR Ambedkar lives in our hearts. He dominates our mind and touches our soul... Ambedkar's messages bear huge contemporaneous relevance for us. His messages need to permeate down the line, up to the family level. The children must come to know about these messages,' he said, calling for a reflection on why 'temples of democracy' are being 'sacrileged' and 'ravaged by disruption.'
Recalling judicial perspectives, Dhankhar cited Justices Hidayatullah, Hegde, Mukherjee, Shelat, and Grover from the IC Golaknath versus State of Punjab case, who viewed the Preamble as unalterable and embodying the Constitution's fundamental values.
He contrasted this with the casual alteration during the Emergency, deeming it an 'earthquake' to the constitutional foundation.
'The Preamble to our Constitution contains in a nutshell its ideals and aspirations. It is not a mere flourish of words but embodies the objectives which the Constitution seeks to achieve,' the Vice-President quoted Justice Hidayatullah, emphasising the gravity of the change.
Dhankhar concluded by invoking Ambedkar's final address to the Constituent Assembly on November 25, 1949, urging the nation to prioritise country over creed.
'I do not want that our loyalty as Indians should in the slightest way affected by our competitive loyalty, whether that loyalty arises out of our religion, out of our culture or out of our language. I want all people to be Indian first, Indian last and nothing else but Indians,' Ambedkar had said, a message Dhankhar urged should be framed and read daily.
He warned of the risks of placing creed above country, echoing Ambedkar's anxiety about India's independence being jeopardised again.
'This anxiety is deepened by the realization of the fact that in addition to our old enemies in the form of castes and creeds, we are going to have many political parties with diverse and opposing political creeds. Will Indians place the country above their creed? Or will they place creed above the country... I do not know, but this much is certain that if the parties place creed above country, our independence will be put in jeopardy a second time and probably be lost forever,' Dhankar stated as quoted by Ambedkar. Industry ready if US trade deal doesn't materialise: CII President
Indian industry is prepared for any outcome regarding the proposed bilateral trade agreement with the United States, according to Confederation of Indian Industry (CII) President Rajiv Memani, who emphasised that the country's business sector will not pursue deals that compromise national interests. In an interview with ANI, Mempraised the government's extensive consultation process with industry stakeholders before positioning India in trade negotiations. "The Indian government has given considerable time to understand industry concerns, issues and opportunities. Every industry, every size of industry has been consulted to understand how India should be positioned," he said. The CII President emphasized that there is no compulsion to conclude a deal at any cost. "There is no doubt that India will only do this deal when it is in India's interest and America's interest. Until it is not in the interest of both countries, this deal will not happen. There is no compulsion in this regard," Memani stated. Live Events Expressing readiness for either possibilty, Memani outlined the conditions under which industry would support the Free Trade Agreement (FTA). "If you ask industry whether they want this FTA on favourable terms and if we get relatively better terms compared to other countries, then industry desires this FTA," he explained. The potential benefits are significant, particularly regarding tariff reduction. "The 26 per cent tariff that has been imposed will come down and industry will get opportunities to operate there. We will remain more competitive compared to other countries," Memani noted. The CII President also highlighted the broader strategic messaging that an FTA would send: "When two countries have an FTA, it also sends a message that both countries are ready to work together." Memani acknowledged that certain sectors would face difficulties if the trade deal (with US) doesn't materialize, but emphasized industry's commitment to national interests. "It is certain that some sectors and some industries will face difficulties, but industries do not want to work in a way that harms the country. Industry wants to do this in a way that benefits the country," he said. The CII President specifically identified potential competitive challenges, particularly in the automotive sector. "If you look at auto companies, Mexico has a trade deal where tariff is almost 0 per cent. If there's a 25 per cent gap, then Mexico becomes most competitive," he explained. Memani predicted that Mexico would be the primary beneficiary if India fails to secure favorable terms, with some potential gains for Vietnam as well. "The maximum alternative replacement will come from Mexico, with some possibility from Vietnam," he said. The textiles and garments industry could face particular challenges due to Vietnam's existing advantages. "The garments industry could become slightly less competitive because Vietnam has a 20 per cent tariff," Memani observed, highlighting how existing trade relationships could impact Indian competitiveness. Memani cautioned against expecting immediate benefits even if a deal is concluded, describing trade agreements as "a long game." He emphasised that both countries would need to make adjustments to maximize benefits. "Many American companies may also invest in India to export from India. Indian companies will also have to focus on their competitiveness," he noted, suggesting that the government might need to implement reforms and support measures to help industries become more competitive. The CII President's comments reflect a mature approach to international trade negotiations, where industry supports government efforts to secure favorable terms while remaining prepared for alternative scenarios. "Trade deals are two-way. Some things will be good, while some sectors may face challenges," Memani said acknowledging the complex nature of international trade agreements and their varied impacts across different sectors of the economy.

TMC MP Mahua Moitra moves Supreme Court against EC's revision of electoral rolls in Bihar
NEW DELHI: Trinamool Congress leader and Member of Parliament Mahua Moitra has moved the Supreme Court challenging an order of the Election Commission of India for special intensive revision of electoral rolls in Bihar. In her plea, Moitra said she seeks setting aside of the order dated June 24 under which Special Intensive Revision (SIR) is being conducted in alleged violation of various provisions of the Constitution. "The present writ petition has been filed in public interest under Article 32 of the Constitution seeking setting aside of order dated 24.06.2025 issued by Election Commission of India under which SIR of electoral rolls in Bihar is being conducted in violation of Articles 14, 19(1)(a), 21, 325, 328 of the Constitution and provisions of Representation of People (RP) Act, 1950 and Registration of Electors (RER) Rules, 1960 which, if not set aside, can lead to large-scale disenfranchisement of eligible voters in the country thereby undermining democracy and free and fair elections," it submitted. Moitra further sought a direction from the apex court to restrain the Election Commission of India from issuing similar orders for SIR of electoral rolls in other states of the country. "It is submitted that it is for the very first time in the country that such an exercise is being conducted by ECI, where electors whose names are already there in electoral rolls and who have already voted multiple times in are being asked to prove their eligibility," the plea filed through advocate Neha Rathi said.

The Member of Parliament and Bollywood actress Kangana Ranaut visited the Thunag subdivision in Mandi district on Sunday, amid widespread destruction and loss of lives caused by cloudbursts and flash floods triggered by heavy rainfall across Himachal Pradesh . While speaking to ANI, Kangana shared the on-field report of the ' relief efforts ' by the Indian government and the administration in the flash flood-affected areas, especially Thunag subdivision. "Following the cloudburst , there is a flood-like situation here in Mandi. Road connectivity is severely affected, particularly in the Thunag area and the nearby areas. Despite this, our government and administration are closely monitoring the situation, and relief efforts are underway. Road connectivity is being restored. Our teams are in every affected area. We have made committees in the affected areas, which have their chairpersons," said Kangana Ranaut. A spokesperson of the State Government said that the Mandi administration had distributed 1,317 food kits having 5 kg flour, 5 kg rice, one litre edible oil, one kg salt, one kg sugar, two kg pulses, 100 gm Haldi, 100 gm Mirch powder and 100 gram tea each among the affected families in the disaster hit areas. Live Events He stated that 197 food kits were made available in Thunag, 69 in Janjehli, 1,000 in Bagsaid, 40 in Dharampur, and 11 in the Chauntra area of Mandi district. He said that 160 food kits had been sent for the Janjehli area and 176 kits for the Thunag area of the Seraj assembly constituency of Mandi district today for further distribution among the disaster-affected families. He stated that 665 kits are still in stock and will be distributed as needed. On Saturday, a team of the State Disaster Response Force (SDRF) conducted a field visit to a village in Panchayat Jarode to extend emergency assistance to residents in disaster-affected areas. During the visit, the SDRF team surveyed the impacted areas and identified vulnerable individuals in urgent need of aid. Relief materials, including basic need kits and medical kits, were distributed to the affected families as part of the immediate response effort. The team also assessed the medical conditions of several villagers and provided essential medicines on-site to those requiring immediate care. As part of the outreach, SDRF personnel interacted with local residents to gather information about unmet needs and additional support requirements. These findings have been shared with the District Administration to ensure timely and continued relief measures. Himachal Chief Minister Sukhvinder Singh Sukhu has directed the Mandi district administration to conduct relief and rescue operations on a war footing in the disaster-affected areas of the district, ensuring that relief reaches all those in need. The death toll in Mandi district has risen to 14 amid widespread destruction and loss of lives caused by cloudbursts and flash floods triggered by heavy rainfall. The most affected areas are the Thunag subdivision, Karsog Gohar subdivision and Dharampur subdivision, DC Mandi, Apoorv Devgan said.
