Vietnamese women among four charged over massive RM3m MDMA haul in Johor

JOHOR BARU, July 3 — Four individuals, including two Vietnamese women, were charged in the Magistrate's Court here today with five charges of drug trafficking and possession.
In the court before Magistrate A. Shaarmini, they were jointly charged with two counts of drug trafficking, namely MDMA powder weighing 12,090 grams and MDMA pills weighing 375 grams, at Unit No. 25-05, Mercu 1, Block A3-1, Jalan Tanjung Puteri 1, R&F Tanjung Puteri, at about noon last June 19.
The charges were brought under Section 39B(1) of the Dangerous Drugs Act 1952, read together with Section 34 of the Penal Code, which provides for the death penalty or life imprisonment and, if not sentenced to death, to be whipped with not less than 15 strokes of the cane upon conviction.
No plea was recorded from all of them, namely Ching Hin Leong, 46, Tay Wei Bin, 36, Pham Thi Quy, 26, and Nong Thi Nhinh, 29, as the case involved the death penalty, which is under the jurisdiction of the High Court.
They were not allowed bail, and the court set Sept 3 for mention.
Deputy public prosecutors Nur Fatihah Mohd Nizam and Nor Afiqah Musa prosecuted in both cases, while Ching and Pham were represented by lawyers S. Selvanteran and Siti Nadia Yahya.
The four accused were among five individuals arrested in a special operation by the Johor Police Narcotics Criminal Investigation Department (JSJN) in Johor Baru Selatan, which resulted in the seizure of various types of drugs estimated to be worth almost RM3 million.
In the court before Magistrate Nabilah Nizam, the five accused were jointly charged with three counts of drug possession at the same location and time.
On the first count, they were jointly charged with possessing seven grams of methamphetamine, while for the second and third charges, they were charged with possessing 520 grams of nimetazepam and 25 grams of ketamine.
All the charges were framed under Section 12(2) of the Dangerous Drugs Act 1952 and are punishable under Section 39A(1) and Section 12(3) of the same act, read together with Section 34 of the Penal Code.
If convicted, they can be sentenced to between two and five years' imprisonment and whipping for the first charge, while the other two charges carry a prison sentence of up to five years or a maximum fine of RM100,000 or both.
In a separate proceeding before the same Magistrate, Ching was charged with another three counts of drug trafficking and possession.
On the first count, he was charged with trafficking 4,645 grams of MDMA at a unit at Block B, Vista Puteri Apartment, Jalan Bayu Puteri 1, at about 3.10 pm.
The charge, under Section 39B(1) of the Dangerous Drugs Act 1952, provides the death penalty or life imprisonment and whipping of not less than 15 strokes, if not sentenced to death upon conviction.
For the second and third charges, he was alleged to be in possession of 79 grams of ketamine and 28 grams of nimetazepam at the same location and time.
Both charges were brought under Section 12(2) and are punishable under Section 12(3) of the same act, which provides imprisonment of not more than five years or a fine of up to RM100,000 or both upon conviction.
No plea was recorded, and the court set Sept 4 for mention.
Deputy public prosecutors Siti Aishah Latif and Amirah Tasnim Saleh appeared for the prosecution in the case. — Bernama

KUALA LUMPUR : The High Court heard today that SRC International Sdn Bhd's subsidiary, Jendela Pinggiran Sdn Bhd (JPSB), was a dormant company with only RM500 in its bank account before it received RM43.96 million from its parent company, with no documentation to justify the transfer. SRC International's lawyer, Razlan Hadri Zulkifli, told the court the former directors of JPSB had committed a breach of fiduciary duty following the lack of documents concerning the transfer. 'There were no resolutions, notes, internal memoranda, or even WhatsApp messages … nothing at all related to JPSB. 'JPSB had an opening balance of RM500 in April 2015. That remained the case until July 2015, when SRC International suddenly transferred RM43.96 million into JPSB's bank account. 'Not only were there no documents justifying the amount, obviously there were no documents justifying the RM19.5 million (transferred) to the defendants (Umno),' he said. Razlan was submitting in a suit filed by SRC International and its subsidiaries, JPSB and Gandingan Mentari Sdn Bhd, against the Umno headquarters and its Selangor chapter to recover RM19.5 million in funds, including RM3.5 million transferred to Selangor Umno. He said that after July 2015, JPSB returned to its 'natural state, very quiet, sitting there with a minimal sum of money in its bank account'. Razlan said there had been no documentation because JPSB's purpose was to 'purely collect money and transfer it out'. The plaintiffs claim that the defendants had dishonestly and knowingly received the funds from JPSB. Umno's lawyer, Shahrul Fazli Kamarulzaman, denied the claim, suggesting that JPSB was a special vehicle with a dedicated account to run corporate social responsibility activities, accept funds for CSR, and disburse them to third parties. He said the earlier examination of former JPSB director Suboh Yassin showed that there were documents available pertaining to the company's activities. 'PW-2 (Suboh Yassin) said there are other documents available outside the bundle, possibly with the authorities or in the plaintiff's office,' he said. The hearing before Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan continues on July 30.

(Facebook pic) PETALING JAYA : Twenty children, including a 15-day-old baby girl, were rescued from a warehouse and a house operating as an unregistered learning centre in Bukit Mertajam, Penang, last week. Penang social development and welfare committee chairman Lim Siew Khim said the rescue operation was carried out by the social welfare department (JKM) with the cooperation of the police, following public complaints. 'Those rescued were aged between 15 days and 16 years, comprising 10 boys and 10 girls. 'Initial investigations revealed that 12 children, including the baby, did not have birth certificates. 'Six had valid documents but no parents or guardians, while two have since been placed in the care of close family members,' Lim told a press conference in George Town today. She was quoted by Kosmo as saying a 20-year-old woman, believed to be the biological mother of the baby, was also 'rescued' during the operation. All those rescued are believed to be of various nationalities and primarily spoke Mandarin, with limited proficiency in Malay. Lim said the children are believed to have been deprived of basic necessities, including adequate food, clothing and safe shelter. 'The warehouse was in a filthy condition and completely unsuitable for habitation, especially by children. 'It was neither a care home nor a registered learning centre. Children should not have been there,' she said. During the raid, five adults believed to be acting as caretakers were also found on the premises. They were local individuals, aged over 18, and are currently being investigated by the police. 'Health screenings have also been conducted at Seberang Jaya Hospital with the involvement of JKM psychological officers,' Lim said, adding that a temporary custody order for the children had been granted by the court. Lim said her office had received several public complaints since the end of last year about the centre. However, earlier inspections at the address found no children present.

PETALING JAYA : Police have remanded an army sergeant in Alor Gajah, Melaka, for five days on suspicion of sexually assaulting a five-year-old girl in January. Magistrate Teoh Shu Yee allowed the remand of the 32-year-old suspect from today to July 29 for police to complete their investigation under Section 14(a) of the Sexual Offences Against Children Act 2017, Harian Metro reported. The daily quoted a source as saying the suspect was arrested yesterday after the victim complained to her mother on July 9. 'The victim alleged that she was assaulted one evening in January in their neighbourhood when she was walking home from kindergarten. 'She said the suspect, who is known to her parents, approached her and took her around the neighbourhood in his car,' said the source. The source said this happened frequently, with the suspect luring her into his car with ice cream.
