Attorney ordered to pay R500,000 for false assault charges against colleague

An attorney's actions by laying false charges of assault against a colleague at the same law firm where she is based, causing him to spend several days in custody under harrowing conditions, will cost her R500,000.
The Gauteng High Court, Johannesburg, did not only order Sameera Malekjee to pay her colleague, Christopher Jukes, this amount in damages for defamation, but it was also directed that a copy of this judgment be sent to the Legal Practice Council.
Acting Judge Nigel Redman said: 'The defendant (Malekjee) is an attorney and an officer of this court. The defendant appears to have abused the criminal justice system for her own ends.'
The judge added that making a false and malicious complaint to the police is reprehensible.
'The defendant's conduct is of great concern and may have to be dealt with by the Legal Practice Council.'
Jukes claimed R1.5 million for the humiliation and hardship he had to endure. He is said to be a successful attorney who has been practising in Benoni for approximately 14 years. He is currently a partner of the firm Jukes Malekjee.
He told the court that in July last year, the defendant reported a case of assault with intent to do grievous bodily harm against him. In an affidavit to the SAPS, she claimed Jukes had stabbed her in the left leg the previous day.
Her allegations included that Jukes stabbed her with a glass on her 'left toe's whole toenail completely came out (sic).' She further claimed that he called her a b**** and that he threatened to shoot her. She demanded that the matter be investigated and added that he 'must face the full might of the law' (sic).
Two months prior to laying the complaint with the police, the defendant had verbally threatened to injure herself and lay a criminal charge against the plaintiff accusing him of assault. This threat was recorded by the plaintiff on his cellphone.
The complaint to the police was also preceded by WhatsApp messages being exchanged between the plaintiff and the defendant. In these messages, the defendant had threatened the plaintiff with false criminal charges and she threatened that she would take steps to ensure that he lost his licence as an attorney if he did not comply with her demands.
While she accused him of physical assault, threatening behaviour, and abuse, the plaintiff provided evidence that this did not occur. Malekjee, on the other hand, did not defend herself in court.
Resulting from the false complaint, Jukes was arrested at his offices in front of witnesses, including a candidate attorney and the owner of the neighbouring property. He was incarcerated for eight days at Modderbee Prison.
He told the court of his hardships there, where he was forced to sleep on a concrete floor without blankets, a mattress, or a pillow, and required to use an open toilet and shower in front of other prisoners.

Simelane said she was not amazed by what was happening to her because a person stands in front of a judge when charged with an offence. 'You are trying me in public because you think this is the only way to degrade the work I am doing,' she said. Simelane responded to the DA's attacks during the budget vote for her department on Wednesday. The DA, which had its former deputy minister, Andrew Whitfield, dismissed for taking a trip to the US without authorisation from President Cyril Ramaphosa, has vowed not to vote in support of the budgets of departments left by compromised ministers and deputy ministers. On Tuesday, the DA claimed that Simelane was under investigation after it laid charges with the SAPS for the alleged theft of more than R700,000 by fraudulently billing Eskom when she worked for a company named Vitrovian. Speaking during the debate, DA MP Luyolo Mphithi said the Human Settlements Department was saddled with a catastrophic collapse of governance across its several housing entities. Mphithi recalled that Simelane was previously accused of receiving a R575,600 'loan' from Gundo Wealth Solutions, linked to the unlawful investments of municipal funds into the VBS Mutual Bank, while she was the mayor of the Polokwane Municipality. Mphithi also said that although the department's budget and department have many challenges, it would under normal circumstances be supported. In 2019, three years later, she died. 'So good, you can find the nearest door to the police station. Where it matters, you don't even know where the door is,' she said. Simelane insisted that the investigation was about accountability. 'I availed myself of accountability. Now the investigation is done, and you reported the case, but you now can't wait for the investigation to conclude. I fear I am going to disappear after this. I mean really,' she said. ANC MP Albert Seabi pleaded with Simelane not to be distracted by the amount of noise, no matter how loud it may be, including an allegation not tested in court. 'You have our support minister because of your strong work ethic, your dedication, your diligence, and your consistent commitment to transparency, accountability, and transforming the sector,' said Seabi. EFF MP Babalwa Mathulelwa said they rejected the budget not because 'we are extortionists like the DA'. Mathulelwa said the rejection of the budget was based on the empty promise wrapped in inflation and false hopes. A suspected July 2021 unrest instigator believes she's being targeted for being Zuma fan
JOHANNESBURG - One of the suspected instigators of the July 2021 unrest believes she is being targeted for being a fan of former president Jacob Zuma. Bogadi Maphisa, along with four co-accused, appeared at the Roodepoort Magistrates Court on Wednesday. The group stands accused of conspiracy to incite public violence. Maphisa showed up to court on Wednesday in full uMkhonto weSizwe (MK) Party regalia – an organisation led and founded by Zuma. It was Zuma's incarceration in 2021 that led to the deadly unrest in parts of KwaZulu-Natal and Gauteng. Maphisa said that while she was angry at Zuma's imprisonment, she didn't participate in any criminal activity. 'Maybe my sin is that I am a fan of my president, Jacob Gedleyihlekisa Zuma, and I will let him go at any given moment. I know that I do not have a case. I am not guilty of anything, so they can go as far as they want to go. My conscience is clear - I didn't incite anybody to go and do anything.' The matter returns to court on 29 July for full disclosure of the charge sheet.
