Content creator fined RM1,800 for dressing and behaving like a woman in Melaka
Judge Amirrudin Abdul Latip meted out the sentence after the accused, Muhammad Hakim Noraji, 25, pleaded guilty to both charges in a case prosecuted by Syariah Deputy Public Prosecutor Ahmad Faizul Ashar on Monday (July 7).
The accused, who was unrepresented, was charged with wearing attire and behaving like a woman in a public place without reasonable justification.
The offences took place at two different locations, between midnight and 3am on June 10 at the A'Famosa building and at about 1.30am on Monday in front of the Dunia Melayu Dunia Islam building at Jalan Kota, here.
Both locations are in Banda Hilir, within the Melaka Tengah district.
The charge was framed under Section 72 of the Syariah Criminal Offences (State of Melaka) Enactment 1991, which prohibits men from behaving in a manner deemed feminine.
The offence carries a fine up to RM1,000 or a maximum of six months' imprisonment.
The court imposed a fine RM850 for the first offence, with an alternative of one month's imprisonment if he fails to pay and RM950 for the second offence.
The accused, who was unmarried, subsequently paid the fines.

The RM100,000 was for both general and aggravated damages, he said. 'The claim for exemplary damages is not allowed since there is no solid evidence to support such an award,' the judge added. Rosmah filed the lawsuit on Sept 19, 2023, seeking RM1 million in damages from the TikTok account holder for a loss of reputation over his claim. She claimed that the defendant had, six months earlier, uploaded a video on his TikTok account containing false and defamatory statements about her. The impugned statements accused her of committing sinful acts and being involved in rituals involving the devil and bomohs. They also accused her of practising polytheism. Rosmah said the statements damaged her reputation as the wife of Malaysia's sixth prime minister and a patron of various charitable organisations in the country. KUALA LUMPUR: The High Court today ordered a TikTok user to pay RM100,000 in damages to Datin Seri Rosmah Mansor for defaming her of engaging in sinful practices, devil worship, black magic rituals, and polytheism two years ago. High Court judge Datuk Ahmad Shahrir Mohd Salleh fixed the amount after finding that Rosmah, as the plaintiff, had successfully established her entitlement to damages for defamation from defendant, Ku Muhammad Hilmie Ku Din, the owner of TikTok account "CEO Hilmie Fighter." "This court finds a global award in the sum of RM100,000 constitutes a just and proportionate assessment," he said in his judgment in assessment of damages in Rosmah's defamation suit. The judge said the global award in the sum of RM100,000 comprised general and aggravated damages. "The claim for exemplary damages is not allowed as there is no cogent evidence before this court to support such an award," he said in an assessment of damages proceedings. Rosmah, the wife of former prime minister Datuk Seri Najib Razak, was represented by lawyer Datuk Abu Bakar Isa Ramat and Mohamed Baharudeen Mohamed Ariff. Ku Muhammad Hilmie was also ordered to pay RM20,000 in costs. On May 28 last year, Ahmad Shahrir granted Rosmah a judgment in default (JID) after Ku Muhammad Hilmie failed to file an appearance or defend the suit. A JID is a court ruling favouring one party due to the opposing party's failure to respond or appear in court, thus allowing the plaintiff to win by default. Rosmah had sought RM1 million damages from Ku Muhammad Hilmie in the defamatory suit initiated on Sept 19, 2023. Ahmad Shahrir said he found that the defamatory allegations levelled against Rosmah imputed her involvement in supernatural practices and associate her with spiritual entities. "These imputations constitute an attack on her character in the domains of religious integrity and moral standing. "In a societal context where religious values and moral propriety carry significant weight, such allegations assume a particular seriousness and have the potential to cause distinct reputational harm," he said. The judge said he came to the sum after considering the current judicial trend towards moderation in damages and the principle that damages are compensatory in nature and not intended to be punitive. He said although Rosmah had been convicted by the Kuala Lumpur High Court over the RM1.25 billion solar energy project for Sarawak rural schools and currently appealing at the Court of Appeal, damages in a defamation claim must be assessed without reference to that conviction. He said her conviction cannot be used as evidence of bad character for the purpose of reducing the quantum of damages. In the suit, Rosmah claimed that Ku Muhammad Hilmie uploaded a video on his TikTok account making false and defamatory statements about her. Rosmah contended that the defamatory remarks damaged her reputation as the wife of Malaysia's sixth prime minister and the patron of several charitable organisations. As a result of the defamatory statement, she said she was viewed negatively by the public, mocked and humiliated - thus tarnishing her reputation as a public figure.
