
Leasing companies allege Flair Airlines failed to make rent payments, ignored default notices
The allegations were detailed in a statement of defence and counterclaim for US$30.9 million filed in Ontario Superior Court on June 26.
In March 2023, Flair Airlines filed a $50-million lawsuit against Irish-based Airborne Capital Inc. and a trio of affiliated leasing corporations, alleging they 'secretly' found a better deal for the Boeing 737 Max aircraft with a third party and then set up Flair for default.
Flair said at the time it received no notice over the 'unlawful' seizures, which took place at airports in Toronto, Edmonton and Waterloo, Ont., precluding the airline from alerting or rebooking customers.
The airline then found itself down by more than a fifth of its 19-plane fleet, forcing it to cancel multiple flights.

'The lessors sent agents to seize the aircraft in the middle of the night as passengers were boarding planes for spring break vacations,' Flair's statement of claim said.

But Airborne Capital has said that Flair 'regularly' missed payments over the previous five months, prompting the plane seizures, and that it had been in regular contact with Flair's representatives about its obligations.

None of the allegations in Flair's lawsuit or the countersuit have been tested in court.
In new court documents, the lessors deny any breach of contract or duty to act in good faith, saying the seizures were necessary to protect the value of the aircraft.
They said the seizures took place at Canadian airports to avoid stranding passengers overseas and were timed overnight to prevent disruption during busier daytime hours.

'Flair's action is an attempt to recover self-inflicted losses arising from its own defaults,' the countersuit stated.
'For months, Flair failed to make rent and other payments when due under the leases. It ignored repeated default notices in which the lessors expressly reserved their rights and remedies under the leases, including to terminate the leasing of the aircraft and repossess the aircraft.'
The leasing companies said they 'repeatedly advised that the continuing arrears were unacceptable.'
They also denied that the seizures were related to a more profitable deal with a third-party.
'In fact, it took the defendants several months and significant cost … to re-market and restore the aircraft to a suitable condition before they could be re-leased or sold,' the document stated.
'Two aircraft required major repairs because one or more of their engines were unserviceable due to defects uncovered post recovery from Flair.'
In a statement, Flair CEO Maciej Wilk called the counterclaim a 'predictable response' to Flair's lawsuit.
'The company does not comment on active litigation, but would like to point out that the claims in question relate to events that occurred over two years ago,' Wilk said.
'Flair continues to maintain and cultivate productive and positive relationships with all of its stakeholders, including its customers, lessors and other industry partners and remains focused on executing its strategy and commitment to be Canada's most reliable and affordable airline.'

Japan to Import Canadian LNG in Bid to Diversify Energy Supply

Mitsubishi Corporation is preparing to begin importing liquefied natural gas (LNG) from Canada. These shipments will be primarily destined for the Japanese market. This will be the first major delivery of Canadian LNG to Japan, which currently depends on Australia and Malaysia for over half of its LNG imports. With limited domestic energy resources, Japan has been actively working to diversify its LNG supply. Australia, its largest supplier, is projected to face production declines in the coming years. This highlights the need for more stable and reliable sources. Canadian LNG, backed by geographic proximity and political stability, presents a strong alternative. It could play a key role in strengthening Japan's energy security. LNG is natural gas that has been cooled to a liquid state, reducing its volume to about one-600th and making it much easier to transport by sea. Japan does produce some natural gas domestically, mainly in areas like Niigata and Chiba, but this supply falls far short of meeting national demand. Like oil, Japan relies almost entirely on imports for its natural gas. With delays in restarting nuclear power plants, Japan remains heavily dependent on thermal power, which generates around 70% of the country's electricity. Gas-fired power plants are the largest contributors. Compared to other fossil fuels, natural gas produces less CO₂, making it a relatively cleaner option. Because of its key role in electricity generation, any disruption in LNG supply could have serious consequences for the economy and daily life. (File photo) The new LNG supply will come from the LNG Canada project in British Columbia, a facility developed with investment from Mitsubishi Corporation, Shell, and other partners. Natural gas is extracted inland and transported via a 670-kilometer pipeline to the coast. There, it is liquefied and shipped overseas by tanker. The project represents a total investment of about $14 billion USD and has an annual production capacity of 14 million tons. Mitsubishi holds a 15% stake, giving it rights to around 2.1 million tons per year. If all of that were exported to Japan, it would cover roughly a quarter of the country's projected increase in LNG demand. Mitsubishi was the first major Japanese trading company to enter the LNG business, beginning in the 1960s. Today, it is involved in LNG projects across more than 10 countries. With the addition of Canadian supply, Mitsubishi's annual LNG production capacity has grown to around 15 million tons, the largest among Japanese companies. Katsumi Saito, Senior Executive Officer overseeing the fuel business and related operations, commented, "Our strength lies in the knowledge and development capabilities built on more than 50 years of experience." One of the key advantages of Canadian LNG is proximity. Shipping LNG from Canada's west coast to Japan takes about 10 days — much shorter than the roughly 30 days required from the US Gulf Coast via the Panama Canal. That route can take even longer when canal traffic is restricted by drought. Other shipping routes, such as around the Cape of Good Hope in South Africa, can take up to 60 days. LNG from the Middle East typically takes about 16 days. In contrast, Canadian LNG avoids major chokepoints like the Strait of Hormuz, offering more stable and reliable delivery. Canada also has vast natural gas reserves — enough to meet Japan's current annual LNG demand for about 25 years. Its cold climate makes the liquefaction process more energy-efficient. Canadian LNG has a higher heat content than LNG from the United States. On top of that, there is strong political support in Canada for energy exports, ensuring long-term policy stability. As of fiscal 2024, Australia supplies 38% of Japan's LNG. Although shipping times from Australia are similar to those from Canada, slower gas field development — driven by climate change policies — has raised concerns about future supply. To reduce risks, Japan has also prioritized LNG imports from the United States, Qatar, which has massive reserves, and Russia. The US has significantly increased its LNG exports in recent years. Qatar, however, faces geopolitical risks, especially due to tensions with Iran. Japan continues to import LNG from Russia, but new projects have been put on hold under US sanctions. For instance, Japanese trading firms like Mitsui & Co are currently unable to engage with Russia's Arctic LNG 2 project. Japan's electricity demand is expected to grow as the number of data centers increases, driven by the expansion of artificial intelligence technologies. If decarbonization efforts do not progress, the government estimates LNG imports could rise by 12% by 2040, reaching about 74 million tons. The LNG Canada project marks the first new LNG venture involving Japanese companies in around six years. With global instability highlighting the need for stronger supply chains, Canada's role as a new supplier is a major win for Japan. Sutskever steps in at SSI after Meta poaches CEO Daniel Gross
PALO ALTO/TEL AVIV: The battle for top AI talent has claimed another high-profile casualty—this time at Safe Superintelligence (SSI), where co-founder Ilya Sutskever has stepped in to lead the company following the exit of CEO Daniel Gross to Meta. Gross, a noted entrepreneur and investor, has joined Meta Platforms to head its AI products division, sources told Reuters. His departure adds fuel to an escalating recruitment war among tech giants eager to dominate the next era of artificial intelligence. Meta had also attempted to recruit Sutskever and acquire SSI, which was last valued at US$32 billion, according to people familiar with the matter. "You might have heard rumors of companies looking to acquire us. We are flattered by their attention but are focused on seeing our work through," Sutskever said in a post on X. Founded last year, SSI aims to develop advanced AI systems that safely surpass human intelligence. The company raised $1 billion in cash to fund its mission and has positioned itself as a key player in the safe AI space. Sheraton Vancouver Guildford workers on strike for fair wages
SURREY, BC, July 5, 2025 /CNW/ - More than 140 hotel workers at the Sheraton Vancouver Guildford hotel began strike action today after failing to reach a fair collective agreement with their employer. "Our members deserve better and are trying to catch up," said Unifor National President Lana Payne. "These workers kept the doors open during some of the most challenging years in hospitality. Now, they're standing together to demand better wages in the face of a skyrocketing cost of living in the Lower Mainland. This strike is about fairness, respect, and economic justice." Unifor Local 3000 members at the Sheraton Vancouver Guildford have been without a contract since April 2024. After more than a year of bargaining, workers voted to reject a tentative agreement and began legal strike action at 5:30 p.m. Pacific on July 5,2025. "This hotel runs because of our members—and they're done waiting for a fair deal," said Unifor Western Regional Director Gavin McGarrigle. "They're taking a stand not just for themselves, but for all hospitality workers who deserve better pay and respect on the job." The Sheraton Vancouver Guildford is owned by Pacific Reach Properties, a Vancouver-based investment firm with holdings in real estate, hospitality, healthcare, and tech. The company outsources its labour negotiations to Hospitality Industrial Relations (HIR), a third-party group that bargains on behalf of hotel operators across the province. "Wages at this hotel have flatlined while rent, groceries, and gas have soared," said Adrian Burnett, President of Unifor Local 3000. "Our members are scraping by while a wealthy ownership group tries to nickel-and-dime them. This strike is the direct result of that imbalance." Unifor Local 3000 represents 120 full-time and 24 part-time workers at the hotel, including room attendants, front desk staff, banquet servers, kitchen workers, and maintenance workers. The union says it remains open to productive talks but warns the strike will continue until a fair deal is on the table. Unifor is Canada's largest union in the private sector, representing 320,000 workers in every major area of the economy. The union advocates for all working people and their rights, fights for equality and social justice in Canada and abroad, and strives to create progressive change for a better future.
