'RCB created nuisance, cops not magicians': CAT cancels IPS officer's suspension in Bengaluru stampede case

The Central Administrative Tribunal (CAT) on Tuesday, July 1, cancelled the Karnataka government's suspension order against Additional Commissioner of Police Vikash Kumar Vikash, saying the cops are not magicians and neither they have Alladin ka Chirag (Alladin's magic lamp). The IPS officer was suspended in the wake of the Bengaluru stampede case in early June.
The Bengaluru bench of the tribunal comprising Justice BK Shrivastava and administrative member Santhosh Mehra, had reserved its verdict on June 24.
The tribunal noted that the sufficient time should have been given to the police personnel to make arrangements for the Royal Challengers Bengaluru (RCB) victory parade in Bengaluru, blaming the franchise for 'creating the nuisance'.
'Prima facie it appears that the RCB is responsible for the gathering of about three to five lakh people. The RCB did not take the appropriate permission or consent from the Police. Suddenly, they posted on social media platforms and as a result of aforesaid information the public were gathered.'
The CAT said, 'It cannot expected from the Police that within a short time of about 12 hours the Police will make all arrangements required in the Police Act or in the other rules.'
'Police personnel are also human beings. They are neither 'God' nor Magician and also not having the magic powers like 'Alladdin ka Chirag' which was able to fulfil any wish only by rubbing a finger . To control the aforesaid type of gathering and for making the proper arrangements sufficient time should be given to the Police,' the tribunal said.
It further added, 'But neither the information was given to the Police for making the arrangements nor the permission was applied or granted by the Police. The KSCA submitted a letter which also did not contain any request for granting the permission or for making the arrangements. The letter shows only the information regarding the intention. Therefore, it was not expected from the Police that upon the basis of letter submitted before the Station In-charge of one Police Station, the Police will make all arrangements all of a sudden.'
IPS officer Vikash Kumar Vikash was suspended who later moved the CAT challenging his suspension.
The tragic stampede incident on June 4 in front of M Chinnaswamy stadium claimed the lives of 11 people.
After the CAT order, Vikash Kumar Vikash's counsel, senior advocate Dhyan Chinappa, said, 'The tribunal has allowed the petition and annulled the suspension, affirming that he is entitled to all benefits as per service rules.'
'The Police officers have been suspended without any sufficient material or grounds. Hence, the aforesaid order is liable to be quashed,' the order said.
'We allow the present petition, and quash the order dated June 4, in relation to the suspension of Vikash Kumar Vikash, (IPS, Inspector General & Additional Commissioner of Police, West, Bengaluru City).' It then directed the government to reinstate the applicant immediately and said the period of suspension shall be treated as duty with full pay and allowances.

Agency: Chandigarh, Jul 24 (PTI) Haryana Police made thorough security arrangements across the state to ensure that the Common Eligibility Test (CET) examination to be held on Saturday and Sunday is conducted peacefully and transparently. According to an official statement issued on Thursday, Director General of Police Shatrujeet Kapur has issued necessary instructions to senior police officers in all district for the fair conduct of CET. On the day of the examination, prohibitory orders under Section 163 (power to issue orders in urgent cases of nuisance or apprehended danger) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 will be imposed and enforced within a 500 metre radius of all examination centres. All district police chiefs will inspect the centres a day prior to the exam along with the respective deputy commissioners and will personally patrol on the day of the exam to ensure that the recruitment examination is conducted fairly and without any disruptions, it said. The state government has directed the deputy commissioners to appoint an adequate number of duty magistrates for the exam. Haryana Police said a large number of candidates will arrive at the respective stations by train or bus the evening before the exam and then travel via auto-rickshaws and taxis to hotels and lodges near the examination centres. Additional traffic duties have been directed to be deployed to avoid disorder due to the crowd. Kapur has also directed the district police to establish checkpoints and inspect all suspicious vehicles arriving from outside the city starting from the evening before the exam. This activity will continue until the completion of the examination. The concerned officers have been instructed to ensure that only authorised persons are allowed entry into the examination centres. Invigilators inside the examination halls will not be allowed to carry mobile phones or electronic gadgets. No vehicles will be allowed to park within a 200 metre radius of the examination centres and on the day of the exam, photocopy and printing shops near the centres have been ordered to remain closed. During the examination, the district police will communicate exclusively through local wireless networks, as per instructions to the police. Meanwhile, the DGP has appealed to the citizens of the state, candidates, and their guardians to cooperate with the police and immediately report any suspicious activity by dialling '112' emergency helpline or the local police. He assured that Haryana Police is fully committed to ensuring that CET-2025 is conducted in a fair and peaceful manner. On Tuesday, Haryana Chief Minister Nayab Singh Saini had conducted a review of arrangements for the CET examination. The exams are to be conducted for the 'Group-C" posts recruitment under the Haryana Staff Selection Commission (HSSC). Saini had appealed to the general public 'to avoid unnecessary travel on July 26 and 27, the days of the CET examination, in order to maintain a smooth and uninterrupted traffic system, thereby facilitating hassle-free movement for the candidates." The chief minister had been informed by the officials during the meeting on Tuesday that approximately 13.48 lakh candidates are eligible to appear in the examination this year and a total of 834 examination centres have been set up across the state. Bengaluru, Jul 24 (PTI) The mother of a 14-year-old girl who died in the June 4 stampede near Chinnaswamy Stadium during the RCB victory celebrations has filed a police complaint, alleging that her daughter's belongings, including a pair of gold earrings, were stolen during the post-mortem. Speaking to reporters after lodging the complaint on Thursday, Ashwini, mother of the deceased girl Divyanshi, said the earrings—gifted by the family—had deep emotional value and were missing when her daughter's body was returned after the autopsy. The complaint was filed with the Commercial Street Police station in the city. 'She (Divyanshi) did not remove them for one year. They were gifted by our family. The earrings hold deep emotional value and I wanted to save those earrings as a keepsake," Ashwini said. The woman alleged that despite approaching hospital authorities, including the dean, and visiting multiple police stations in the days following her daughter's death, she received no proper response. 'We tried filing a complaint with another police station, the hospital, and we had met the dean and others. They have agreed that the theft happened, but they didn't hand them over. It's not about the value of the earrings. We hold them dear as she was very fond of them," she said. Commercial Street Police said a case has been registered under Section 303(2) of the Bharatiya Nyaya Sanhita, which pertains to theft. 'We are in the process of investigating the allegations," a police official told PTI. The stampede on June 4 near Chinnaswamy Stadium claimed 11 lives and left several injured. The incident occurred during a victory parade organised by the Royal Challengers Bengaluru franchise after their successful IPL campaign, when a massive crowd gathered outside the venue, leading to a stampede.
