
'RCB created nuisance, cops not magicians': CAT cancels IPS officer's suspension in Bengaluru stampede case
The Bengaluru bench of the tribunal comprising Justice BK Shrivastava and administrative member Santhosh Mehra, had reserved its verdict on June 24.
The tribunal noted that the sufficient time should have been given to the police personnel to make arrangements for the Royal Challengers Bengaluru (RCB) victory parade in Bengaluru, blaming the franchise for 'creating the nuisance'.
'Prima facie it appears that the RCB is responsible for the gathering of about three to five lakh people. The RCB did not take the appropriate permission or consent from the Police. Suddenly, they posted on social media platforms and as a result of aforesaid information the public were gathered.'
The CAT said, 'It cannot expected from the Police that within a short time of about 12 hours the Police will make all arrangements required in the Police Act or in the other rules.'
'Police personnel are also human beings. They are neither 'God' nor Magician and also not having the magic powers like 'Alladdin ka Chirag' which was able to fulfil any wish only by rubbing a finger . To control the aforesaid type of gathering and for making the proper arrangements sufficient time should be given to the Police,' the tribunal said.
It further added, 'But neither the information was given to the Police for making the arrangements nor the permission was applied or granted by the Police. The KSCA submitted a letter which also did not contain any request for granting the permission or for making the arrangements. The letter shows only the information regarding the intention. Therefore, it was not expected from the Police that upon the basis of letter submitted before the Station In-charge of one Police Station, the Police will make all arrangements all of a sudden.'
IPS officer Vikash Kumar Vikash was suspended who later moved the CAT challenging his suspension.
The tragic stampede incident on June 4 in front of M Chinnaswamy stadium claimed the lives of 11 people.
After the CAT order, Vikash Kumar Vikash's counsel, senior advocate Dhyan Chinappa, said, 'The tribunal has allowed the petition and annulled the suspension, affirming that he is entitled to all benefits as per service rules.'
'The Police officers have been suspended without any sufficient material or grounds. Hence, the aforesaid order is liable to be quashed,' the order said.
'We allow the present petition, and quash the order dated June 4, in relation to the suspension of Vikash Kumar Vikash, (IPS, Inspector General & Additional Commissioner of Police, West, Bengaluru City).' It then directed the government to reinstate the applicant immediately and said the period of suspension shall be treated as duty with full pay and allowances.

Women villagers on outskirts of Bengaluru seek police help over liquor shop menace
Villagers of Rajaghatta, especially women, raised concerns over what they called rampant sale of liquor, and claimed that it is destroying families by pushing their husbands into addiction and joblessness. Even grocery and vegetable shops have started stocking up liquor, making them accessible round the clock,' she said. Mr. Baba summoned the excise department officials to ensure that the liquor shops should adhere to the time specified in the licensing condition. The department and the jurisdictional police have also been asked to conduct regular checks on the illegal sale of liquor at the shops. Meanwhile, a few students present at the meeting complained of being humiliated at schools as they were ridiculed by their friends and classmates for their caste. 'We were mocked and called casteist names. The teachers and village elders are not doing anything despite being aware of this situation,' a student told senior police officers. Taking strong objection, Mr. Baba asked the Panchayat Development officer, and officials of the education department present at the meeting to take immediate action and ensure such practices are not repeated. The police later visited Dalit colonies and pasted stickers containing the names and numbers of police officers to be contacted in any eventuality with the intention of instilling confidence among the general public that the police are at their service. Mr. Baba, along with other officials also had lunch with the villagers. The villagers were urged to help the police force in fighting crime and maintaining law and order.

The accused has been identified as Chandra Prakash (47), who worked as a driver at the same farmhouse, and was arrested from Palam in southwest Delhi, he said. Police reported that a missing person complaint was filed at Mehrauli Police Station on July 26 for Sita Ram, a native of Uttar Pradesh. News agency PTI quoted Deputy Commissioner of Police (South) Ankit Chauhan as saying in a statement, 'Sita Ram had been a domestic worker at a private farmhouse in Chhattarpur for the past 10 years and was staying alone at the premises because the owner was out of town." The authorities were alerted when domestic staff discovered that the main doors of the farmhouse were open and Sita Ram was missing. After receiving the complaint, a team from the Mehrauli Police Station initiated a search operation. During this search, his body was found in the septic tank located within the farmhouse, said the DCP. The crime and forensic teams were immediately called to the scene, and the body was sent for post-mortem examination. 'Based on initial findings, a case was registered on Sunday under Sections 103(1) (murder) and 238(a) (causing disappearance of evidence) of the Bharatiya Nyaya Sanhita (BNS) at Mehrauli," said the officer. The investigation team started reviewing CCTV footage, mobile data records, and statements from other workers. During the investigation, it was discovered that Chandra Prakash, the farmhouse owner's driver of seven years, was missing from the scene. The officer said, 'Using technical surveillance and tips from local sources, police tracked Chandra Prakash's location to Palam in Delhi, where he was apprehended." Upon sustained interrogation, Chandra Prakash confessed to the crime. 'He disclosed that he had requested Rs 10,000 from Sita Ram, but when the latter refused, a heated argument broke out between the two. In a fit of rage, he picked up a hammer and struck Sita Ram on the head, killing him," said the officer, adding that to hide the crime, the accused dumped the body into the septic tank and fled the scene. The murder weapon was recovered from the premises based on Chandra Prakash's confession, and the investigation is ongoing to determine if others were involved or had prior knowledge of the incident. Chandra Prakash, a native of Pantgaon village in Almora district, Uttarakhand, lived in Chhattarpur and worked as a driver at the farmhouse. Several locals expressed their shock at his death, recalling Sita Ram as a helpful man with a good nature. 'I work in another farmhouse and I have known Sita Ram for the last two years. He was a good man and was very helpful," a local worker said. He claimed that Chandra Prakash initially told the farmhouse owner about Sita Ram's disappearance, leading the owner to contact the police. Pune ‘drug party' raid: CM Fadnavis' first reaction as ex-minister Eknath Khadse's son-in-law among 7 held
In first comments after former Maharashtra minister Eknath Khadse's son-in-law was arrested after Pune Police busted a rave party on Sunday, Chief Minister Devendra Fadnavis said that although it appears that a crime was committed, he will only be able to talk more about it after he receives a proper briefing. According to a PTI report, police arrested seven persons after busting a "drug party" following a raid at an apartment in Pune early on Sunday and seized narcotics, hookah set ups and liquor, officials said. Pranjal Khewalkar, the husband of former Maharashtra minister Eknath Khadse's daughter Rohini Khadse, was among those arrested, they said. Rohini Khadse is state president of the women's wing of the opposition NCP (SP). Reacting to the arrest, CM Fadnavis said, 'Even I saw it only in the media. I've been attending programmes since morning, so I haven't received an actual briefing on it yet. Based on what is being shown in the media, the police have busted a rave party, and some people have been found there. Drugs were reportedly found.' 'Once I receive a proper briefing, I will be able to comment on it. Prima facie, it appears that a crime has taken place at that location,' the CM was quoted by ANI as saying. The police's Crime Branch carried out the raid at the studio apartment located in the upscale Kharadi area of Maharashtra's Pune city based on a tip-off about a rave party, an official told PTI. The raid was conducted around 3.30 am on Sunday and a 'drug party' was busted at the studio apartment, Deputy Commissioner of Police (Crime) Nikhil Pingle said at a press conference in Pune. During the raid and subsequent search, police seized 2.7 grams of cocaine-like substance, 70 gm of a ganja-like substance, a hookah pot, various hookah flavours, and liquor, and beer bottles, Pingle said. "We have arrested seven individuals, identified as Pranjal Khewalkar, Nikhil Poptani, Sameer Sayyad, Shripad Yadav, Sachin Bhombe, Isha Singh and Prachi Sharma, under relevant sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act," he said. All the accused were sent for medical examination and their reports are awaited, the official said. Reacting to the raid, Eknath Khadse said it should be probed if there was a political motive behind the police action. Shiv Sena (UBT) deputy leader Sushma Andhare said the raid is a message for those speaking against the government. (With inputs from agencies)
