The Madhya Pradesh High Court has commuted the death sentence awarded by a trial court to a man convicted of raping a four-year-old minor girl.
A division bench, comprising Justices Vivek Agarwal and Devnarayan Mishra, observed in their order on June 19, 'No doubt that appellant's act was brutal as he has committed rape upon the victim of four years and three months of age and after committing rape also throttled her treating her dead and thrown the victim in such a place where she could not be searched and left the spot but it is also clear that he has not committed brutality.'
According to the prosecution, the convict entered the complainant's hut and requested a cot to sleep on. Later that night, he allegedly opened the gate of a nearby house where the victim and her parents was staying, abducted and raped her. Thereafter, he allegedly left the child in an unconscious state in a mango orchard, believing her to be dead.
The High Court was hearing a criminal appeal filed by the convict against a trial court judgment which found him guilty under Section 307 of the Indian Penal Code and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).
The high court acknowledged that the aggravating circumstance of this case was the age of the victim and the convict. The bench stated, 'There are aggravating circumstances that the victim was four years old and the rape was committed upon such a kid and offence was committed in such a way that the private part of the victim was torn and after committing the offence, the victim was thrown in the solitary place treating her that she had died.'
However, the bench also took note of the fact that the convict, aged 20, is uneducated and belongs to the tribal community and his parents never tried to give him education and did not take proper care of him. Therefore, he left his house and was earning, living and working in a restaurant, the court said.

The Telangana government has filed a legal note to reopen the Rohith Vemula suicide case, state's deputy Chief Minister Mallu Bhatti Vikramarka said. 'We have already filed a note in the High Court asking the court to give direction to reopen the case. And we will not leave anybody involved in the case,' Vikramarka said. He was speaking in a press meet held at the All India Congress Committee (AICC) office in New Delhi on the appointment of Ramchander Rao as Telangana BJP president. Rao, an MLC then, was one of the accused named in the Rohith Vemula suicide case. 'It (the appointment) shows that whoever goes against Adivasis and whoever goes against Dalits will be rewarded by the BJP,' Vikramarka alleged. 'The BJP has to apologise to the nation. Is targeting Dalits the qualification for you (BJP) to appoint as president,' he sought to know. Rohith Vemula, who identified as a Dalit, a research scholar in University of Hyderabad, died by suicide 2016, leadings to country-wide protests against caste discrimination in higher educational institutions. Shortly after his demise, a case of abetment of suicide and charges under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, was filed against the then Vice Chancellor Apparao Podile, then Union minister Bandaru Dattatreya, then MLC N Ramchander Rao, and then university students Krishna Chaitanya, N Susheel Kumar and N Diwakar. Eight years after his demise, in May 2024, Telangana police filed a closure report in the case absolving all the accused in the case. The closure report also said that Rohith Vemula was not a Dalit but an OBC. The deputy chief minister also said that on the call given by Rahul Gandhi, Telangana government will enact Rohith Vemula Act meant to curb discrimination in educational institutions. 'We are on the job and we have given it to the legal department to vet it properly and thoroughly so that it will not face any sort of (legal) challenge in the future,' Vikramarka said. Calling Rohith Vemula's suicide an institutional murder, Vikramarka added, 'A youngster, who had reached the level of PhD… A youngster who had dreams of living and leading a colourful life had gone to the extent of taking a decision of ending his life. Just think, why are these kinds of things driving them to take the extreme step? Is it not an institutional murder?'

Govt orders attachment of properties in liquor scam probe

Vijayawada: Andhra Pradesh govt has ordered the attachment of properties and bank accounts linked to Adan Distilleries Pvt Ltd and Leela Distillery Pvt Ltd, as part of an ongoing investigation into alleged irregularities in the implementation of the state's excise policy between 2019 and 2024. The orders were issued under the Criminal Law Amendment Ordinance, 1944, based on findings by the crime investigation department (CID). The total value of attached properties is estimated to be around Rs 33 crore. According to the govt order issued on Friday, the CID registered a case under multiple sections of the Indian Penal Code and the Prevention of Corruption Act, citing serious offences including criminal breach of trust, cheating, conspiracy, and corruption. The probe revealed a nexus involving govt officials and private entities allegedly manipulating the issuance of order for supply (OFS) licences, inflating liquor prices, and receiving commissions and kickbacks from distilleries. The investigation further revealed a money trail involving significant transfers. Adan Distilleries allegedly transferred Rs 5 crore each to Arroyo Services Pvt Ltd and Ezyload Network Pvt Ltd, which in turn transferred these funds to Phoenix Spaces Pvt Ltd under the direction of T Eswar Kiran Kumar Reddy, reportedly acting under instructions from Raj Kasireddy. In another major transaction, Rs 20 crore was allegedly transferred from Adan Distilleries to Phoenix Infrastructure Pvt Ltd for commercial property in Phoenix Trivium in Hafeezpet, Hyderabad. Investigators assert that these transactions were part of a larger operation to divert illegally acquired funds from state-sanctioned liquor operations. ‘Mane Manege Police' campaign starts in Udupi

Udupi: The innovative campaign, as per the govt circular, 'Mane Manege Police', was officially inaugurated on Friday by principal district and sessions judge Kiran Siddappa Gangannavar. The department aims to build confidence among people and address grievances faced by them through the campaign. The judge inaugurated the programme, wishing that police services reach every home and that the teams' efforts be successful. Familiarising themselves with the 27-point circular issued by the govt, they launched the campaign on Friday at Udupi sub-division's Udupi Town station as well as Manipal, Brahmavar, and Kota stations. During the campaign, the public was made aware of topics such as cybercrime, narcotics, drugs, juvenile offences, the Pocso Act, home theft, chain snatching, and traffic rules. The names and mobile numbers of household members were collected. Complaints, grievances, and requests from the public were received during the campaign.
