Karnataka HC dismisses PhonePe's plea against police notice, says privacy not a shield against lawful investigation

Noting that 'confidentiality must coexist with accountability', the Karnataka High Court recently dismissed a petition by PhonePe Private Limited against a police notice issued to the financial service company in connection with the investigation in a 2022 online sports betting case.
'The submissions of the petitioner's counsel that information that is to be kept confidential need not be divulged, cannot be accepted. The protection of consumer privacy cannot eclipse the lawful imperative of investigating officers to secure evidence and take the investigation to its logical conclusion,' said a single-judge bench of Justice M Nagaprasanna in the order dated April 29.
The police issued the notice on December 7, 2022, to PhonePe to provide details based on a complaint from a resident of the Chikkamagaluru district, who alleged that he lost funds while transacting through several payment gateways for cricket betting. The notice under the Criminal Procedure Code (CrPC) directed PhonePe to furnish transaction details of certain users.
PhonePe's counsel argued that the company is merely an intermediary under the IT Act and that neither the company nor its employees are implicated in the case. The counsel further said the Bankers' Books Evidence Act and the Payment and Settlement Systems Act prohibit the company from disclosing information. The company contended that the investigating officer cannot summon documents or information through a notice without a directive from a court.
The bench observed that as per Section 87 of the Information Technology (IT) Act, information would have to be given within 72 hours of the notice from an investigating officer. Citing previous judgments of the high courts of Kerala, Madras, and Bombay, it observed that the laws cited by PhonePe would not be stretched to immunise an institution from investigation.
'The duty to protect data must yield, where public interest and criminal investigation intersect,' the court noted.
'Conventional crimes have receded, and new age crimes have sprung in large numbers. The new age crimes are cyber crimes – the clandestine modern offences… while privacy as contended by the petitioner should be maintained, it cannot be wielded as a shield against lawful investigation,' the court added, while rejecting PhonePe's plea.

Continuing its crackdown on cyber criminals, the Uttar Pradesh Special Task Force (STF) has arrested two members of a notorious gang involved in digital arrest and cyber fraud. The accused, identified as Muhammad Iqbal Balasahib (47) and Shain Iqbal Balasahib (42), were arrested from a flat in a residential building on Mira Road, in Maharashtra's Thane district on Sunday and were brought to Lucknow for investigation, officials said. (For representation) Describing the gang's modus operandi, a senior STF official said the duo impersonated police and narcotics officers, using WhatsApp calls and video conferencing to deceive victims. They would allege that the victim's name was linked to illegal activities and demand money to settle the matter. In one such case, they defrauded a Lucknow resident, Dr BN Singh, of ₹95 lakh. An FIR was lodged at the local cyber crime police station in April. According to a press note shared with the media, the STF's cyber team, led by additional superintendent of police (ASP) Vishal Vikram Singh, tracked down the accused after analysing technical evidence and receiving tips from informants. The release stated that the team raided the suspects' flat in Mira Road and seized two laptops, three mobile phones, seven pen drives, three hard disks, six ATM cards, two Aadhaar cards, two computer mice, and a laptop charger, along with ₹450. Officials said the STF is now examining the seized electronic devices and probing the accused's bank accounts and digital wallets. Efforts are underway to apprehend other members of the gang. The accused have been charged under various sections of the Bharatiya Nyaya Sanhita and the IT Act. They are currently in custody, having been brought to Lucknow on transit remand.

Gaya: The health department has clarified that the ambulance driver and technician accused of raping a home guard job aspirant in Gaya are not its regular employees but were hired through a private agency. The alleged incident took place on July 24 when the woman was raped inside a slow-moving ambulance between the Bihar Military Police (BMP) ground and Anugrah Narayan Magadh Medical College Hospital. Speaking to reporters, Gaya civil surgeon Dr Raja Ram Prasad said, "Both the driver and the technician are not regular employees of the health department. Their recruitment was done by a private agency engaged at the state level. Therefore, the question of departmental action against them does not arise." When asked whether background checks had been conducted before the duo were deployed, the civil surgeon said, "It is for the agency to explain." On the medical report of the survivor, Bodh Gaya SDPO Saurav Jaiswal said it was expected to be made available soon. Public sector Indian Bank has received approval from the board to raise Rs 5,000 crore during the financial year, a top official has said. The Chennai-headquartered bank reported a capital adequacy ratio of 17.80 per cent for the April-June 2025 quarter, the bank's Managing Director and CEO Binod Kumar said. "Approval is there. We have to raise Rs 5,000 crore. Not QIP (Qualified Institutional Placement) or by any other instruments. But, I do not think it (fund raise) will be required (immediately). 17.8 per cent (of Capital Adequacy Ratio) is there.., " he told PTI in a brief the April-June 2025 quarter, the Capital Adequacy Ratio of the bank rose to 17.80 per cent from 16.47 per cent recorded in the same quarter of last financial the fund raising plan, the bank is betting big on its UPI related payments proposal, as it is currently working on developing an IND-UPI application, similar to the services provided by PhonePe, GPay or PayTM. Through such an initiative, the bank would be able to save about Rs 150 crore every Kumar said the bank is developing its own UPI app named 'IND-UPI', a UPI-based payment solution similar to the current PhonePe, GPay or PayTM services."Right now, our customers are using other UPI apps and we (Indian Bank) have to pay them a fee. But in this April-June 2025 quarter itself, we have recovered Rs 2,059 crore. It is a good one". The total income of the bank grew to Rs 18,721 crore during the April-June 2025 quarter from Rs 16,945 crore registered in the corresponding quarter of last financial year. PTI
