NPA requests court clarification on Timothy Omotoso's acquittal

The National Prosecuting Authority (NPA) on Monday asked the Eastern Cape High Court, sitting in Gqeberha, to clarify its judgment in which Nigerian pastor and televangelist Timothy Omotoso and his co-accused were acquitted of 30 charges, which include rape and human trafficking.
Judge Irma Schoeman, who had acquitted the accused as she found that the State did not prove its case beyond a reasonable doubt, was told by the prosecuting authority that it was not clear on which facts her acquittal was based.
She was told that the NPA needed to be clear as it must base its appeal to the Supreme Court of Appeal on questions of law under the Criminal Procedure Act, which arose during the trial.
This is the only basis on which the State can appeal the judgment under South African law.

The prosecution told the judge that they had to be clear on the facts, as contained in her judgment.
This prompted Judge Schoeman to respond: 'So, you first want to clarify the judgment and then find a question of law.'
Counsel for the State responded that, 'with respect,' it is not clear upon reading the judgment what the factual findings are.
The judge was told that the State is not asking her to alter or revisit her judgment in any way, only to clarify it.
It said the fact stands that the accused are acquitted, and the State cannot run away from it. All it wants is to link questions in law to the factual findings of the court.
The defence, however, accused the State of being on a fishing expedition.
Omotoso's lawyer, Peter Daubermann, asked the judge not to even entertain this application, as it is defective in law.
He said the judgment is not unclear, as the acquittal is based on the fact that the State did not prove its case.
Daubermann further argued that if the court ruled in favour of the State, it would set a dangerous precedent. He said this would mean that an accused would never know if a judgment is final.
He also pointed out that while the State claims to want this clarification with the aim of turning to the SCA to appeal the judgment, no application for leave to appeal has been made to date.
He pointed out that the State had 21 days in which to note its intention to appeal, yet it has been about 90 days since the judgment was delivered.
Judge Schoeman, meanwhile, indicated that she will deliver her judgment on the State's request for clarification next week.
Omotoso left South Africa in May for Lagos, Nigeria, marking the end of a drawn-out legal process that lasted nearly a decade.

Beare allegedly stabbed Halima Hoosen-Preston to death. He also faces two counts of attempted murder against Hoosen-Preston's husband, Shaun, and their 18-year-old son, Adam. On June 2, 2024, he allegedly stormed into the Preston home and attacked Halima, stabbing her 15 times in front of her family in the Glenmore area. Advertisement Next Stay Close ✕ Ad loading As Beare made a brief appearance in court, State senior prosecutor, Calvin Govender, told the court that a medical report from Fort Napier Psychiatric Hospital said Beare would not be able to follow court proceedings and instruct his attorney. Govender added that Beare had been declared unfit to stand trial. He said he would be discussing the report with the Director of Public Prosecutions. Additionally, Govender requested that the matter be referred to the regional court for an inquiry. 'From the available information, the accused was unable to appreciate the wrongfulness of his actions at the time of the alleged offence,' read the report. According to the report, Beare was admitted to this hospital on March 15, 2025, for mental evaluation. He was examined by two State psychiatrists, Dr S Shain and Dr S. V Moodley. During his stay at Fort Napier, Beare had psychiatric interviews, physical and neurological examinations, and a urine multi-drug screening. 'Throughout he was under constant observation by the psychiatric nursing staff,' the report stated. Additionally, the report also revealed that Beare has a tertiary degree and is divorced. Beare has been in custody since his arrest in 2024 and has not applied for bail as he has been waiting for his mental evaluation. His mental state became a point of contention following a State district surgeon's finding that he was fit to stand trial. At the time, his defence challenged this report in an application made in the court, on the basis that the accused had been a psychiatric patient for more than five years, adding that he was not fit to stand trial. The matter was postponed to August 15.

Wolwespruit wetland secured, illegal squatters evicted
Relief has set in for residents of Erasmuskloof, Moreleta Park, Mooikloof and surrounding suburbs as the metro managed to finally relocate scores of squatters who have occupied the Wolwespruit wetland on the corner of Solomon Mahlangu Drive and Delmas Road. The squatters who for years made the wetland their home were resettled and removed from the property on July 13, according to Ward 83 councillor Andrew Lesch. The land where the camp was situated is within a flood line and not suited for human settlements, as there is a stream of water that runs through the area. It was illegally occupied by South African residents and foreign nationals from Lesotho and Zimbabwe, who have indicated that the area is convenient for waste sorting and close to their workplace. For years, the removal of the land invaders had involved a drawn-out legal process, with human rights lawyers blocking every attempt of the city and the residents to evict the squatters. Lesch said the occupation of the wetland has been a major source of concern for many years, but the number of people increased while efforts were made to evict them. 'For years, the community and business in this area suffered several power outages due to cable theft, increased crime, smoke pollution and pollution due to noise and illegal recycling,' he explained. He said some of the people in the informal settlement were involved in crime. 'We also experienced several cases of illegal dumping by people and even some local businesses. Previous attempts at eviction and/or resettlement were met by objections and court interdicts. Now I can confirm they have been resettled.' He said, however, there are still a few people camping outside the property on the corner of Nossob Street and Solomon Mahlangu Drive. 'The Human Settlements Department will be dealing with them as soon as possible,' he said. Lesch said over the past two years, he has put in a lot of effort and consulted with many departments and people to find a permanent solution, but also to reactivate the efforts of the Tshwane metro to finalise the resettlement. 'The process of removing the squatters has been coming for years, with multiple previous mayors involved in possible relocations.' Lesch added that the teams involved in the relocations have explored different options and tried different funding models to resolve the matter. 'Different departments of the City of Tshwane, community members and NPOs assisted. I could not always communicate what exactly was done because the information could be used to stall the efforts, as in the past,' he explained. 'The relocation was also important to ensure that the people who lived on the land were moved to a suitable environment. Our wetlands are protected, and it is heart-breaking to see the level of decay and pollution in this area.' According to Lesch, the property is now guarded, and repair of the fences has started. 'Rehabilitation will be done, and I am thankful for those who committed to assist with the rehabilitation process. From my observation, the basic rehabilitation may take several weeks to months to complete.' He said the resettlement now opens the way or planned development on nearby properties to go ahead, and for the protection of the environment to gain momentum. 'I must thank everyone in the community who supported me in this effort, especially those who lifted me up during the times that things did not progress as planned.' Gauteng High Court orders Meta to shut child porn accounts targeting SA learners
The Gauteng High Court in Johannesburg has ordered tech giant Meta to shut down anonymous Instagram accounts and WhatsApp channels distributing explicit child pornography involving South African learners. According to The Witness, Judge Mudunwazi Makamu granted the order yesterday after an urgent application by the Digital Law Company, directed by social media law expert Emma Sadlier. Makamu agreed with advocate Ben Winks's arguments that children were being victimised through the distribution of explicit material. Makamu ordered Meta to permanently shut down all linked accounts and channels and to 'disable the creator of the WhatsApp channels and Instagram profiles listed… from creating any further WhatsApp channels and Instagram profiles'. The company must also provide Digital Law Company with 'all information' in its possession about the creators. 'The respondents shall, before 12:00 on July 15, furnish to the applicant all information in the first respondent's possession pertaining to the creator(s) of the WhatsApp channels and Instagram profiles.' Sadlier confirmed that The Digital Law Company obtained a High Court order against Meta to shut down certain anonymous Instagram accounts and WhatsApp Channels distributing child pornography. Urgent action to protect children Sadlier confirmed the High Court order against Meta, describing it as crucial for protecting children from online exploitation. 'We count our lucky stars to be able to work with such extraordinary legal minds who understand how important it is to protect our children in this damn crazy world,' she said. She explained that the person behind the Instagram profiles and WhatsApp channels appeared to be the same individual using similar aliases and uploading intimate content received from others. 'It goes without saying that the uploading and distribution of this content is a crime, a flagrant disregard of the law and an egregious violation of constitutional rights, including… the rights to dignity, privacy, the best interests of a child and psychological integrity,' she said. The channels reportedly included explicit images and videos of South African learners, some filmed in school bathrooms. Yesterday, Digital Law Company launched urgent legal action, saying a WhatsApp channel with over 11 000 followers – mostly children – had threatened to publish 'everything' that evening. In a letter to Meta, the company's attorney, Rupert Candy, warned: 'If you do not ensure the deletion of the WhatsApp channels and Instagram profiles before then, the lives of numerous South African children will be irreparably harmed, with potentially suicidal consequences.' Sadlier said investigations revealed the person behind the profiles was soliciting sexual content from learners and distributing it to large audiences on WhatsApp community channels and Instagram profiles. 'The affected individuals face the imminent and irreparable dissemination of their most sensitive and intimate information,' she said.
