Tasmac code that allowed action against staff sans inquiry abolished
The ruling was given by Justice A D Maria Clete on the petitions filed by Tamil Nadu Tasmac workers union seeking the court to quash the 'Code of Prevention and Detection of Fraudulent Acts in Tasmac-2014' brought into force by the TN government's liquor business entity, stating it was in violation of the Tamil Nadu Model Standing Orders and provided for punishments which are not prescribed in the model standing orders.
Justice Maria Clete, in the recent judgment, held that fundamentally Tasmac cannot implement a new code without securing certification of standing orders in accordance with law.
'The justification sought to be advanced for the 2014 code based on the Tamil Nadu Prohibition Act, 1937, is wholly misplaced, as that enactment has no bearing on the disciplinary action to be taken against workmen for alleged misconduct. The Prohibition Act does not confer any authority upon Tasmac to frame rules or regulations governing service conditions,' she said.
The judge also noted that the 2014 code 'clearly constitutes a transgression' of the prohibition imposed under section 9A of the Industrial Disputes Act, 1947, that mandates issuance of a prior notice to the workers.
Expressing concern about the Tasmac – having 4,820 retail liquor outlets and a workforce of about 24,000 – not complying with the orders of the high court categorically directing it to adhere to the model standing orders for taking disciplinary action, the judge noted that it has persistently disregarded its legal obligations.
Apart from striking down the 2014 code, the judge also quashed the communication sent to the union by the Joint Commissioner of Labour (JCL), Chennai, who had endorsed the code stating it is in consonance with the model standing orders.

New Delhi: In a setback to Bollywood actor Jacqueline Fernandez , Delhi High Court on Thursday dismissed her plea to end criminal proceedings in a Rs 200-crore money laundering case involving Sukesh Chandrasekhar, currently imprisoned for fraud. Justice Anish Dayal dismissed the plea that also sought to quash the chargesheet by the Enforcement Directorate and proceedings pending before the special court under the stringent Prevention of Money Laundering Act (PMLA) against her and others. She appeared before ED for questioning in the investigation launched after Delhi Police booked Chandrasekhar for extortion and cheating Aditi Singh, wife of former Ranbaxy promoter Shivinder Singh, of Rs 200 crore. While police investigated Chandrasekhar's activities of alleged extortion and fraud from inside jail, ED named Fernandez as an accused in the money laundering probe. In her defence, the actor contended that if as per ED's claims, money was distributed among other individuals too, then everyone involved, be it a grocery vendor, court officials or lawyers, could be deemed guilty of money laundering. She questioned the premise that any financial transaction involving a criminal automatically constitutes money laundering, suggesting such an interpretation would create undue fear. The actor said that she was an innocent victim of Chandrasekhar's "maliciously targeted attack". "There is absolutely no indication she had any involvement whatsoever in aiding him to launder his purportedly ill-gotten wealth. Hence, she cannot be prosecuted for the offences under sections 3 and 4 of PMLA," her plea said. However, ED opposed any relief, submitting Fernandez continued to enjoy Chandrasekhar's gifts despite being aware of his criminal antecedents. The agency also pointed out a special court took cognisance of the prosecution complaint (chargesheet) and prima facie found a case. The cognisance order was not challenged, ED said, adding there are other ongoing investigations against Chandrasekhar across the country. Chandrasekhar and his wife Leena Paulose, facing proceedings in a money laundering case of ED, were arrested by Delhi Police, which invoked MCOCA. The duo allegedly used hawala routes and created shell companies along with other accused persons to park the money earned as proceeds of the crime.

Kolkata: The Calcutta High Court on Thursday directed the state to submit a report on the progress of the investigation into the campus rape and the case diary. The incident is being probed by the Kolkata Police detective department, along with an SIT, and the survivor's counsel told the court "she was getting all support from the SIT". The matter will be next heard on July 10. In the PILs, the petitioner questioned the "unfettered entry" of accused Monojit Mishra, a former student, to the campus, especially beyond academic hours. The rape reportedly took place between 7.30 pm and 10.50 pm inside the guard's room beside the students' union room. The petitioners also pointed at the absence of CCTV cameras, lack of gender-sensitive safety protocols and institutional indifference in the violation of Articles 14, 15, 19, and 21 of the Constitution. Justice Sen asked for a response from the college administration over the litigants' allegations. State counsel Kalyan Banydopadhyay told the judge, "We have done everything. After an FIR was registered, within three hours, a woman police officer arrested the prime accused." The judge clarified that at this point, the HC's only concern was the probe's progress. It was pointed out that the survivor's family was not made a party in the case. Arindam Jana, representing the family, said they prayed to be added as a party, and that the survivor's identity should not be revealed at any cost. The advocate-on-record for the family is Yuvraj Chatterjee. Bandyopadhyay told the court that a few girls from the college had been shown on channels and social media, which might have created an impression that one of them was the survivor. "It demeans the modesty of the survivor and the female, who have been shown with a mistaken identity. If required, an advisory shall be issued by the state home department to all media houses and to lodge appropriate complaints if in the social media any such attempt is made to confuse the survivor's identity," the judge directed. One of the PILs filed by Souma Subhra Ray had an error and was dismissed. The state counsel said the petition seemed to have been copy-pasted. Justice Sen asked the petitioner to re-file the plea.

Jewellery, Cash Stolen From Delhi Government Officer's Home During Trip: Cops
New Delhi: Expensive jewellery, lakhs in cash and foreign currency were stolen from the central Delhi residence of a government officer while he was travelling abroad with his family, police said on Thursday. According to the FIR registered at the Tughlaq Road police station, the government officer had left for Spain and Italy for vacation with his family on June 13 and was scheduled to return to India on the night of June 29. Around 8.47 am that day, while he was at the Abu Dhabi airport in transit to Delhi, his house help, Janki, informed him over the phone that the main door of his residence was broken, the complaint read. "The homeowner immediately asked her to inspect the house along with their residential guard, Manish Kumar. On entering, they found one safe broken and cupboards open. He then directed the guard to call the police. A PCR call was made and police personnel later reached the spot," it said. The officer and his family reached their house at 9.30 pm. Only then were the missing items confirmed. According to the complainant, the stolen items included two sets of gold bangles weighing around 115 grams, a diamond-studded bracelet of about 16 grams, a gold chain, a gold pendant, earrings, five gold rings, three additional sets of earrings, around Rs 4-5 lakh in cash and approximately 18,000 Thai Baht received as daily allowance on official trips. Most of the stolen jewellery belonged to the officer's wife, read the FIR. The officer said more valuables might be missing, which would be reported once identified. The complainant expressed suspicion that someone familiar with the house and its layout may have been involved in the theft, as only specific locations where cash and jewellery were kept appeared to have been targeted. Crime and forensic teams have inspected the house and CCTV footage from nearby locations is being examined, police said.
