Ministry of Awqaf releases fourteenth book on jurisprudential principles in exchange contracts

QNA Doha The Department of Islamic Research and Studies at the Ministry of Endowments and Islamic Affairs (Awqaf) has released the fourteenth book in the Research and Scientific Papers series on jurisprudential principles in exchange contracts by Qatari researcher Abdulaziz Mohammed Al Jaber, comprising 280 pages. Director of the Department of Islamic Research and Studies HE Sheikh Dr. Ahmed bin Mohammed bin Ghanem Al Thani explained that the book is a scholarly thesis submitted for a master's degree at Qatar University. He added that it is a scientific effort that highlights the contributions of Hanbali jurists in deducing jurisprudential principles in transactional chapters, particularly in sales, salam contracts, and leasing, within the school of Imam Ahmad ibn Hanbal. He said that this publication represents a significant cultural contribution to introducing the Hanbali methodology in transaction jurisprudence. He noted that it aligns with the ministry's efforts to support Qatari researchers and encourage serious Islamic studies through the Research and Scientific Papers series, which focuses on publishing distinguished academic theses in Islamic sciences. The book aims to demonstrate the impact of deducing jurisprudential principles in exchange contracts by analysing jurisprudential applications in the chapters of sales, salam, and leasing. It relies on three main methodologies: inductive, analytical, and applied, in studying the principles, extracting them from the school's texts, analysing them, and applying them to both classical and contemporary jurisprudential issues. The book includes a preliminary introduction and three main chapters. The first addresses the use of jurisprudential principles in the chapter of sales, the second in salam contracts, and the third in leasing. Additionally, a preliminary chapter discusses the concepts of deduction, jurisprudential principles, and exchange contracts. Among the key findings of the research is that Hanbali jurists permit reliance on jurisprudential principles in the absence of explicit texts and acknowledge the designation of a principle as universal despite the existence of certain exceptions. The book also addresses contemporary issues such as instalment-based sales and the criteria for price determination using indicators. The researcher recommends the application of jurisprudential principles in addressing emerging financial exchange contracts, supporting contemporary jurisprudential reasoning, and enhancing the flexibility of Islamic jurisprudence in adapting to changes. The Research and Scientific Papers series, launched by the Ministry of Endowments and Islamic Affairs in 2018, is dedicated to publishing distinguished scientific research to support Qatari researchers in the fields of jurisprudence and Islamic studies and to promote the status of scientific research in society.
