Delhi court upholds magistrate's order refusing probe against NDMC officials

The court was hearing a revision petition by Vishal Parashar, a contractor, who alleged that he was assaulted, threatened, and wrongfully detained by four NDMC officials, including a chief engineer, an executive engineer and two security officials, in the civic body's Palika Kendra office on March 10, 2023.
Parashar then filed a plea in a magisterial court seeking a summons against the accused and an investigation, but it was dismissed in March this year on the grounds that the complaint was 'unsubstantiated and potentially motivated by ongoing civil or contractual grievances with NDMC".
Against the magistrate's order, Parashar filed the present appeal.
In an order dated July 23, the court said, 'In cases involving allegations against public servants in restricted government premises, courts must exercise heightened scrutiny to shield officials from vexatious litigation arising from official duties." Flagging the issue of Parashar not providing a valid proof of entry and lack of permission to meet the chief engineer, it trashed his claim that no pass was demanded from him ever since he started visiting the office in 2017.
'The magistrate's reasoning is precise and justified, reinforcing that such unsubstantiated claims cannot form the basis for criminal prosecution," the court said.
It said that the magistrate had correctly discerned that the petitioner's grievances stemmed from protracted civil disputes involving contractual payments, RTI appeals, and claims against NDMC.
The court said the alleged incident arose during an unsolicited visit to discuss these matters, indicating an ulterior motive to leverage criminal proceedings as a tool to coerce the release of approximately Rs 15 lakh in pending dues.
The court further noted that the magistrate had also correctly flagged other issues, such as the absence of independent public witnesses and the lack of corroboration of the allegations.
It said, 'The magistrate appropriately underscored that the issuance of summons under Section 204 of Code of Criminal Procedure demands judicial satisfaction of sufficient grounds, rather than a mechanical exercise." 'The order's comprehensive analysis— encompassing vague allegations, evidentiary deficits, and the underlying civil motives— reflects a diligent application of this standard, ensuring that criminal proceedings are not initiated frivolously," the court added.

In a disturbing case of child trafficking, five people, including the father of a newborn, have been arrested in Tamil Nadu's Tiruvarur district for allegedly selling the infant for Rs 1.5 lakh. The male baby has been rescued and is currently under the care of a government-run children's home. The case came to light after a widow, Santoshkumari, alerted police that Dinesh, a local man with whom she had been in a relationship, along with his mother and others, forcibly took away her newborn baby on July 25 while she was returning home from the Thanjavur Government Medical College Hospital, where she had delivered the baby on July 13. Dinesh, who is married and has a child of his own, allegedly conspired with his mother Vasugi and a broker named Vinoth to sell the baby to a childless couple, Radhakrishnan, a Tamil Nadu State Marketing Corporation Limited (TASMAC) employee, and his wife Vimala, from Adichapuram village in Mannargudi taluk. Following the complaint, police registered a case and arrested all five accused: Dinesh, his mother Vasugi, broker Vinoth, and the couple who bought the baby. The infant was successfully traced and rescued by authorities. "We do not want to endanger the newborn by returning him to the mother immediately," a senior police officer told NDTV. "He will be handed over only after proper counselling and evaluation." Tamil Nadu has had a Cradle Baby Scheme since the 1990s, an initiative that allows parents to safely and anonymously surrender unwanted newborns at designated government hospitals and child welfare centers. ED Issues Look Out Notice Against Anil Ambani: Report
A SEBI report allegedly found that R‑Infra, a Reliance Group company, had moved around Rs. 10,000 crore to other group companies through an undisclosed private entity without declaring it as a related party. New Delhi: The Enforcement Directorate (ED) has issued a lookout circular against businessman Anil Ambani, managing director of the Reliance Anil Dhirubhai Ambani (ADA) Group, according to a report by Hindustan Times. The agency is investigating allegations of loan fraud worth thousands of crores by his companies, sources told HT on August 1. The issuance of a lookout circular, or LOC, means that Ambani can no longer leave India without the permission of courts. As per the HT report, Ambani has also been summoned for questioning under the Prevention of Money Laundering Act (PMLA) on August 5. 'We have issued a LOC against Anil Ambani and issued summons to him on August 5 asking him to appear in Delhi for recording his statement under the PMLA in the loan fraud probe,' HT quoted an officer in the Enforcement Directorate (ED) as saying. The unnamed source also said that Ambani would likely be asked about various loans based on findings by the Securities and Exchange Board of India (SEBI), a statutory body under the government of India that regulates securities and the commodity market in the country. The HT report said that the ED searched the premises of 50 companies and 25 people, including senior executives, associated with the Reliance Anil Dhirubhai Ambani Group companies, last week. According to officials, the ED is looking into alleged financial irregularities and collective loan diversion amounting to more than Rs. 17,000 crore by multiple companies under the Group including Reliance Infrastructure (R Infra). According to The New Indian Express, a report by SEBI allegedly disclosed via ED sources accused R‑Infra of moving approximately Rs. 10,000 crore to group companies through an undisclosed private entity named CLE Pvt Ltd – without declaring it as a related party, possibly to avoid approvals from shareholders and audit panels – under the guise of inter‑corporate deposits, equity investments and corporate guarantees. According to the report, these transactions allegedly span across the financial years of 2013 to 2023, with total exposure to CLE reported at Rs. 8,302 crore by SEBI, and write‑offs reaching Rs 10,110 crore during the financial years (FY) 2017–21. Reliance ADA Group rejects allegations The Reliance ADA Group has, however, rejected these allegations, according to the TNIE report. A spokesperson of the Reliance Group said in a statement that the allegation regarding the diversion of ₹10,000 crore to an undisclosed party was a 10-year-old matter and that the company had stated in its financial statements that its exposure was only around Rs. 6,500 crore, the HT report said. As per the statement, R Infra had already publicly disclosed this matter on February 9 this year. 'Through mandatory mediation proceedings conducted by a retired Supreme Court judge and the mediation award filed before the Hon'ble Bombay High Court, Reliance Infrastructure arrived at a settlement to recover its 100 per cent exposure of ₹6,500 crore,' HT quoted the statement as saying. Per the report, the company also claimed that Anil Ambani had not been on the Board of Reliance Infrastructure for more than three years, since March 2022. The ED is also looking into allegations of illegal loan diversion of approximately Rs. 3,000 crore provided by Yes Bank to companies under the Reliance Group, Reliance Home Finance Limited and Reliance Commercial Finance Ltd, between 2017 and 2019. According to the HT report, ED officials had stated last week that Yes Bank promoters received money in their accounts just before the loan was granted to these companies.
